【摘要】: 眾所周知,法律教育是塑造人的品質(zhì),預(yù)防犯罪的重要手段,,它對于預(yù)防未成年人犯罪的發(fā)生尤為重要。本文研究的重點就是如何通過法律教育以實現(xiàn)預(yù)防未成年人犯罪的問題。 文章從1999年6月28日第九屆全國人民代表大會常務(wù)委員會第十次會議通過的《中華人民共和國預(yù)防未成年人犯罪法》(以下簡稱《預(yù)防未成年人犯罪法》)出發(fā),以我國未成年人法律教育的實踐為基點,在掌握大量相關(guān)的古今中外文獻資料的基礎(chǔ)上,從犯罪學(xué)、社會學(xué)、教育學(xué)等多學(xué)科的角度,對我國預(yù)防未成年人犯罪的法律教育問題進行了全面的分析和客觀的評價,努力做到揭示本質(zhì),歸納要點,分析特色,吸取精華。 本文共分為四個部分,即緒論部分和分為三章論述的下文部分。 緒論部分主要介紹了對預(yù)防未成年人犯罪的法律教育問題進行研究的起因、以及這項研究具有的理論意義與現(xiàn)實意義。 第一章通過大量的實證資料對目前我國未成年人犯罪的趨勢和類型以及預(yù)防未成年人犯罪的法律教育的現(xiàn)狀進行了考察。通過對未成年人犯罪現(xiàn)狀的考察,旨在證明法律教育對于預(yù)防未成年人犯罪的重要性。而對于預(yù)防未成年人犯罪法律教育現(xiàn)狀的考察,旨在回答目前我國預(yù)防未成年人犯罪法律教育“是什么”和“怎么樣”的問題。 第二章對我國預(yù)防未成年人犯罪的法律教育存在缺陷的原因進行了全面的探析。文章主要是從理論和制度兩個層面宋探討目前我國預(yù)防未成年人犯罪法律教育薄弱的原因。本章的論述旨在回答目前我國預(yù)防未成年人犯罪的法律教育的缺陷“為什么”存在的問題。 第三章探討了我國預(yù)防未成年人犯罪法律教育的實現(xiàn)途徑:通過對我國古代法律資料和英、美等國法律教育理論與實踐資料的整理,探索了許多值得我們借鑒的經(jīng)驗和做法,本章的論述從六個角度展開。本章的論述旨在回答針對目前我國預(yù)防未成年人犯罪法律教育存在的缺陷“怎么辦”的問題。 本文通過以上幾個部分的分析和論述得出的結(jié)論是:法律教育是預(yù)防未成年人犯罪的重要途徑之一,它對于預(yù)防未成年人犯罪的潛移默化的作用是其他預(yù)防手段所不可替代的。深入研究這一問題,對于豐富和發(fā)展法律教育的理論以及完善犯罪學(xué)理論,對于控制和預(yù)防未成年人犯罪都具有相當重要的理論和實踐價值。當然,這項研究的深入,在理論上需要犯罪學(xué)、教育學(xué)、社會學(xué)等多個學(xué)科的參與,在實踐上,則需要政府、學(xué)校、家長、社區(qū)的共同努力。具備了以上理論和實踐兩個方面的條件,法律教育一定能夠?qū)崿F(xiàn)未成年人犯罪的預(yù)防。
[Abstract]:As we all know, legal education is an important means to shape the quality of human beings and prevent crime, which is especially important to prevent juvenile delinquency. The focus of this study is how to prevent juvenile delinquency through legal education. The article proceeds from the Law of the people's Republic of China on the Prevention of Juvenile Delinquency (hereinafter referred to as the Law on the Prevention of Juvenile Delinquency) adopted at the 10th meeting of the standing Committee of the Ninth National people's Congress on June 28, 1999. Based on the practice of legal education for minors in our country, and on the basis of mastering a large number of relevant documents, such as criminology, sociology, pedagogy, and so on, This paper makes a comprehensive analysis and objective evaluation on the legal education of preventing juvenile delinquency in China, and tries to reveal the essence, sum up the main points, analyze the characteristics and absorb the essence. This paper is divided into four parts, that is, the introduction part and the following part, which is divided into three chapters. The introduction mainly introduces the causes of the research on the legal education of preventing juvenile delinquency, and the theoretical and practical significance of this study. The first chapter investigates the trend and types of juvenile delinquency and the current situation of legal education on the prevention of juvenile delinquency through a large number of empirical data. The purpose of this paper is to prove the importance of legal education in the prevention of juvenile delinquency. The purpose of this study is to answer the questions of what and how to prevent juvenile delinquency education in our country. The second chapter makes a comprehensive analysis of the reasons for the defects in the legal education of preventing juvenile delinquency in China. This article mainly discusses the reason why the legal education of preventing juvenile delinquency is weak in our country from the two aspects of theory and system. The purpose of this chapter is to answer the question of why the legal education on the prevention of juvenile delinquency exists. The third chapter discusses the ways to realize the legal education for the prevention of juvenile delinquency in China: through the collation of the ancient legal materials of our country and the theory and practice of legal education in Britain and the United States, it explores many experiences and practices that we should learn from. This chapter discusses from six angles. The purpose of this chapter is to answer the question of "how to do" in the legal education of preventing juvenile delinquency in our country. The conclusion of this paper is that legal education is one of the important ways to prevent juvenile delinquency, and its effect on the prevention of juvenile delinquency is irreplaceable by other means of prevention. The in-depth study of this problem is of great theoretical and practical value for enriching and developing the theory of legal education and perfecting the theory of criminology and for controlling and preventing juvenile delinquency. Of course, the depth of this research requires the participation of criminology, pedagogy, sociology and other disciplines in theory. In practice, it requires the joint efforts of the government, schools, parents, and the community. With the above theoretical and practical conditions, legal education can certainly achieve the prevention of juvenile delinquency.
