【摘要】： 礦山重大安全事故犯罪是目前我國比較突出的一類犯罪,近年來,我國礦山重大安全事故不斷發(fā)生,礦難事故的頻發(fā),對國家、社會財產(chǎn)和公民的生命財產(chǎn)都造成巨大的損失,安全事故總體形勢嚴(yán)峻,重特大礦難事故造成了嚴(yán)重的社會危害,重特大礦山安全事故問題突出,因此對礦山重大安全事故犯罪成因及對策的研究對我國刑事立法及司法實(shí)踐具有重要意義。 本文分5章對礦山重大安全事故犯罪的成因及對策的相關(guān)問題予以研究,第1章是關(guān)于本文選題的背景、文獻(xiàn)綜述及研究方法概括性介紹,從整體上了解文章的寫作背景及選題意義。第2章對煤礦及非煤礦重大安全事故犯罪的現(xiàn)狀及特點(diǎn)進(jìn)行了概述,根據(jù)已有統(tǒng)計數(shù)據(jù)可知我國礦山重大安全事故犯罪頻發(fā),由于立法不完善、懲罰不嚴(yán)厲;第3章探討了造成礦山重大安全事故犯罪的原因,從主客觀兩方面進(jìn)行深入的分析,從根本上遏制礦山重大安全事故犯罪;第4章主要介紹國外關(guān)于礦山重大安全事故犯罪的現(xiàn)狀、特點(diǎn)以及具體處理辦法,進(jìn)而對主要國家關(guān)于礦山安全事故犯罪的具體處理辦法進(jìn)行比較分析,為遏制我國礦山安全事故犯罪提供借鑒意見;第5章對我國關(guān)于礦山重大安全事故犯罪人的懲處的立法及司法實(shí)踐中存在的問題進(jìn)行分析,主要對刑事處罰、行政處罰、刑事附帶民事賠償立法及司法實(shí)踐中存在的問題予以分析;進(jìn)一步提出對礦山重大安全事故犯罪的預(yù)防與治理對策,主要從社會、心理、治安、刑罰等方面進(jìn)行預(yù)防,對礦山重大安全事故犯罪提出了綜合治理的模式,以及通過健全完善相關(guān)法律與規(guī)章制度,并做到嚴(yán)格執(zhí)法來控制,提出如何改造我國有關(guān)礦山安全生產(chǎn)的法律法規(guī),以及在事故發(fā)生后用什么樣的刑罰處罰才能起到強(qiáng)而有力的懲戒、威懾作用,從而降低礦山重大安全事故犯罪的發(fā)生頻率。
[Abstract]:The crime of major mine safety accident is one of the most prominent crimes in our country at present. In recent years, major mine safety accidents have occurred continuously in our country, and the frequent occurrence of mine accidents has caused huge losses to the country, social property and citizens' life and property. The overall situation of the safety accident is grim, and the serious mine accident has caused serious social harm, and the problem of the serious mine safety accident is prominent. Therefore, it is of great significance to study the causes and countermeasures of the major mine safety accidents in our criminal legislation and judicial practice. This paper is divided into five chapters to study the causes and countermeasures of major mine safety accidents. The first chapter is about the background of this paper, literature review and research methods. From the overall understanding of the writing background and significance of the topic. Chapter 2 summarizes the present situation and characteristics of major safety accidents in coal mines and non-coal mines. According to the existing statistical data, the crime of major safety accidents in mines is frequently committed in China, and the punishment is not strict because of imperfect legislation. The third chapter discusses the causes of the major mine safety accident crime, from the subjective and objective two aspects of in-depth analysis, fundamentally curb the mine major safety accident crime; Chapter 4 mainly introduces the present situation, characteristics and specific treatment methods of major mine safety accident crime in foreign countries, and then compares and analyzes the specific treatment methods of mine safety accident crime in major countries. Chapter 5 analyzes the problems existing in the legislation and judicial practice on the punishment of the perpetrators of major mine safety accidents in China, mainly on the criminal punishment, administrative punishment, The problems existing in the legislation and judicial practice of criminal incidental civil compensation are analyzed, and the countermeasures for preventing and controlling the crime of major safety accidents in mines are put forward, mainly from the aspects of society, psychology, public order, punishment, etc. This paper puts forward the mode of comprehensive management of the crime of major mine safety accidents, and puts forward how to reform the laws and regulations of mine safety production in our country by perfecting the relevant laws and regulations, and strictly enforcing the law to control the crime, and how to reform the laws and regulations of mine safety production in our country. And what kind of punishment after the accident can play a strong and powerful punishment, deterrent role, so as to reduce the occurrence of major mine safety accidents crime frequency.
