【摘要】： 社區(qū)矯正是當(dāng)今世界各國(guó)刑罰執(zhí)行理論和實(shí)踐中發(fā)展最快的領(lǐng)域,也是以非監(jiān)禁刑逐步取代監(jiān)禁刑占主導(dǎo)地位的國(guó)際行刑趨勢(shì)的主要標(biāo)志之一。它代表了刑罰由嚴(yán)厲走向?qū)捑彽内厔?shì),是刑罰發(fā)展的歷史潮流。面對(duì)這一歷史潮流,中國(guó)的司法工作者也在努力研究。目前,社區(qū)矯正試點(diǎn)已在全國(guó)近一半以上轄區(qū)開(kāi)展,隨著構(gòu)建社會(huì)主義和諧社會(huì)的實(shí)施,對(duì)社區(qū)矯正這一命題在我國(guó)的理論和實(shí)踐探索還將更為深入。社區(qū)矯正制度實(shí)際反映了對(duì)人權(quán)的真正關(guān)懷,以及對(duì)人的真正關(guān)愛(ài),這也是這個(gè)制度價(jià)值之所在。 本文選擇這一現(xiàn)實(shí)熱點(diǎn)議題,旨在從理論層面和實(shí)踐層面兩個(gè)視角對(duì)國(guó)外和我國(guó)的社區(qū)矯正作一介紹與論述,并重點(diǎn)通過(guò)對(duì)哈爾濱市開(kāi)展社區(qū)矯正試點(diǎn)的實(shí)務(wù)研究,總結(jié)目前開(kāi)展社區(qū)矯正的經(jīng)驗(yàn)與存在的問(wèn)題,探索提出改革和完善我國(guó)社區(qū)矯正制度的構(gòu)想與建議。 推進(jìn)社區(qū)矯正工作是一項(xiàng)復(fù)雜的系統(tǒng)工作,既涉及到刑事司法理念的擅變,又涉及立法、司法、執(zhí)法以及法律監(jiān)督等諸多問(wèn)題。所以,要在借鑒國(guó)外成熟經(jīng)驗(yàn)的基礎(chǔ)上,結(jié)合我國(guó)社區(qū)矯正實(shí)踐,從社區(qū)矯正的理念、制度、立法、機(jī)構(gòu)、人員隊(duì)伍等諸多層面進(jìn)行系統(tǒng)的理性建設(shè),逐步建構(gòu)一個(gè)既與人類(lèi)司法文明的普遍準(zhǔn)則相適應(yīng),又具有鮮明中國(guó)特色的社區(qū)矯正體系。
[Abstract]:Community correction is the fastest developing field in the theory and practice of penalty enforcement in the world, and it is also one of the main symbols of the international execution trend of replacing imprisonment with non-custodial punishment. It represents the trend of penalty from severity to leniency and is the historical trend of penalty development. In the face of this historical trend, Chinese judicial workers are also working hard to study. At present, the pilot of community correction has been carried out in nearly half of the country. With the implementation of building a harmonious socialist society, the proposition of community correction in China will be further explored in theory and practice. The community correction system reflects the real concern for human rights and the real care for human beings, which is also the value of this system. This paper chooses this practical hot topic to introduce and discuss the community correction in foreign countries and China from both theoretical and practical perspectives, and focuses on the practical research of community correction pilot project in Harbin. This paper summarizes the experience and existing problems of developing community correction, and puts forward some ideas and suggestions for reforming and perfecting the system of community correction in China. It is a complicated and systematic work to promote community correction, which involves not only the change of criminal justice concept, but also the problems of legislation, judicature, law enforcement and legal supervision. Therefore, on the basis of drawing lessons from the mature experience of foreign countries and combining the practice of community correction in our country, we should carry out systematic rational construction from many aspects, such as the concept, system, legislation, organization, personnel and so on, of community correction. Gradually construct a community correction system with distinct Chinese characteristics and adapt to the universal norms of human judicial civilization.
