【摘要】：近年來我國加大了對(duì)涉黑犯罪的專項(xiàng)打擊力度,而隨著這些打黑案件的告破而來的是越來越多涉黑公職人員的浮出水面,其嚴(yán)重程度令人觸目驚心,如何遏止住這種公職人員參與涉黑案件嚴(yán)重化的趨勢,進(jìn)而徹底根治官員涉黑犯罪成為當(dāng)前黨和政府及學(xué)界高度關(guān)心的問題。本文意圖對(duì)當(dāng)前的公職人員涉黑犯罪現(xiàn)狀進(jìn)行分析研究,探討出解決之道。 要解決這個(gè)問題,需要大量的研究案件資料,從單個(gè)案件資料的收集到整體的數(shù)據(jù)總結(jié),厘清內(nèi)部邏輯,把握趨勢,剖析其存在原因,提出具體的解決方案--預(yù)防和處理的對(duì)策。本文行文便采用了基本概述-原因分析-對(duì)策構(gòu)建的整體架構(gòu),全文共分為三個(gè)部分： 第一部分為公職人員涉黑的整體概述,即基本理論研究,概括了公職人員涉黑定義,將涉黑犯罪綜合為三類,進(jìn)而根據(jù)具體的數(shù)據(jù)以及實(shí)例對(duì)公職人員涉黑的特點(diǎn),發(fā)展趨勢,以及具體危害進(jìn)行了全面而又詳細(xì)的研究和總結(jié)。 第二部分為公職人員涉黑犯罪的原因分析,共從四個(gè)角度來把握公職人員涉黑犯罪具體原因,一是從公職人員的主觀角度來把握,結(jié)合相關(guān)犯罪心理的知識(shí),分析影響公職人員涉黑犯罪的兩類主觀心理。二是從黑社會(huì)犯罪組織的組織動(dòng)因角度來把握,從黑社會(huì)(性質(zhì))犯罪組織不同發(fā)展階段來分析其對(duì)公職人員涉黑犯罪的原因影響力。三是從社會(huì)管理某些層面和區(qū)域的缺失來把握,這也是從當(dāng)前公職人員涉黑的高發(fā)領(lǐng)域分析出發(fā),進(jìn)行的深層次剖析。第四個(gè)原因探析從物質(zhì)驅(qū)動(dòng)的角度把握,物質(zhì)驅(qū)動(dòng)一是指以及當(dāng)前雙軌制下的尋租利益驅(qū)動(dòng),二是指“官黑”結(jié)合的壟斷利益驅(qū)動(dòng)。 第三部分為公職人員涉黑犯罪的對(duì)策構(gòu)建,共有四個(gè)方面,一是強(qiáng)化執(zhí)政為民理念,加強(qiáng)官員思想教育,這部分旨在從思想教育角度解決官員的思想及心理問題。二是嚴(yán)厲打擊涉黑犯罪,通過綜合治理從上游犯罪上把握公職人員涉黑犯罪的預(yù)防。三是加強(qiáng)權(quán)力監(jiān)督制約,完善公務(wù)員利益規(guī)避制度,這主要從體制上解決利益驅(qū)動(dòng)下的公職人員涉黑問題。四是加強(qiáng)政權(quán)建設(shè),重塑傳統(tǒng)文化。這個(gè)從加強(qiáng)政權(quán)建設(shè),和崇尚積極社會(huì)風(fēng)氣的角度宏觀把握對(duì)犯罪的預(yù)防。
[Abstract]:In recent years, our country has stepped up the special crackdown on criminal activities, but with the breaking of these criminal cases, more and more public officials have emerged, the severity of which is shocking. How to stop this kind of public officials taking part in the serious trend of criminal cases, and then thoroughly eradicate the official criminal crime has become a high concern of the Party and the government and academic circles. This paper intends to analyze and study the present situation of public officials' criminal crimes and explore the solutions. To solve this problem, it is necessary to study a large number of case materials, from the collection of individual case data to the overall data summary, to clarify the internal logic, to grasp the trend, and to analyze the reasons for its existence. Put forward the concrete solution-prevention and treatment of countermeasures. In this paper, the author adopts the whole framework of the basic summarization, cause analysis and countermeasure construction. The whole text is divided into three parts: the first part is the whole summary of the public officials involved in the crime, that is, the basic theoretical research. This paper summarizes the definition of public officials' involvement in criminal matters, synthesizes the criminal offences into three categories, and then makes a comprehensive and detailed study and summary of the characteristics, development trends, and specific harm of public officials' involvement in criminal matters according to the specific data and examples. The second part is the analysis of the reasons of the public officials' criminal involvement in the black. The author tries to grasp the specific reasons of the public officials' criminal crimes from four angles, one is from the subjective angle of the public officials, combined with the knowledge of the related criminal psychology. This paper analyzes two kinds of subjective psychology which affect the criminal activities of public officials. Secondly, from the angle of the organization motivation of the underworld criminal organization, this paper analyzes the influence of the underworld criminal organization on the criminal activities of public officials in different stages of its development. The third is from the social management of certain levels and the lack of regional to grasp, this is from the current high incidence of public officials in the field of analysis, in-depth analysis. The fourth reason is from the perspective of material driving. Material driving refers to the rent-seeking interest drive under the current two-track system, and the monopoly interest driven by the combination of "official and black". The third part is the construction of public officials' criminal crime, there are four aspects, one is to strengthen the concept of governance for the people, strengthen the ideological education of officials, this part aims to solve the ideological and psychological problems of officials from the perspective of ideological education. Second, we must crack down on the crime of dealing with the crime and grasp the prevention of the crime of the public officials from the upstream crime. Third, strengthen the power supervision and restriction, perfect the civil servant benefit circumvent system, this mainly solves the problem of the public servant involved in the black matter under the interest drive from the system. Fourth, strengthen political power construction, reshape traditional culture. This macroscopically grasps crime prevention from the angle of strengthening regime construction and advocating positive social ethos.
