【摘要】： 本文針對(duì)我國(guó)預(yù)防職務(wù)犯罪工作只重宏觀造勢(shì)不重微觀操作、只重個(gè)案嚴(yán)懲不重整合設(shè)計(jì)的弊端和費(fèi)力不少收效甚微、四面出擊疲于應(yīng)付的局面，以系統(tǒng)論為指導(dǎo)，著眼于當(dāng)前職務(wù)犯罪的整體特點(diǎn)和共同規(guī)律，在深入研究“職務(wù)犯罪”、“機(jī)制”等概念的基礎(chǔ)上，創(chuàng)造性地提出了一套具有實(shí)效功用的“預(yù)防職務(wù)犯罪工作機(jī)制”研究方案。文章充分利用了系統(tǒng)論中整體大于部分之和的原理，，從軟硬件工程與機(jī)制上比較合理設(shè)計(jì)了預(yù)防職務(wù)犯罪工作的操作與運(yùn)行，主張充分調(diào)動(dòng)各方面的積極因素，形成合力，共同構(gòu)建一個(gè)彼此呼應(yīng)、機(jī)動(dòng)靈活、運(yùn)轉(zhuǎn)協(xié)調(diào)、功效持久的預(yù)防職務(wù)犯罪工作機(jī)制。文章既重視“預(yù)防職務(wù)犯罪工作機(jī)制”的整體建構(gòu)，又重視各子系統(tǒng)機(jī)制的微觀操作，具體設(shè)計(jì)了“打擊職務(wù)犯罪機(jī)制”、“防范職務(wù)犯罪機(jī)制”、“預(yù)防職務(wù)犯罪教育機(jī)制”、“預(yù)防職務(wù)犯罪督查機(jī)制”四個(gè)子系統(tǒng)機(jī)制，深刻闡明了它們之間相互依存、相互作用、相互影響的關(guān)系，并且分別從機(jī)制的建設(shè)、機(jī)制的運(yùn)行、機(jī)制的維護(hù)三個(gè)角度對(duì)“預(yù)防職務(wù)犯罪工作機(jī)制”及其四個(gè)子系統(tǒng)機(jī)制進(jìn)行了詳盡的論述。
[Abstract]:In view of the fact that the prevention of job-related crimes in our country only pays attention to macro construction and not micro operation, and only pays attention to the malpractice of individual cases and not emphasizing integrated design, and has little effect on effort, it is hard to cope with the situation, and guided by the theory of system, this paper focuses on the situation in which the prevention of job-related crimes is exhausted. On the basis of deeply studying the concepts of "duty crime" and "mechanism", the author creatively puts forward a set of effective and functional research scheme of "working mechanism of preventing duty crime". This paper makes full use of the principle that the whole is greater than the sum of parts in the system theory, designs reasonably the operation and operation of the prevention of job-related crime from the hardware and software engineering and the mechanism, and advocates to fully mobilize the positive factors in all aspects to form a resultant force. To build a mutually consistent, flexible, coordinated and lasting duty crime prevention work mechanism. The article not only pays attention to the whole construction of the working mechanism of preventing duty crime, but also pays attention to the micro operation of each subsystem mechanism, and designs the mechanism of "cracking down on duty crime" and "preventing duty crime mechanism". The four subsystem mechanisms of "educational mechanism of duty crime prevention" and "supervision mechanism of duty crime prevention" have expounded the relationship of interdependence, interaction and mutual influence between them, respectively, from the construction of mechanism and the operation of mechanism. This paper discusses in detail the working mechanism of duty crime prevention and its four subsystems from the maintenance of the mechanism.
