【摘要】：摘 要 有組織犯罪是困擾當(dāng)今世界各國的一個(gè)嚴(yán)重的社會(huì)問題，也是倍受學(xué)界普遍關(guān)注的熱點(diǎn)問題。近年來，隨著社會(huì)的轉(zhuǎn)型，各種有組織犯罪對(duì)我國正在進(jìn)行的社會(huì)主義現(xiàn)代化經(jīng)濟(jì)建設(shè)和新形勢(shì)下的社會(huì)治安管理秩序都帶來了嚴(yán)重的沖擊和破壞，因此，加強(qiáng)有組織犯罪研究，為司法機(jī)關(guān)更好地懲治該類犯罪獻(xiàn)計(jì)獻(xiàn)策，是廣大學(xué)者義不容辭的義務(wù)。 我國學(xué)界對(duì)有組織犯罪的研究雖然起步較晚，但學(xué)術(shù)的責(zé)任和工作的熱情令人崇然起敬。學(xué)者們以刑法學(xué)和犯罪學(xué)理論為武器，對(duì)有組織犯罪的研究，無論在規(guī)范層面，還是事實(shí)層面上，都達(dá)到了一定的深度。然而，迄今為止，還沒有人對(duì)我國有組織犯罪研究情況進(jìn)行詳盡的梳理和總結(jié)。本文用文獻(xiàn)研究方法，以“范式”為分析工具，對(duì)二十世紀(jì)末中國大陸有組織犯罪研究進(jìn)行力所能及的介評(píng)，以其為今后的研究做一些基礎(chǔ)性的鋪墊工作，這不僅具有一定的理論價(jià)值，也具有相當(dāng)?shù)膶?shí)踐意義。
[Abstract]:Organized crime is a serious social problem that afflicts countries all over the world today. It is also a hot issue that attracts the attention of the academic circles. In recent years, with the transformation of society, various kinds of organized crime have brought serious impact and destruction to the socialist modern economic construction and the social security management order under the new situation. It is an unshirkable duty for scholars to strengthen the research on organized crime and make suggestions for the judiciary to punish such crimes. Although the research on organized crime in Chinese academic circles started late, the academic responsibility and enthusiasm of work make people respect. Scholars take criminal law and criminology as weapons, and the research on organized crime has reached a certain depth in both normative and factual aspects. However, so far, no one has made a detailed summary of organized crime research in China. Using the method of literature research and using the "paradigm" as an analytical tool, this paper makes a review of the organized crime research in mainland China at the end of the 20th century, and makes some basic preparations for the future research. This not only has certain theory value, also has the quite practical significance.
