【摘要】： 本文對我國目前國家工作人員的腐敗現(xiàn)狀進行了具體分析和總體評述。從案件數(shù)量的上升、犯罪金額的增大、涉官級別的趨高，到反腐敗的指導思想、法律、政策、措施及預(yù)防手段等多個側(cè)面，詳盡闡述了上世紀八十年代至今腐敗與反腐敗的現(xiàn)況和發(fā)展走勢。著重分析了腐敗現(xiàn)象得不到根本遏止的主要原因，，認為：反腐敗是一項系統(tǒng)工程，反思治理腐敗工作的經(jīng)驗教訓，最大的失誤在于簡單化地依賴某一方面的行動戰(zhàn)略，而對反腐敗缺乏宏觀的理性思考和系統(tǒng)的總體決策；強調(diào)：在懲治腐敗工作中既要有重罪重罰手段，更要體現(xiàn)輕罪輕罰和有罪必罰的精神；要求：在預(yù)防職務(wù)犯罪的工作中應(yīng)從人性化的角度來設(shè)計預(yù)防措施、制度和方法；同時，對我國目前反腐敗的機構(gòu)設(shè)置以及管轄界限中的立法缺陷等提出了修改意見，對如何有效遏止腐敗現(xiàn)象的發(fā)生、發(fā)展提出了可行性建議；提出：依法治國必先依法治官，必須在維護法治的前提下治理官員的腐敗，決不能以犧牲法治為代價去換取一時的所謂成果。文中對目前在反腐敗實踐中存在的一些不足之處，特別是查處受賄犯罪方面的不足提出了建設(shè)性意見。
[Abstract]:This paper makes a concrete analysis and a general comment on the current situation of corruption of state functionaries in China. From the increase in the number of cases, the increase in the amount of crime, the increase in the level of officials involved, to the guiding ideology, laws, policies, measures and preventive measures against corruption, The present situation and development trend of corruption and anti-corruption since 1980's were described in detail. Focusing on the analysis of the main reasons why corruption cannot be fundamentally curbed, it is considered that anti-corruption is a systematic project, and that the greatest mistake in reflecting on the experience and lessons of corruption management lies in the simplistic reliance on an operational strategy in one area, However, there is a lack of macroscopic rational thinking and systematic overall decision in the fight against corruption, which emphasizes that in the work of punishing corruption, we should not only have the means of heavy punishment for serious crimes, but also embody the spirit of misdemeanour and punishment. Requirements: in the work of preventing job-related crimes, we should design preventive measures, systems and methods from a humanized point of view, and at the same time, put forward some amendments to the establishment of anti-corruption institutions in our country and the legislative defects in the limits of jurisdiction, etc. The paper puts forward some feasible suggestions on how to effectively curb the occurrence of corruption, and puts forward the following points: governing the country according to law must first govern the official according to law, and must govern the corruption of the official under the premise of maintaining the rule of law. We must not sacrifice the rule of law for temporary gains. This paper puts forward some constructive suggestions on the shortcomings in anti-corruption practice, especially in the investigation and punishment of bribery crime.
