【摘要】：法律經(jīng)濟(jì)學(xué)是一門對效益問題進(jìn)行實(shí)證性研究的邊緣學(xué)科,它的宗旨就在于通過對有限資源的合理配置,爭取以最小可能的資源花費(fèi)來達(dá)到預(yù)期目標(biāo),即實(shí)現(xiàn)效益的最大化。在刑事偵查過程中,為了實(shí)現(xiàn)偵查目的,必須預(yù)先投入一定的人力、物力和財(cái)力,然而,由于資源的稀缺性,偵查部門的辦案經(jīng)費(fèi)嚴(yán)重短缺,公安機(jī)關(guān)的建設(shè)經(jīng)費(fèi)、裝備經(jīng)費(fèi)、行政辦公經(jīng)費(fèi)和教育培訓(xùn)經(jīng)費(fèi)得不到保障。警力不足,經(jīng)費(fèi)緊張是當(dāng)前偵查機(jī)關(guān)所面臨的兩大難題。另一方面,犯罪的大量增加又是體制轉(zhuǎn)軌、社會轉(zhuǎn)型的必要代價,是現(xiàn)代化進(jìn)程中不可避免的社會現(xiàn)象,要想徹底消滅犯罪是根本不可能的�，F(xiàn)在,擺在人們面前的問題是,如何在有限的資源的基礎(chǔ)上使取得的偵查效果最為明顯,即,使有限資源發(fā)揮出最大效益。這也正是經(jīng)濟(jì)分析所關(guān)注的論題。偵查現(xiàn)狀對經(jīng)濟(jì)分析方法的運(yùn)用提出了現(xiàn)實(shí)性的要求。 將經(jīng)濟(jì)分析的方法引入到偵查領(lǐng)域中,將經(jīng)濟(jì)學(xué)的理論和方法應(yīng)用于偵查中并對其進(jìn)行系統(tǒng)分析,標(biāo)志著刑事偵查研究的方法論上的一次重大變革,填補(bǔ)了我國偵查理論研究的空白。本文正是在對經(jīng)濟(jì)分析進(jìn)行可行性評論的基礎(chǔ)上展開刑事偵查的經(jīng)濟(jì)分析的。
[Abstract]:Law and economics is a marginal discipline that carries on the positive research to the benefit problem. Its aim is to achieve the expected goal with the minimum possible resource expenditure through the reasonable allocation of the limited resources, that is, to realize the maximum benefit. In the course of criminal investigation, in order to achieve the purpose of investigation, a certain amount of manpower, material resources and financial resources must be invested in advance. However, due to the scarcity of resources, the investigation department has a serious shortage of funds for handling cases, the funds for the construction of public security organs, the funds for equipment, Administrative office funds and education and training funds are not guaranteed. The shortage of police force and the shortage of funds are the two major problems faced by the investigation organs at present. On the other hand, the increase of crime is the system transition, the necessary cost of social transformation is the inevitable social phenomenon in the process of modernization, it is impossible to eliminate the crime completely. At present, the problem before people is how to make the investigation effect most obvious on the basis of limited resources, that is, to make the limited resources exert the maximum benefit. This is precisely the topic that economic analysis pays close attention to. The present situation of investigation has put forward the realistic request to the application of economic analysis method. Introducing the method of economic analysis into the field of investigation, applying the theory and method of economics to the investigation and systematically analyzing it marks a great change in the methodology of criminal investigation. It fills up the blank of investigation theory research in our country. In this paper, the economic analysis of criminal investigation is carried out on the basis of the feasibility review of economic analysis.
