【摘要】： 隨著時(shí)代的進(jìn)步和發(fā)展,各種智能犯罪和高科技犯罪凸現(xiàn),如何充分利用技術(shù)偵查手段為辦案服務(wù)就成為了當(dāng)前形勢(shì)迫切需要。在法治化的界域內(nèi),具有侵犯性特征的技術(shù)偵查不僅應(yīng)當(dāng)體現(xiàn)程序正當(dāng)性,還要實(shí)現(xiàn)技術(shù)偵查措施有效性與合法性的平衡。在西方國家,偵查機(jī)關(guān)的偵查手段開始日益向技術(shù)化、高隱秘性方向發(fā)展。然而,在我國,技術(shù)偵查的法律規(guī)范卻與偵查實(shí)踐需要極不相稱,有許多問題都有待于法律規(guī)制。目前,將科學(xué)技術(shù)手段運(yùn)用于檢察機(jī)關(guān)查辦貪污賄賂、瀆職侵權(quán)等職務(wù)犯罪案件顯得尤為重要,司法實(shí)踐中,由于受各種因素的影響,技術(shù)偵查問題還沒有得到應(yīng)有的關(guān)注和重視,以致于給目前查處職務(wù)犯罪案件帶來困難。本文就檢察機(jī)關(guān)在查辦職務(wù)犯罪中運(yùn)用技術(shù)偵查的一些相關(guān)問題及立法構(gòu)想作了探析。
[Abstract]:With the progress and development of the times, various intelligent crimes and high-tech crimes have emerged. How to make full use of the technical investigation techniques to serve the handling of cases has become the urgent need of the current situation. In the realm of rule by law, the technical investigation with aggressive characteristics should not only reflect the legitimacy of the procedure, but also achieve the balance between the validity and legality of the technical investigation measures. In the western countries, the investigative techniques of the investigation organs began to develop to the direction of technology and high secrecy. However, in China, the legal norms of technical investigation are not commensurate with the needs of investigation practice, and there are many problems to be regulated by law. At present, it is particularly important to apply scientific and technological means to procuratorial organs in investigating cases of corruption and bribery, malfeasance of duty infringement and other job-related crimes. In judicial practice, due to the influence of various factors, The problem of technical investigation has not received due attention and attention, which makes it difficult to investigate and deal with duty crime cases. This paper probes into some related problems and legislative ideas about the use of technical investigation by procuratorial organs in the investigation of job-related crimes.
