【摘要】：恐怖主義是一種古老的政治或社會(huì)現(xiàn)象,從歷史根源上看已有兩千 多年的悠久歷史。但是在當(dāng)今社會(huì),恐怖主義這個(gè)問題凸顯出來,已成 為當(dāng)今世界一個(gè)相當(dāng)嚴(yán)重的“全球性問題”。 但是目前從國(guó)際上來看,恐怖主義并無一個(gè)準(zhǔn)確的界定,人們所說 的恐怖主義還不是一個(gè)法律概念,而是帶有某種感情傾向或意識(shí)形態(tài)傾 向的概念。雖然我們目前無法從法律的角度給恐怖主義的定義提出一種 能為有關(guān)各方面所普遍接受、共同認(rèn)可的表述,我們還是從法史學(xué)的角 度來分析和論述恐怖主義產(chǎn)生的歷史根源,分析它的產(chǎn)生、發(fā)展到引人 關(guān)注這一系列階段的深刻的歷史背景和民族宗教的歷史原因,分析全球 化導(dǎo)致貧富差距擴(kuò)大、分離主義以及在單極世界秩序背景下,美國(guó)奉行 的武力至上主義激起了弱國(guó)的反抗等其它誘因。
[Abstract]:Terrorism is an ancient political or social phenomenon, which has a long history of more than two thousand years. But in today's society, terrorism has become a serious global problem. But at present, there is no precise definition of terrorism in the international community. What people call terrorism is not a legal concept. It is a concept with an emotional inclination or an ideological inclination. Although we are not currently in a position to put forward a legal definition of terrorism that is generally accepted and agreed upon by all concerned, We also analyze and expound the historical origin of terrorism from the angle of legal historiography, and analyze its emergence. To draw people's attention to the profound historical background of this series of stages and the historical reasons for the ethnic religion, Analysis of the widening gap between the rich and the poor, separatism and, in the context of the unipolar world order, The supremacy of force in the United States provoked resistance from weak states and other causes.
