【摘要】：隨著改革開放的深入發(fā)展,我國進(jìn)入從傳統(tǒng)社會向現(xiàn)代社會的加速轉(zhuǎn)型期,因各類矛盾、利益沖突、分配不公、干部腐敗、社會運行機制不完善等原因而引發(fā)的群體性事件明顯增多,社會危害性也不斷增強。在這樣的背景下,合理處置群體性事件的已成為維護(hù)我國社會穩(wěn)定的重要因素之一。因此,預(yù)防和化解群體性事件是未來一段時間內(nèi)我國政府的重要任務(wù)。雖然社會各界已經(jīng)開始關(guān)注群體性事件,并積極提出應(yīng)對策略,但是,目前我國還沒有總結(jié)出一套行之有效的預(yù)防和化解群體性事件的機制。行政權(quán)力的不規(guī)范行使是當(dāng)下我國群體性事件產(chǎn)生的最主要、最直接和最嚴(yán)重的原因。這樣不合理的行政現(xiàn)狀引發(fā)諸多群眾的心理不良反應(yīng),并隨著這種不良心理反應(yīng)的積聚和爆發(fā)引發(fā)群體性事件。群眾是群體性事件的參與主體,對群眾心理的加以研究,有利于從根本上化解群體性事件。因此,本文的寫作目的就在于試圖以行政研究和參與者心理研究的結(jié)合為視角,在分析領(lǐng)導(dǎo)機關(guān)不合理、不合法行政行為及其引發(fā)的參與者心理的基礎(chǔ)上,從法律角度為應(yīng)對和化解群體性事件提出建議,以便于盡早的消除群體性事件的不良影響。 因此,本文運用理論分析法和案例分析法,結(jié)合群體性事件中的行政不當(dāng)行為和參與者心理,擬從行政視角分析群體性事件中民眾不良心理產(chǎn)生的原因,并在此基礎(chǔ)上有針對性的提出應(yīng)對策略。文章第一部分就是對全文框架的簡介和行文意義的概述,從四個方面論述了研究群體性事件中參與者心理的必要性。第二部分則是對群體性事件概念和特征做簡要的分析,值得一提的是,本文所寫的群體性事件主要側(cè)重于狹義的群體性事件,即由于行政機關(guān)不規(guī)范行政行為或者行政不作為所引發(fā)的群體性事件。文章第三部分致力于對群體性事件中的不規(guī)范行政現(xiàn)象進(jìn)行分析,從行政角度分析群體性事件產(chǎn)生的潛在原因,以便規(guī)范政府行為,防范群體性事件的發(fā)生。下一部分則是從參與者的角度出發(fā),在第三部分的基礎(chǔ)上,闡述由于政府部門的不規(guī)范行使權(quán)力所導(dǎo)致的,可能引發(fā)群體性事件的民眾不良心理。最后一部分則是本文的意義所在,即針對前文所分析的政府不規(guī)范行為及其所引發(fā)的參與者心理提出相應(yīng)的法律應(yīng)對措施,這些措施主要分為兩個部分,一是法律防范措施,目的在于防患于未然,要求我們的行政領(lǐng)導(dǎo)機關(guān)在日常公共管理過程中采取相應(yīng)措施,防止矛盾的滋生,從而達(dá)到預(yù)防群體性事件發(fā)生的效果,另一部分則是法律應(yīng)對措施,即在群體性事件發(fā)生過程中如何規(guī)范政府行為,以便防止矛盾的激化,并及時化解矛盾。 不合理、合法的行政行為是我國當(dāng)前群體性事件產(chǎn)生的主要原因,參與者是群體性事件的主體,參與者心理是引導(dǎo)參與者政治行為的主要因素,將行政行為、參與者心理有效地結(jié)合起來,并從法律上尋求群體性事件的解決之道,是一種高效便捷的應(yīng)對之策。
[Abstract]:With the deepening of reform and opening up, China has entered a period of accelerating transformation from the traditional society to the modern society. The mass incidents caused by various contradictions, conflicts of interest, unfair distribution, corruption of cadres, and imperfect social operation mechanism have increased obviously, and the social harmfulness is also increasing. In this context, the rational disposal of the group Sexual events have become one of the important factors to maintain social stability in our country. Therefore, the prevention and resolution of group events is an important task of our government in the future. Although all walks of life have begun to pay attention to group events and actively put forward countermeasures, we have not yet summed up a set of effective pretext before the eyes of our country. The non standard exercise of administrative power is the most important, most direct and most serious cause of mass incidents in China. This irrational administrative situation leads to many people's psychological adverse reactions, and with the accumulation and outbreak of this kind of bad psychological reaction, the mass events are caused by the masses. The subject of the participation of group events and the study of the psychology of the masses is beneficial to dissolve the group events fundamentally. Therefore, the purpose of this article is to try to analyze the irrational, unlawful administrative behavior and the psychological basis of the participants in the perspective of the combination of the administrative research and the psychological Research of the participants. From the legal point of view, suggestions are made for coping with and resolving mass incidents so as to eliminate the adverse effects of mass incidents as soon as possible.
Therefore, this article uses the theory analysis method and the case analysis method, combined with the administrative misconduct and the participant psychology in the group events, and intends to analyze the causes of the bad psychology of the masses in the group events from the administrative point of view, and on this basis there are pertinent countermeasures. The first part of the article is the brief introduction and the line of the full text frame. The summary of the meaning of this article discusses the necessity of studying the psychology of participants in group events from four aspects. The second part is a brief analysis of the concept and characteristics of group events. It is worth mentioning that the group events written in this article mainly focus on the group events in the narrow sense, that is, because the administrative organs do not regulate the administrative behavior or the administrative acts. The third part of the article is devoted to analyzing the non standard administrative phenomena in the group events, analyzing the potential causes of the mass events from the administrative point of view in order to standardize the behavior of the government and prevent the occurrence of group events. On the basis of the three part, the author expounds the bad psychology of the masses which may lead to mass events due to the unstandardized exercise of power by the government departments. The last part is the significance of this article, namely, the corresponding measures of legal response to the government's unstandardized behavior and the participants' Psychology caused by the previous article. The main part is divided into two parts, one is the legal precaution, the aim is to prevent the situation, and the administrative organs should take corresponding measures in the process of daily public management to prevent the breeding of contradictions, thus to prevent the occurrence of group events, the other is the legal response, that is, the occurrence of group events. How to regulate the government's behavior in order to prevent the intensification of contradictions and resolve conflicts in time?
Unreasonable, legal administrative act is the main cause of the current group events in our country. The participants are the main body of the group events. The participants' psychology is the main factor to guide the participants' political behavior. It is a high level to combine the administrative behavior, the participants' psychology effectively and seek the solution of the group events from the law. A quick and convenient way to deal with it.
