【摘要】： 本文分引言、正文和結(jié)論三部分。 引言部分簡(jiǎn)要描述了我國(guó)傳統(tǒng)刑事訴訟觀念中對(duì)國(guó)家權(quán)力和公民權(quán)利 的認(rèn)識(shí)。在此基礎(chǔ)上，認(rèn)為我國(guó)刑事訴訟中偵查權(quán)過分膨脹的觀念原因在 于偵查權(quán)在實(shí)踐中獲得了一種“司法”的地位，并指出我國(guó)刑事訴訟程序 中實(shí)際上存在著以偵查為中心的弊端。 正文分為三部分。 第一部分對(duì)偵查權(quán)的性質(zhì)展開了集中討論。這一部分從兩個(gè)典型案例 出發(fā)，介紹了我國(guó)實(shí)踐中對(duì)偵查權(quán)控制的新動(dòng)向，以及由此引發(fā)的研究偵 查權(quán)性質(zhì)的必要性。論文從一般意義上概括了司法與行政的不同特征，在 此基礎(chǔ)上，通過對(duì)偵查權(quán)特征的分析，，認(rèn)為偵查權(quán)在本質(zhì)上是一種行政權(quán)， 偵查權(quán)和審判權(quán)是國(guó)家行政權(quán)和司法權(quán)在刑事訴訟領(lǐng)域的具體表現(xiàn)形式。 第二部分探討了偵查程序在刑事訴訟中的地位問題。這一部分首先對(duì) 刑事訴訟程序的劃分方式作了研究，認(rèn)為刑事訴訟程序總體上可劃分為偵 查和審判兩大部分。在現(xiàn)代刑事訴訟中，偵查程序是一個(gè)兼具行政特性和 司法特性的復(fù)合程序。針對(duì)偵查程序的地位問題，論文分析了偵查與審判、 起訴的關(guān)系，主張偵查獨(dú)立說。最后，論文考察了偵查職能與治安管理職 能之間的緊密聯(lián)系，從另一個(gè)方面印證了偵查的獨(dú)立地位。 第三部分是對(duì)偵查的司法控制。其中首先論述了控制偵查的必要性， 然后分析了偵查的各種控制方式，指出司法控制方式是其中的重要方面。 論文最后分析了司法審查和人身保護(hù)令制度，主張從保護(hù)公民權(quán)利的角度， 建立獨(dú)立于刑事訴訟領(lǐng)域之外的人身保護(hù)令制度。 結(jié)論則簡(jiǎn)要?dú)w納了全文主要內(nèi)容，重申了作者的基本觀點(diǎn)。
[Abstract]:This paper is divided into three parts: introduction, text and conclusion. The introduction briefly describes the understanding of state power and civil rights in the traditional concept of criminal procedure in China. On this basis, the author thinks that the concept of excessive expansion of investigation power in criminal proceedings in our country has gained a kind of "judicial" status in practice. It also points out that the criminal procedure in our country actually has the malpractice of focusing on investigation. The text is divided into three parts. The first part focuses on the nature of the power of investigation. Starting from two typical cases, this part introduces the new trends in the control of investigation power in China's practice. And the necessity of researching the nature of investigation power. The paper generalizes the different characteristics of judicature and administration in general sense, and on this basis, through the analysis of the characteristics of investigation power, It is believed that the power of investigation is essentially an administrative power, and the power of investigation and jurisdiction is the concrete form of the state administrative power and judicial power in the field of criminal procedure. The second part discusses the status of investigation procedure in criminal proceedings. First of all, this part makes a study on the division of criminal procedure. The author thinks that the criminal procedure can be divided into two parts: investigation and trial. In modern criminal procedure, investigation procedure is a compound procedure with both administrative and judicial characteristics. Aiming at the status of investigation procedure, this paper analyzes the relationship between investigation, trial and prosecution, and advocates the theory of independence of investigation. Finally, the paper examines the close relationship between the investigation function and the public security management ability, and confirms the independent position of the investigation from another aspect. The third part is the judicial control of investigation. Firstly, it discusses the necessity of controlling investigation, then analyzes the various control ways of investigation, and points out that judicial control is an important aspect. Finally, the paper analyzes the system of judicial review and habeas corpus, and advocates to establish a system of habeas corpus independent of criminal procedure from the angle of protecting civil rights. The conclusion briefly summarizes the main contents of the paper and restates the author's basic point of view.
