【摘要】： 司法鑒定人是司法鑒定活動的實施主體,鑒定結論的制作者。司法鑒定人直接決定著鑒定結論的科學性、客觀性、公正性,因而司法鑒定人具有非常重要的作用,并且這種重要性已經(jīng)得到國內外法學界、司法鑒定界的普遍認可。為了保證司法鑒定過程中鑒定結論的客觀性、公正性,必須在法律層面上明確、具體的規(guī)定司法鑒定人的權利、義務、法律責任。而我國現(xiàn)行法律相關規(guī)定或者一片空白,或者問題多多。2005年10月1日生效的《全國人大常委會關于司法鑒定管理問題的決定》使司法鑒定模式發(fā)生轉型,司法鑒定職能從偵查職能、審判職能、行政職能中獨立出來,司法鑒定人失去“官方”背景,司法鑒定人制度越來越走向社會化,這一轉變使得合理配置我國司法鑒定人權責內容,完善我國司法鑒定人權責制度成為當務之急。因此,本文從司法鑒定人權責制度的基本理論入手,通過觀察我國司法鑒定人權責現(xiàn)狀,借鑒西方國家司法鑒定人權責制度的有益經(jīng)驗,研討我國司法解釋、規(guī)章、地方性法規(guī)等關于司法鑒定人權責內容的合理規(guī)定,力圖在對部分現(xiàn)有規(guī)定進行完善和對應有權利、義務、法律責任內容增加的思路下,從法律層面上對我國司法鑒定人權責內容統(tǒng)籌考慮、合理配置,以期達到科學、合理地完善我國司法鑒定人權責制度的最終目標。
[Abstract]:The judicial appraiser is the main body of the judicial identification and the producer of the conclusion. Judicial connoisseur directly determines the scientific objectivity and impartiality of the conclusion. Therefore the forensic expert has a very important role and this importance has been generally recognized by the legal circles both at home and abroad. In order to ensure the objectivity and impartiality of the conclusion in the process of judicial identification, it is necessary to specify the rights, obligations and legal responsibilities of the judicial experts on the legal level. However, the relevant provisions of the current laws in China are either blank or have many problems. The decision of the standing Committee of the National people's Congress on the management of judicial expertise, which came into effect on October 1, 2005, has transformed the judicial expertise model. The function of judicial identification is independent from the functions of investigation, trial and administration, and the judicial expert loses the "official" background, and the system of judicial expert is becoming more and more socialized. This change makes it urgent to rationally allocate the content of the right and responsibility of our judicial connoisseur and perfect the system of the right and responsibility of our judicial connoisseur. Therefore, this paper starts with the basic theory of the system of the right and responsibility of judicial connoisseurs, through observing the present situation of the rights and responsibilities of judicial experts in our country, drawing on the beneficial experience of the system of the right and responsibility of judicial connoisseurs in western countries, discussing the judicial interpretation and regulations of our country. Local laws and regulations and other reasonable provisions on the content of the rights and responsibilities of judicial connoisseurs try hard to improve and correspond to the existing provisions and to increase the content of the contents of rights, obligations and legal responsibilities. In order to achieve the ultimate goal of scientifically and reasonably perfecting the system of the right and responsibility of judicial connoisseurs in our country, the contents of the rights and responsibilities of judicial appraisers in our country are considered as a whole from the legal level.
