【摘要】：當(dāng)今時(shí)代網(wǎng)絡(luò)技術(shù)日新異,日益滲透到人們生活的方方面面,成為現(xiàn)代生活不可缺少的重要組成部分,對(duì)于經(jīng)濟(jì)發(fā)展、國家安全、國民教育和現(xiàn)代化管理都起著極其重要的作用,但同時(shí)網(wǎng)絡(luò)犯罪也愈加嚴(yán)重。分析網(wǎng)絡(luò)犯罪的特點(diǎn),并對(duì)網(wǎng)絡(luò)犯罪的防控政策提出一些新的看法和建議,促進(jìn)網(wǎng)絡(luò)文明建設(shè),意義重大。從網(wǎng)絡(luò)犯罪的定義和原因,網(wǎng)絡(luò)犯罪自身的特點(diǎn),系統(tǒng)研究網(wǎng)絡(luò)犯罪,結(jié)合世界計(jì)算機(jī)發(fā)展的趨勢(shì),從立法的層面提出網(wǎng)絡(luò)犯罪責(zé)任追究立法的具體建議,是十分必要的。網(wǎng)絡(luò)犯罪是網(wǎng)絡(luò)信息安全中一個(gè)最為極端的問題,給社會(huì)造成極大危害。要想從根本上遏止網(wǎng)絡(luò)犯罪,就要正確理解網(wǎng)絡(luò)犯罪的概念、產(chǎn)生原因、犯罪特點(diǎn)、犯罪構(gòu)成要件及其在立法領(lǐng)域的完善和對(duì)網(wǎng)絡(luò)犯罪的刑事規(guī)制,惟如此,網(wǎng)絡(luò)犯罪才能得到真正遏止。我國已經(jīng)制定的相關(guān)的法律法規(guī)和規(guī)章,建立了完善的計(jì)算機(jī)保護(hù)體系,對(duì)于保護(hù)和規(guī)范網(wǎng)絡(luò)秩序,發(fā)揮了十分重要的作用。但是信息網(wǎng)絡(luò)立法是一個(gè)全新的領(lǐng)域,對(duì)網(wǎng)絡(luò)信息活動(dòng)所涉及的各個(gè)領(lǐng)域?qū)嵤┝⒎?因?yàn)榫W(wǎng)絡(luò)犯罪不能僅僅把其視為一種以網(wǎng)絡(luò)為作案工具的一般社會(huì)犯罪行為。因?yàn)?網(wǎng)絡(luò)行為也不僅僅在犯罪方面產(chǎn)生負(fù)面影響,同時(shí)也產(chǎn)生了諸多的民事侵權(quán)糾紛。現(xiàn)有法律條文中對(duì)與網(wǎng)絡(luò)相關(guān)的內(nèi)容進(jìn)行補(bǔ)充是不夠的,也是不適應(yīng)網(wǎng)絡(luò)發(fā)展趨勢(shì)的,也不會(huì)起到規(guī)范網(wǎng)絡(luò)行為、確保網(wǎng)絡(luò)安全的作用。同時(shí),對(duì)于網(wǎng)絡(luò)犯罪,在政策層面上還有許多需要修正的地方。因此,制定一個(gè)全新的網(wǎng)絡(luò)法規(guī),加強(qiáng)網(wǎng)絡(luò)犯罪防控政策研究,是當(dāng)今社會(huì)一個(gè)迫切的需求。
[Abstract]:Nowadays, the network technology is becoming more and more new, and it is increasingly infiltrating into every aspect of people's life, and it has become an indispensable part of modern life. For economic development, national security, National education and modern management both play an extremely important role, but at the same time, cybercrime is becoming more and more serious. It is of great significance to analyze the characteristics of network crime and to put forward some new opinions and suggestions on the prevention and control policy of network crime so as to promote the construction of network civilization. It is necessary to study the network crime systematically from the definition and reason of the network crime, the characteristic of the network crime, the trend of the development of the world computer, and put forward the concrete suggestion of the legislation of investigating the responsibility of the network crime from the legislative level. Network crime is the most extreme problem in network information security, which causes great harm to society. In order to stop cybercrime fundamentally, it is necessary to correctly understand the concept of cybercrime, its causes, its characteristics, the elements of crime and its perfection in the field of legislation and the criminal regulation of cybercrime. Only then can cybercrime be really curbed. The relevant laws and regulations have been established in our country, and a perfect computer protection system has been established, which plays a very important role in protecting and standardizing the network order. However, the information network legislation is a new field. It carries out legislation on all fields involved in network information activities, because cybercrime can not be regarded as a general social crime with the network as the criminal tool. Because, the network behavior not only has the negative influence in the crime aspect, but also has produced many civil tort disputes. It is not enough for the existing legal provisions to supplement the contents related to the network, and it is also not suitable for the development trend of the network, nor will it play the role of standardizing the network behavior and ensuring the network security. At the same time, for cybercrime, there are still many areas that need to be corrected at the policy level. Therefore, it is an urgent need to establish a new network law and strengthen the research on the prevention and control policy of network crime.
