【摘要】： 信訪制度是我國社會主義民主政治制度特有的形式之一,是黨和政府聯(lián)系人民群眾的橋梁和紐帶,也是民意表達(dá)的重要渠道和窗口。作為我國信訪工作中不可或缺的組成部分,公安信訪工作為公安機關(guān)積極響應(yīng)人民群眾呼聲、改進自身工作發(fā)揮了巨大的作用。 公安信訪工作是我國信訪工作中不可或缺的組成部分。隨著我國政治、經(jīng)濟、社會、文化事業(yè)的快速發(fā)展,社會矛盾也日益突出,體現(xiàn)在公安信訪工作上就是:公安信訪總量居高不下。如何正確應(yīng)對這種前所未有的嚴(yán)峻形勢,使公安信訪工作有序進行,是每一個公安機關(guān)信訪工作人員需要思考的問題,也是公安機關(guān)應(yīng)對新時期挑戰(zhàn)、把握新時期機遇的要求之一。 本文從公安信訪工作實際出發(fā),分析了公安信訪形勢嚴(yán)峻的原因,認(rèn)為:社會轉(zhuǎn)型帶來的高違法犯罪率、社會矛盾凸現(xiàn)引發(fā)警民沖突、公安機關(guān)職能的泛化、通過公安信訪與通過訴訟等法律途徑解決問題的成本差異明顯、民眾信訪(相信信訪)不信法及公安機關(guān)執(zhí)法不當(dāng)、當(dāng)事人維權(quán)意識的增強,是目前公安信訪總量高發(fā)的主要原因;并詳細(xì)介紹了目前公安機關(guān)的信訪制度。在此基礎(chǔ)上,本文剖析了目前公安信訪存在的問題:人治運作模式弊端明顯,加之缺乏相對客觀、穩(wěn)定的辦案標(biāo)準(zhǔn),處理問題隨意性大;考核片面追求數(shù)據(jù),與切實解決問題的工作宗旨相背離;信訪程序空轉(zhuǎn),未能解決問題;公安信訪機構(gòu)缺乏獨立性,工作人員缺乏專業(yè)性。 同時,本文針對我國目前關(guān)于信訪制度“存”、“廢”的爭論,從公安信訪的群眾基礎(chǔ)、法治產(chǎn)物屬性、橋梁紐帶作用、發(fā)現(xiàn)自身問題的途徑作用以及政治溝通的角度,探討了公安信訪工作的重要性,并就改進當(dāng)前的公安信訪工作進行了以下方面的展望:弱化公安信訪工作對部分問題的救濟功能;改革對公安信訪工作考核的價值取向;以解決群眾反映的治安問題等為公安信訪工作的重點;建立專門的公安信訪機構(gòu),培養(yǎng)專業(yè)的公安信訪工作人員;以公安機關(guān)業(yè)務(wù)主管部門負(fù)責(zé)制原則規(guī)范公安信訪工作的路徑;在加強對公安信訪矛盾事后化解的同時,重視在公安機關(guān)執(zhí)法的“源頭”上提高質(zhì)量,作到案結(jié)事了;對公安機關(guān)的職能進行去泛化處理;進一步完善、健全公安機關(guān)通過信訪渠道收集、報送社情民意的機制;公安機關(guān)在充分挖掘自身潛力開展公安信訪工作外,更要多方借力,內(nèi)外合力,共同破解公安信訪難題;妥善把握個性化處理與一般化處理之間的關(guān)系。本文希望通過上述嘗試,破解公安信訪的難題,為改進公安信訪工作盡綿薄之力。
[Abstract]:The petition system is one of the unique forms of the socialist democratic political system in our country. It is the bridge and tie between the Party and the government to connect the masses of the people, and it is also an important channel and window for the expression of public opinion. As an indispensable part of the work of letters and visits in China, the work of public security letters and visits has played a great role in the public security organs to respond positively to the voice of the people and to improve their own work. The work of public security letters and visits is an indispensable part in the work of letters and visits in our country. With the rapid development of politics, economy, society and culture in our country, social contradictions are becoming more and more prominent, which is reflected in the fact that the total amount of public security letters and visits remains high. How to correctly deal with this unprecedented severe situation and make the work of public security letters and visits go on in an orderly manner is a problem that every public security organ staff member should consider, and it is also a challenge for public security organs to cope with in the new period. One of the requirements for seizing opportunities in the new era. Starting from the reality of the public security petition work, this paper analyzes the reasons for the severe situation of the public security petition and visits, and holds that: the high crime rate brought about by the social transformation, the emergence of social contradictions, the emergence of conflicts between the police and the people, and the generalization of the functions of the public security organs, There are obvious differences in the cost of solving the problem through the legal channels such as public security petition and litigation, the people's petition (believe in petition) does not believe the law and the police organ's improper enforcement of the law, and the enhancement of the party's awareness of protecting the rights of the party. It is the main reason that the total number of public security letters and visits is high at present, and introduces in detail the present system of letters and visits of public security organs. On this basis, this paper analyzes the problems existing in the present public security letters and visits: the malpractice of the operation mode of the rule of man is obvious, coupled with the lack of relatively objective and stable standards for handling cases, the randomness of handling problems, the one-sided pursuit of data by examination, It deviates from the aim of solving the problem; the procedure of letter and visit is idle and fails to solve the problem; the public security petition organization lacks independence and the staff lacks professionalism. At the same time, in view of the current debate about the "existence" and "abolition" of the petition system in our country, this paper analyzes the mass basis of the public security petition, the attributes of the legal products, the role of the bridge link, the role of the way to discover the problems of oneself and the angle of political communication. This paper probes into the importance of the work of public security letters and visits, and looks forward to the following aspects of improving the present work of public security letters and visits: weakening the relief function of the public security letters and visits to some problems, reforming the value orientation of the assessment of the public security letters and visits; To solve the public security problems reflected by the masses as the focus of public security letter and visit work, to establish a special public security letter and visit organization, to train professional public security letter and visit staff; Based on the principle of the responsibility system of the department in charge of the public security organ, the way of the public security petition work should be standardized, while the contradiction between the letter and the visit should be resolved afterwards, the quality of the law enforcement in the public security organ should be improved and the criminal case should be concluded. To deal with the functions of public security organs in a more general way; to further improve and improve the mechanism of collecting public security organs through channels of letters and visits and to report public opinions and feelings; in addition to fully tapping their own potential to carry out public security petition work, the public security organs should make more efforts to do so. Combining internal and external forces to solve the problem of public security letters and visits, and to properly grasp the relationship between individualized and general handling. This paper hopes to solve the problem of public security letters and visits through the above attempts, and do its utmost to improve the work of public security letters and visits.
