【摘要】： 本文以保護(hù)家庭中的弱勢群體的合法權(quán)益為視角，在比較和借鑒西方有關(guān)家庭暴力的理論的基礎(chǔ)上，從我國特有的國情和歷史文化傳統(tǒng)出發(fā)，，較為深入地論述了我國家庭暴力犯罪的原因、危害、表現(xiàn)形式和防治對策等問題。 本文分為前言、正文和結(jié)論三個(gè)部分。 前言部分簡單闡述了家庭暴力犯罪的現(xiàn)狀，指出了防治家庭暴力犯罪的重要性。 正文由四章組成。 第一章是家庭暴力犯罪的概念和特征。分析了家庭暴力的概念，在此基礎(chǔ)上提出了廣義的家庭暴力犯罪概念，探討了家庭暴力犯罪的法律特征。 第二章是我國家庭暴力犯罪的現(xiàn)狀、表現(xiàn)形式和危害。闡述了我國家庭暴力犯罪的現(xiàn)狀，分析了家庭暴力犯罪的表現(xiàn)形式，基于婚姻家庭制度的價(jià)值理念和家庭的基本功能論述了家庭暴力犯罪對婚姻家庭和社會秩序的危害。 第三章是我國家庭暴力犯罪的原因分析。在介紹西方有關(guān)家庭暴力原因的理論模式的基礎(chǔ)上，從我國的社會文化和社會結(jié)構(gòu)的特殊性出發(fā)探討了社會變遷、變態(tài)人格和法律調(diào)控不足等因素與家庭暴力犯罪的關(guān)系。 第四章是我國家庭暴力犯罪的防治體系的建構(gòu)。從社會政策的制定、加強(qiáng)婦女解放和男女平等的輿論宣傳等方面論述了防治家庭暴力犯罪的社會對策，在分析了我國防治家庭暴力犯罪的現(xiàn)行立法存在的問題的基礎(chǔ)上提出了防治家暴力犯罪的法律對策。 結(jié)語部分著重闡明了我國家庭暴力犯罪發(fā)生機(jī)制的特殊性，應(yīng)采取完善現(xiàn)行立法與制定專門立法相結(jié)合的方法預(yù)防和懲治家庭暴力犯罪。
[Abstract]:From the perspective of protecting the legal rights and interests of the vulnerable groups in the family, this paper, on the basis of comparing and drawing lessons from the western theories on domestic violence, proceeds from the unique national conditions and historical and cultural traditions of our country. The causes, harms, manifestations and countermeasures of domestic violence crime in China are discussed in depth. This paper is divided into three parts: preface, text and conclusion. The preface briefly expounds the present situation of the crime of domestic violence, and points out the importance of preventing and controlling the crime of domestic violence. The text consists of four chapters. The first chapter is the concept and characteristics of domestic violence crime. Based on the analysis of the concept of domestic violence, this paper puts forward a broad concept of domestic violence crime, and probes into the legal characteristics of domestic violence crime. The second chapter is the present situation, manifestation and harm of domestic violence crime in China. This paper expounds the present situation of the crime of domestic violence in our country, analyzes the manifestation of the crime of domestic violence, and discusses the harm of the crime of domestic violence to the marriage, family and social order based on the value concept of the marriage and family system and the basic function of the family. The third chapter is the reason analysis of domestic violence crime in our country. On the basis of introducing the theoretical models of the causes of domestic violence in the West, this paper probes into the relationship between the factors of social change, abnormal personality and insufficient legal control and the crime of domestic violence from the particularity of social culture and social structure of our country. The fourth chapter is the construction of prevention and cure system of domestic violence crime in our country. From the aspects of the formulation of social policy, the strengthening of public opinion on the emancipation of women and the equality of men and women, this paper discusses the social countermeasures to prevent and cure the crime of domestic violence. On the basis of analyzing the problems existing in the current legislation of preventing and controlling domestic violence in China, the author puts forward the legal countermeasures to prevent and cure the crime of domestic violence. The conclusion part emphasizes on the particularity of the occurrence mechanism of domestic violence crime in our country. We should adopt the method of perfecting the current legislation and making special legislation to prevent and punish the crime of domestic violence.
