【摘要】：完善的偵查訊問制度一直以來都是學(xué)者們積極探索和追求的目標(biāo)。而一項(xiàng)完善的偵查訊問制度必然是體現(xiàn)了偵查訊問功能并很好地實(shí)現(xiàn)和發(fā)揮了偵查訊問功能，為此研究偵查訊問制度應(yīng)以實(shí)現(xiàn)和發(fā)揮偵查訊問功能為研究視角。本文就嘗試以偵查訊問功能為視角，為我國偵查訊問制度的完善提供思路。本文基本內(nèi)容如下： 第一部分：簡要介紹偵查訊問功能的基本理念包括：偵查訊問功能的概念、特征及偵查訊問同相關(guān)概念的簡要辨析，借此明晰偵查訊問功能的概念。最終得出偵查訊問功能的概念是指偵查訊問在訊問過程中同外部環(huán)境相聯(lián)系的過程中所產(chǎn)生的一種積極作用。 第二部分：主要介紹偵查訊問功能的主要內(nèi)容，依據(jù)偵查訊問作用對象的不同，偵查訊問功能可分為：對個(gè)人的功能、對偵查活動(dòng)的功能、對犯罪預(yù)防的功能。對個(gè)人的功能指的是偵查訊問制度和活動(dòng)對不同的個(gè)人所可能具有的積極作用；其中對個(gè)人的功能可以進(jìn)一步細(xì)分為對犯罪嫌疑人的功能，對社會(huì)大眾的功能。對偵查活動(dòng)的功能是指偵查訊問制度和活動(dòng)對具體案件的偵查活動(dòng)所可能具有的積極作用。對犯罪預(yù)防的功能是指偵查訊問制度和活動(dòng)中所附加的對犯罪預(yù)防所可能具有的積極作用。 第三部分：主要是以偵查訊問功能是否得到實(shí)現(xiàn)和發(fā)揮為衡量偵查訊問制度的標(biāo)尺，簡要分析現(xiàn)行制度的可取與不足之處，并簡要分析偵查訊問制度存在不足的原因。 第四部分：結(jié)合第三部分分析得出偵查訊問制度存在的不足及其原因，以實(shí)現(xiàn)和發(fā)揮偵查訊問功能為目標(biāo)，針對我國現(xiàn)行偵查訊問制度提出完善建議：首先是樹立偵查訊問制度構(gòu)建的三大基本理念，包括：一是全面認(rèn)識(shí)偵查訊問功能，二是平等對待偵查訊問各功能，三是有利于偵查訊問功能實(shí)現(xiàn)；其次是針對現(xiàn)行偵查訊問制度的不足構(gòu)建四大制度、機(jī)制來完善現(xiàn)行偵查訊問制度，包括：一是構(gòu)建鼓勵(lì)犯罪嫌疑人積極供述制度，，二是構(gòu)建非法訊問方法防范制度，三是構(gòu)建偵查訊問及時(shí)總結(jié)機(jī)制，四是構(gòu)建偵查訊問參與犯罪預(yù)防機(jī)制。
[Abstract]:Perfect investigation and interrogation system has always been the goal that scholars actively explore and pursue. A perfect system of investigation and interrogation must embody the function of investigation and interrogation and realize and exert the function of investigation and interrogation. Therefore, the research of investigation and interrogation system should take the realization and exertion of the function of investigation and interrogation as the research angle. This paper tries to provide ideas for the perfection of investigation and interrogation system from the angle of investigation and interrogation function. The basic contents of this paper are as follows: the first part: briefly introduces the basic concepts of the function of investigation and interrogation, including: the concept of the function of investigation and interrogation, the characteristics and the brief discrimination and analysis of the related concepts of the function of investigation and interrogation. In order to clarify the concept of investigative interrogation function. Finally, the concept of investigative interrogation function is defined as an active role of investigation interrogation in the process of connection with external environment. The second part mainly introduces the main contents of the function of investigation and interrogation. According to the different object of investigation and interrogation, the function of investigation and interrogation can be divided into three parts: the function of individual, the function of investigative activity and the function of crime prevention. The function of the individual refers to the positive effect of the investigation and interrogation system and activities on different individuals, in which the function of the individual can be further subdivided into the function of the criminal suspect and the function of the public. The function of investigation refers to the positive role that the investigation and interrogation system and activities may have on the investigation of specific cases. The function of crime prevention refers to the possible positive effect of the system and activities of investigation and interrogation on crime prevention. The third part is mainly based on whether the function of investigation and interrogation has been realized and played as a yardstick to measure the system of investigation and interrogation, briefly analyzes the desirability and deficiency of the current system, and briefly analyzes the reasons for the insufficiency of the system of investigation and interrogation. The fourth part: combined with the third part of the analysis of the system of investigation interrogation and its reasons, with the goal of realizing and giving play to the function of investigation and interrogation. In view of the current investigation and interrogation system in our country, some suggestions are put forward: first, to establish three basic concepts of the construction of investigation and interrogation system, including: first, to fully understand the function of investigation and interrogation, and second, to treat all functions of investigation and interrogation equally. The third is conducive to the realization of the function of investigation and interrogation; secondly, four systems should be constructed to improve the current investigation and interrogation system, including: first, to build up the system of encouraging criminal suspects to give statements actively. The second is to construct the prevention system of illegal interrogation methods, the third is to construct the mechanism of prompt summing up of investigation interrogation, and the fourth is to construct the criminal prevention mechanism of investigation and interrogation participation.
