【摘要】：20世紀(jì)90年代以來,以計(jì)算機(jī)及網(wǎng)絡(luò)技術(shù)為核心的信息科學(xué)技術(shù)迅猛發(fā)展,并被廣泛應(yīng)用于社會(huì)各領(lǐng)域,給人類社會(huì)以深遠(yuǎn)影響。電子商務(wù)是信息科學(xué)技術(shù)應(yīng)用于經(jīng)濟(jì)領(lǐng)域的創(chuàng)造,是21世紀(jì)的新經(jīng)濟(jì)模式,由于它具有傳統(tǒng)商務(wù)所不能比擬的優(yōu)越性,引起世界各國(guó)的高度重視,各國(guó)把它作為本國(guó)經(jīng)濟(jì)發(fā)展戰(zhàn)略的重要組成部分。與此同時(shí),計(jì)算機(jī)信息技術(shù)這把“雙刃劍”也為電子商務(wù)領(lǐng)域犯罪創(chuàng)造了條件,在不長(zhǎng)的時(shí)間內(nèi),電子商務(wù)領(lǐng)域犯罪迅速發(fā)展起來,嚴(yán)重威脅著電子商務(wù)的安全,引起了各國(guó)刑事立法、司法及理論研究工作者的高度重視。本文就是從犯罪學(xué)的角度,研究了目前國(guó)內(nèi)外電子商務(wù)領(lǐng)域犯罪的發(fā)展態(tài)勢(shì),了解電子商務(wù)領(lǐng)域犯罪的整體特征,然后分析了這類犯罪的犯罪人結(jié)構(gòu)、犯罪客觀表現(xiàn)等方面的特征,并試圖從犯罪學(xué)、社會(huì)學(xué)的角度分析其產(chǎn)生的原因和條件。關(guān)于電子商務(wù)領(lǐng)域犯罪的對(duì)策,作者認(rèn)為,要有效地防治電子商務(wù)領(lǐng)域犯罪,必須充分考慮電子商務(wù)領(lǐng)域犯罪的特點(diǎn)、我國(guó)電子商務(wù)發(fā)展及立法現(xiàn)狀,從多方面構(gòu)建電子商務(wù)領(lǐng)域犯罪綜合控制體系,包括技術(shù)控制、健全管理、完善立法,以及加強(qiáng)公民網(wǎng)絡(luò)道德和法制教育。
[Abstract]:Since the 1990s, information science and technology with computer and network technology as the core has developed rapidly, and has been widely used in various fields of society, which has a profound impact on human society. E-commerce is the creation of the application of information science and technology in the economic field and the new economic model in the 21st century. Countries regard it as an important part of their own economic development strategy. At the same time, the "double-edged sword" of computer information technology has also created conditions for crime in the field of electronic commerce. In a short period of time, crime in the field of electronic commerce has developed rapidly, seriously threatening the security of electronic commerce. Criminal legislation, judicial and theoretical researchers in various countries attach great importance to it. From the angle of criminology, this paper studies the development trend of the crime in the field of electronic commerce at home and abroad, understands the overall characteristics of the crime in the field of electronic commerce, and then analyzes the criminal structure of this kind of crime. This paper tries to analyze the causes and conditions of crime from the angle of criminology and sociology. With regard to the countermeasures of crime in the field of electronic commerce, the author holds that in order to prevent and cure crimes in the field of electronic commerce effectively, the characteristics of crime in the field of electronic commerce must be fully considered, and the development and legislation of electronic commerce in China should be considered. This paper constructs a comprehensive crime control system in the field of electronic commerce from many aspects, including technical control, sound management, perfection of legislation, and strengthening of citizens' network morality and legal education.
