【摘要】：網(wǎng)絡(luò)發(fā)展引起了巨大的社會(huì)變遷，它在給人類的物質(zhì)文明和精神文明建設(shè)創(chuàng)造巨大效益的同時(shí)，也催生了新型的社會(huì)犯罪形態(tài)——網(wǎng)絡(luò)犯罪。面對(duì)網(wǎng)絡(luò)犯罪不斷上升和蔓延的態(tài)勢(shì)，關(guān)于網(wǎng)絡(luò)犯罪的原因探討和控制策略研究已成為一個(gè)受到國(guó)內(nèi)外廣泛關(guān)注的熱點(diǎn)。 本研究就是從社會(huì)需要出發(fā)，以犯罪學(xué)中的“犯罪場(chǎng)理論”來(lái)對(duì)網(wǎng)絡(luò)犯罪進(jìn)行研究，目的在于從全新的視角來(lái)考察網(wǎng)絡(luò)犯罪的產(chǎn)生，探尋更為有效的控制體系�！胺缸飯�(chǎng)理論”之所以可以做到犯罪原因論與控制論的統(tǒng)一，是因?yàn)榉缸飯?chǎng)具有促成犯罪原因轉(zhuǎn)化為犯罪行為的功能，通過(guò)阻隔犯罪場(chǎng)便可阻止犯罪行為產(chǎn)生，所以它既可以解釋犯罪如何產(chǎn)生，又可以反過(guò)來(lái)解釋如何使犯罪不產(chǎn)生。 具體研究過(guò)程，，首先是對(duì)國(guó)內(nèi)外網(wǎng)絡(luò)犯罪研究的歷史認(rèn)真考察和總結(jié)，提出以犯罪場(chǎng)理論重構(gòu)網(wǎng)絡(luò)犯罪研究的理論主張，即網(wǎng)絡(luò)犯罪場(chǎng)研究；然后通過(guò)借鑒“犯罪場(chǎng)理論”來(lái)界定網(wǎng)絡(luò)犯罪場(chǎng)的概念，剖析網(wǎng)絡(luò)犯罪場(chǎng)的結(jié)構(gòu)形態(tài)和功能作用，揭示網(wǎng)絡(luò)犯罪場(chǎng)的特殊性及其在網(wǎng)絡(luò)犯罪的社會(huì)原因和個(gè)體原因轉(zhuǎn)化為網(wǎng)絡(luò)行為過(guò)程中的重要作用；最后基于網(wǎng)絡(luò)犯罪發(fā)展的一般規(guī)律，探尋“入世”后我國(guó)未來(lái)網(wǎng)絡(luò)犯罪的變化趨勢(shì)，并建構(gòu)網(wǎng)絡(luò)犯罪場(chǎng)控制體系以變革當(dāng)前的網(wǎng)絡(luò)犯罪控制模式。
[Abstract]:The development of network has caused great social changes. It not only creates great benefits for the construction of material civilization and spiritual civilization of human beings, but also gives birth to a new form of social crime-network crime. In the face of the rising and spreading situation of cybercrime, the research on the causes and control strategies of cybercrime has become a hot topic which has received extensive attention both at home and abroad. This study is based on the needs of the society. The purpose of this study is to investigate the emergence of cybercrime from a new angle of view and to explore a more effective control system. The reason why "Crime Field Theory" can unify the theory of crime cause and cybernetics is that the crime field has the function of promoting the transformation of the crime cause into the criminal behavior, and can prevent the crime from occurring by blocking the crime field. Therefore, it can not only explain how crimes occur, but also explain how crimes do not occur. The specific research process, first of all, is a careful review and summary of the history of research on cybercrime at home and abroad. This paper puts forward the theoretical proposition of reconstructing the research on network crime with the theory of crime field, that is, the study of network crime field, and then defines the concept of network crime field by using the theory of crime field for reference, and analyzes the structure, form and function of network crime field. It reveals the particularity of the network crime field and its important role in the process of transforming the social reason and individual reason of the network crime into the network behavior, and finally, based on the general law of the development of the network crime, This paper explores the changing trend of the future cyber crime after China's entry into WTO, and constructs the cybercrime field control system in order to change the current cybercrime control mode.
