【摘要】： 犯罪是階級社會特有的產物,研究其成因、發(fā)展及應對措施是犯罪學這門學科的主要任務。傳統的犯罪防治策略主要是以犯罪和犯罪人為主軸而展開的思維路線,這種思維模式在很長一段時期內持續(xù)左右著犯罪學的研究方向并決定了犯罪防治系統的投資比例。然而,曾一度以單一針對犯罪人和潛在犯罪人一方的犯罪防治策略越來越被現實的犯罪境況加以否定,正是這種效果單一的預防現狀印證了傳統單方防治策略的局限性和片面性。傳統的犯罪防治策略的單一格局應當被打破,在新的犯罪防治策略系統中,犯罪預防與被害預防二者同等重要,各居其位,各盡其職,絕對不能漠視或夸大任何一方的效應而造成策略的誤導。本文選擇從被害人和被害預防的角度進行研究,重點針對被害預防問題作出闡釋,從被害預防的概念、特征、地位入手,理清犯罪被害預防的脈絡,分析被害人之所以被害的原因,剖析被害預防的不足,并提出實現預防被害的具體有效措施,完善和構建被害預防體系,從而達到切實有效的犯罪防治之目標。
[Abstract]:Crime is a special product of class society. It is the main task of criminology to study its causes, development and countermeasures. The traditional strategy of crime prevention and control is mainly a thinking line with crime and criminal as the main axis. This mode of thinking continues to control the research direction of criminology for a long period of time and determines the proportion of investment in crime prevention and control system. However, at one time, the crime prevention strategy against the offender and the potential offender was more and more denied by the actual crime situation. It is this kind of single-effect prevention situation that confirms the limitation and one-sidedness of the traditional unilateral prevention and cure strategy. The single pattern of traditional crime prevention and control strategy should be broken. In the new crime prevention strategy system, crime prevention and victimization prevention are equally important. You must never ignore or exaggerate the effects of either party and mislead the strategy. This paper chooses to study from the angle of victim and victim prevention, focusing on explaining the problem of victim prevention, starting with the concept, characteristics and status of victim prevention, and clarifying the context of crime prevention. This paper analyzes the reasons why victims were killed, analyzes the shortcomings of victim prevention, and puts forward concrete effective measures to prevent victims, and consummates and constructs the system of victim prevention so as to achieve the goal of effective crime prevention and control.
