法治視角下的警務(wù)績效考評

【摘要】: 二戰(zhàn)以后,特別是20世紀(jì)60年代末70年代初,以美國、英國為代表的西方國家連續(xù)出現(xiàn)一系列的社會(huì)、經(jīng)濟(jì)和政治危機(jī)。官僚行政也受到批判。在此背景下,西方行政學(xué)界提出新公共行政、新公共管理以及新公共服務(wù)等改造性的理論模式,“服務(wù)行政”、“民主行政”、“善治”等日益成為理論研究和實(shí)踐工作的核心概念。這些概念反映了這樣的一個(gè)變革趨勢,即政治民主向行政民主的調(diào)整和發(fā)展。 在這種民主模式的發(fā)展過程中,績效考評扮演著重要的角色,以其公共責(zé)任和公眾滿意度為首要價(jià)值追求,成為公眾民主參政的橋梁。20世紀(jì)90年代中期,中國學(xué)者開始引進(jìn)介紹包括警務(wù)績效考評在內(nèi)的政府績效評估理論,對警務(wù)績效考評指標(biāo)的構(gòu)建、考評方法、考評結(jié)果的運(yùn)用等方面都取得了一些具有理論和實(shí)踐價(jià)值的研究成果。 筆者以一個(gè)城市派出所的績效考評實(shí)踐為視角,觀察到警務(wù)績效考評實(shí)踐中的“異化”。其延續(xù)的依舊是根源于特別權(quán)力關(guān)系理論的傳統(tǒng)警察考績制度,沒有體現(xiàn)民主行政和公眾的滿意。它不止是警察內(nèi)部管理手段,同時(shí)也是一個(gè)與公民相關(guān)的“活法”。警務(wù)績效考評制度屬法律規(guī)則之外的“規(guī)則”,存在著大量違反訴訟規(guī)律的制度設(shè)計(jì),與現(xiàn)代法治的要求不相符合。而且,絕對化自上而下的績效考評,不僅牽涉到警察的法律責(zé)任與自主權(quán)的問題,更涉及到警察在公眾要求與上級指揮沖突時(shí)的行為選擇問題,乃至警務(wù)績效考評規(guī)范的效力外部化問題。而這,對于中國的法治化進(jìn)程和法律實(shí)效無疑是一種深刻的傷害。 本文主要內(nèi)容有四章。第一章是政府績效考評的理論綜述;第二章探討實(shí)踐中警務(wù)績效考評之異化:一個(gè)派出所“行動(dòng)中的法”。第三章介紹西方警務(wù)績效考評及其借鑒;第四章則是完善警務(wù)績效考評的建議。
[Abstract]:After World War II, especially in the late 1960s and early 1970s, a series of social, economic and political crises appeared in the western countries represented by the United States and Britain. Bureaucratic administration has also been criticized. In this context, Western administrative circles put forward new public administration, new public management and new public service, such as "service administration", "democratic administration", etc. Good governance has increasingly become the core concept of theoretical research and practical work. These concepts reflect the trend of political democracy to administrative democracy. In the process of development of this democratic model, performance evaluation plays an important role, taking its public responsibility and public satisfaction as the primary value pursuit, and becoming the bridge of public democratic participation in politics in the mid-1990s. Chinese scholars began to introduce the theory of government performance evaluation, including the police performance evaluation, the construction of police performance evaluation indicators, evaluation methods, The application of evaluation results has made some theoretical and practical research results. From the perspective of the performance appraisal practice of a city police station, the author observes the dissimilation in the practice of police performance appraisal. Its continuation is still rooted in the special power relationship theory of traditional police performance appraisal system, does not reflect democratic administration and public satisfaction. It is not only a means of internal police management, but also a citizen-related "living law." The police performance appraisal system is the "rule" outside the law rule, and there are a lot of system designs that violate the law of litigation, which does not accord with the request of the modern rule of law. Moreover, the absolute top-down performance appraisal involves not only the legal responsibility and autonomy of the police, but also the behavior choice of the police when the public demands conflict with their superiors. Even the effectiveness of police performance evaluation norms externalized. This, for China's legal process and legal effectiveness is undoubtedly a profound injury. There are four chapters in this paper. The first chapter is a theoretical review of government performance appraisal, and the second chapter discusses the alienation of police performance evaluation in practice: a police station "the law in action". The third chapter introduces the western police performance evaluation and its reference, the fourth chapter is to improve the police performance evaluation recommendations.
