【摘要】：公安與軍事部門分別承擔著國家國內(nèi)保衛(wèi)和抵抗侵略的職能，國家安全是軍事的終結(jié)目的，社會穩(wěn)定是公安的終結(jié)產(chǎn)品，因此兩者均主要是通過國家公共職能的履行得以實現(xiàn)這一目標。從這個意義來講，警務(wù)偵查資源的合理配置與利用與軍隊偵查資源的合理配置與利用在實施背景、價值目標和具體舉措等方面十分趨同，并且公安與軍事兩者在財政物質(zhì)儲備、組織機構(gòu)建設(shè)、資源配置等方面也有諸多類似之處，而當前地方警務(wù)改革正在如火如荼的進行，從而為軍隊偵查資源的合理配置與利用研究提供了便利。 軍隊偵查資源的稀缺性決定了必須注重研究偵查資源的合理配置與利用，才有可能獲得最佳的偵查效益。偵查的有效性將支付調(diào)查費用，這就和獲取企業(yè)利潤一樣，必須投入生產(chǎn)成本，但投入和產(chǎn)出的成本不一定是成正比的關(guān)系。在經(jīng)濟領(lǐng)域，重點是成本最低的投入獲取最大的利益，這是最經(jīng)濟的操作之一。一般來說，，軍隊偵查資源的分配也必須遵循相關(guān)經(jīng)濟學費用成本——收益核算的原理和一般規(guī)律。同時在研究軍隊偵查資源配置模式時必須遵循比例與效益、先進科技與依靠群眾相結(jié)合、多方協(xié)作、實事求是等原則。 當前有關(guān)軍人犯罪伴隨著時代的進步呈現(xiàn)出特有的特點，也就使得研究其對策迫在眉急。為了更好地履行新世紀新階段我軍的歷史使命，必須對現(xiàn)行的偵查資源進行合理的配置。同時可以借鑒地方警務(wù)改革的成功經(jīng)驗，并移植軍隊系統(tǒng)內(nèi)部成功的資源配置模式。在刑事訴訟的語境下，應(yīng)當考慮賦予軍事檢察機關(guān)領(lǐng)導偵查的權(quán)力和犯罪嫌疑人及其律師一定的辯護性調(diào)查權(quán)力。在現(xiàn)代社會里，要拓展偵查資源，充分利用現(xiàn)代技術(shù)，建立信息資源共享系統(tǒng)，從而提高偵查效益。 本文共分為五部分。第一部分主要介紹對當前軍隊偵查資源的合理配置與利用的研究緣起，在分析方法的基礎(chǔ)上闡述了研究軍隊偵查資源的合理配置與利用的應(yīng)然性和必然性，從而為下文的研究打開思路。 第二部分主要介紹了相關(guān)概念，主要對與軍事偵查資源相關(guān)的概念做對比研究，并提出軍隊“C4ISR”系統(tǒng)的概念，為下文軍隊偵查資源的合理配置、軍事偵查資源與地方偵查資源的合理利用以及借鑒軍隊“C4ISR”系統(tǒng)的實質(zhì)分析奠定概念層面的理論基礎(chǔ)。 第三部分主要研究軍隊偵查資源合理配置與利用的研究背景，在充分認識軍隊保衛(wèi)工作面臨的嚴峻形勢、當下群眾的信任危機以及偵查資源稀缺性的基礎(chǔ)上，邏輯的為下文偵查資源的合理配置與利用找到“突破口”。 第四部分主要研究當前我國軍隊偵查資源合理配置與利用的原則及優(yōu)先事項，深入思考了一些原則性問題，突出了資源合理配置與利用的優(yōu)先事項，找到了實現(xiàn)這項研究的平衡點。 第五部分是對軍隊偵查資源的合理配置與利用的探索，是本文的重點和落腳點。首先分析了軍隊偵查資源自身的優(yōu)化，立足首先從自身優(yōu)化實現(xiàn)目標；其次是探討軍事資源與偵查資源的合理配置與利用，針對性的移植軍隊“C4ISR”系統(tǒng)，這是本文的創(chuàng)新點；再次對軍內(nèi)與軍外偵查資源的合理配置與利用、司法資源與偵查資源的合理配置與利用等進行了實質(zhì)探索和分析。
[Abstract]:Public security and military departments are responsible for national internal defense and resistance to aggression respectively. National security is the ultimate goal of the military, and social stability is the final product of the public security. Therefore, both of them can achieve this goal mainly through the performance of the public functions of the state. In order to better fulfill our army's historical mission in the new century and new stage, we must rationally allocate the existing investigation resources. In the context of criminal proceedings, we should consider giving military procuratorial organs the power to lead investigation and the defensive investigative power to suspects and their lawyers. This paper is divided into five parts. The first part mainly introduces the origin of the research on the rational allocation and utilization of the current military investigation resources, and expounds the necessity and necessity of the research on the rational allocation and utilization of the military investigation resources on the basis of the analysis method, so as to open the train of thought for the following research.

The fifth part is the exploration of the rational allocation and utilization of the investigation resources of the army, which is the focus and foothold of this paper.
