【摘要】：網(wǎng)上追逃是公安機關(guān)各部門、各警種在日常工作中,發(fā)現(xiàn)可疑人員時,以全國在逃人員信息光盤或者在逃人員信息系統(tǒng)為查詢比對工具,以發(fā)現(xiàn)、緝捕在逃犯罪嫌疑人、被告人以及從監(jiān)獄、勞教等監(jiān)管場所脫逃的犯罪人員的一項偵查行為。 1999年公安機關(guān)第一次開展網(wǎng)上追逃專項行動,并創(chuàng)立“立案地公安機關(guān)負(fù)責(zé)登記逃犯上網(wǎng)信息,戶籍地公安機關(guān)在予以相應(yīng)配合,各地公安機關(guān)負(fù)責(zé)抓捕”的網(wǎng)上追逃運作機制。網(wǎng)上追逃專項行動為維護社會穩(wěn)定、保障社會秩序的順利進行做出了突出的貢獻。然而我國立法并未有網(wǎng)上追逃的相關(guān)規(guī)定,理論界對于網(wǎng)上追逃的研究也不夠深入,所以到目前為止,網(wǎng)上追逃在我國也只是存在一些司法實踐上的經(jīng)驗而已。 為了彌補立法規(guī)定與理論研究的不足,本文對網(wǎng)上追逃的基本概念進行了梳理,并通過對L區(qū)公安局網(wǎng)上追逃活動的實證調(diào)查,發(fā)現(xiàn)網(wǎng)上追逃在司法實踐中存在的諸多問題,并針對以上問題提出了相關(guān)建議和對策。本文共分為四個章節(jié),第一章節(jié)介紹了網(wǎng)上追逃的涵義、特征、性質(zhì)以及意義；第二章節(jié)通過實證研究方法來了解網(wǎng)上追逃的運行現(xiàn)狀；第三章節(jié)總結(jié)了網(wǎng)上追逃司法實踐中所存在的問題；第四章節(jié)提出完善網(wǎng)上追逃的建議與措施。
[Abstract]:Online pursuit and escape is a common task of public security organs. When police branches find suspicious persons in their daily work, they should use the nationwide fugitive personnel information CD-ROM or the fugitive personnel information system as a query and comparison tool, in order to find and arrest criminal suspects at large. The investigation of the accused and the criminals who escaped from prison, reeducation through labor and other places of supervision. In 1999, the public security organs launched the first special operation to pursue and flee on the Internet, and created "the public security organ in the place of filing the case is responsible for registering the information of fugitives on the Internet." The local public security organs cooperate with each other, and the local public security organs are responsible for the operation mechanism of online pursuit and escape. The special action of online pursuit and escape has made outstanding contributions to maintaining social stability and ensuring the smooth progress of social order. However, the legislation of our country does not have the relevant provisions of the online pursuit of escape, and the research on the online pursuit of escape is not deep enough, so up to now, there are only some experience in judicial practice in our country. In order to make up for the deficiency of legislative regulations and theoretical research, this paper combs the basic concept of online pursuit of escape, and through the empirical investigation of the online pursuit activities of the L District Public Security Bureau, it finds that there are many problems existing in the judicial practice of online pursuit of escape. And put forward the related suggestions and countermeasures in view of the above problems. This paper is divided into four chapters, the first chapter introduces the meaning, characteristics, nature and significance of online pursuit, the second chapter through empirical research methods to understand the current operation of online pursuit; The third chapter summarizes the problems existing in the judicial practice of online pursuit, and the fourth chapter puts forward suggestions and measures to improve the online pursuit.
