【摘要】： 我國(guó)農(nóng)村黑惡勢(shì)力犯罪問題日益嚴(yán)重,已對(duì)建設(shè)社會(huì)主義新農(nóng)村構(gòu)成了極大的威脅,嚴(yán)重地影響了農(nóng)村社會(huì)的穩(wěn)定和發(fā)展。因此,系統(tǒng)地研究我國(guó)農(nóng)村黑惡勢(shì)力犯罪具有重大的理論和現(xiàn)實(shí)意義。 根據(jù)學(xué)術(shù)界對(duì)我國(guó)農(nóng)村黑惡勢(shì)力犯罪的研究現(xiàn)狀,筆者對(duì)農(nóng)村黑惡勢(shì)力犯罪這個(gè)概念進(jìn)行了重新界定,具體分析了我國(guó)農(nóng)村黑惡勢(shì)力犯罪的狀況及特征、演化形態(tài)、發(fā)展規(guī)律及社會(huì)危害。 運(yùn)用系統(tǒng)結(jié)構(gòu)犯罪原因論分析了我國(guó)農(nóng)村黑惡勢(shì)力犯罪的成因。一方面,從鄉(xiāng)村關(guān)系即鄉(xiāng)級(jí)政府與村委會(huì)的關(guān)系的角度,分析了我國(guó)農(nóng)村黑惡勢(shì)力犯罪的社會(huì)原因。在當(dāng)前我國(guó)壓力型體制下,鄉(xiāng)村關(guān)系的沖突和矛盾的表現(xiàn)形式主要是:一是當(dāng)前財(cái)政體制所形成的官民之間直接的利益沖突;二是壓力型體制下的干部制度造成的監(jiān)督失效;三是社會(huì)不公和腐敗現(xiàn)象使傳統(tǒng)的政治動(dòng)員手段失靈。指出當(dāng)前鄉(xiāng)村關(guān)系的矛盾和沖突是我國(guó)農(nóng)村黑惡勢(shì)力犯罪的主要原因,國(guó)家對(duì)農(nóng)村社會(huì)控制力的減弱、鄉(xiāng)村宗族的復(fù)興和農(nóng)村黑惡勢(shì)力背后的“保護(hù)傘”對(duì)我國(guó)農(nóng)村黑惡勢(shì)力犯罪也有著重要的影響。另一方面,從心理學(xué)的角度分析了我國(guó)農(nóng)村黑惡勢(shì)力犯罪的個(gè)體原因。 根據(jù)我國(guó)農(nóng)村黑惡勢(shì)力犯罪的形成原因,提出了控制我國(guó)農(nóng)村黑惡勢(shì)力犯罪的對(duì)策。對(duì)我國(guó)農(nóng)村黑惡勢(shì)力犯罪的控制應(yīng)從兩方面采取措施:一是對(duì)我國(guó)農(nóng)村黑惡勢(shì)力犯罪的預(yù)防對(duì)策,包括對(duì)現(xiàn)行鄉(xiāng)村關(guān)系進(jìn)行調(diào)整和改革、發(fā)展和完善農(nóng)村社會(huì)中介組織、做好“兩勞”人員的幫教工作等;二是對(duì)我國(guó)農(nóng)村黑惡勢(shì)力犯罪的打擊對(duì)策,包括加大對(duì)農(nóng)村黑惡勢(shì)力犯罪的打擊力度和堅(jiān)決懲處農(nóng)村黑惡勢(shì)力背后的“保護(hù)傘”。
[Abstract]:The criminal problem of the evil forces in rural areas is becoming more and more serious, which has posed a great threat to the construction of a new socialist countryside and seriously affected the stability and development of the rural society. Therefore, it is of great theoretical and practical significance to systematically study the crime of evil forces in rural areas. According to the current situation of the research on the crime of the rural black and evil forces in the academic circles, the author redefines the concept of the crime of the rural black and evil forces, and concretely analyzes the situation, characteristics and evolution of the crime of the rural evil forces in our country. The law of development and social harm. Based on the theory of systematic structural crime, this paper analyzes the causes of the crime of evil forces in rural areas. On the one hand, from the angle of the relationship between the village government and the village committee, this paper analyzes the social reasons for the crime of the evil forces in the countryside. Under the pressure-type system in our country, the main forms of conflict and contradiction in rural relations are as follows: one is the direct conflict of interests between the officials and the people formed by the current financial system, the other is the failure of supervision caused by the cadre system under the pressure-type system. Third, social injustice and corruption make the traditional means of political mobilization malfunction. It is pointed out that the contradiction and conflict of the current rural relations are the main reasons for the crime of the evil forces in rural areas, and the state's ability to control the rural society is weakened. The revival of rural clans and the "protective umbrella" behind the evil forces in rural areas also have an important influence on the crimes committed by the evil forces in rural areas. On the other hand, from the angle of psychology, the author analyzes the individual causes of the crime of the evil forces in rural areas. According to the formation reason of the crime of the evil force in the countryside of our country, this paper puts forward the countermeasures to control the crime of the evil force in the countryside of our country. Two measures should be taken to control the crime of the evil forces in rural areas: first, to prevent the crime of the evil forces in the countryside, including the adjustment and reform of the current rural relations, and to develop and perfect the intermediary organizations of the rural society. It is necessary to do a good job in helping and educating the personnel of the "two labor forces", and second, to crack down on the crimes committed by the black and evil forces in rural areas, including to step up the crackdown on the crimes committed by the black and evil forces in the rural areas and to resolutely punish the "protective umbrella" behind the evil forces in the countryside.
