【摘要】：質證是司法證明的基本環(huán)節(jié)之一，作為訴訟當事人的重要權利，它對于司法的公正公平作用巨大。而鑒定意見是特定的當事人運用專業(yè)的知識或技能就某一事實做出的推理意見，這種意見的專業(yè)性及其對法官判斷產生的影響使鑒定意見的充分質證顯得尤為重要。而構建完整的鑒定意見質證程序則是鑒定意見充分有效質證的必要前提，本篇論文對如何完善鑒定意見質證程序進行了研究，文章總共分為五個大部分： 第一部分是緒論，這一部分主要敘述了文章的研究背景、目的及意義、國內外研究現狀和具體的研究方法；第二部分是鑒定意見概述，這一部分主要介紹了關于鑒定意見質證的基本理論，如鑒定意見的證據力和證據效力，鑒定意見質證的重要性，鑒定意見質證的主體及具體內容；第三部分是鑒定意見質證的域外考察。文章對大陸法系國家中的德國、法國、日本以及英美法系國家的美國和英國的鑒定意見質證程序進行了具體考察并簡要評析。然后，通過對比兩大法系國家鑒定意見質證程序，得出了關于完善我國鑒定意見質證程序的啟示；第四個部分首先概括了我國鑒定意見質證的立法現狀，然后總結出了我國的鑒定意見質證程序存在的問題，，并對這些問題產生的原因進行了分析；第五部分是文章的最后一部分，也是核心部分，主要是針對我國鑒定意見質證程序存在的問題，對如何完善我國鑒定意見質證程序提出了具體的建議。
[Abstract]:As an important right of litigant, cross-examination is one of the basic links of judicial proof. The expert opinion is the reasoning opinion made by a particular party on a certain fact by using professional knowledge or skill. The professionalism of this opinion and its influence on the judge's judgment make the full cross-examination of the appraisal opinion particularly important. The construction of a complete appraisal opinion cross-examination procedure is a necessary prerequisite for the full and effective cross-examination of appraisal opinions. This paper studies how to improve the process of cross-examination of appraisal opinions, which is divided into five parts: The first part is the introduction, this part mainly narrates the research background, the purpose and the significance, the domestic and foreign research present situation and the concrete research method; the second part is the appraisal opinion summary, This part mainly introduces the basic theory about the identification opinion cross-examination, such as the evidence power and the evidence effect of the appraisal opinion, the importance of the appraisal opinion cross-examination, the main body and the concrete content of the appraisal opinion cross-examination. The third part is the overseas investigation of cross-examination of appraisal opinions. This paper makes a concrete investigation of the cross-examination procedures of the appraisal opinions of Germany, France, Japan and the United States and the United Kingdom in the countries of civil law system. Then, by comparing the identification opinion cross-examination procedures of the two legal system countries, the author draws the enlightenment of perfecting the identification opinion cross-examination procedure in China. The fourth part summarizes the legislative status quo of the authentication opinion cross-examination in our country. Then it summarizes the problems existing in the process of cross-examination of appraisal opinions in our country, and analyzes the causes of these problems. The fifth part is the last part of the article, which is also the core part. Aiming at the problems existing in the process of cross-examination of appraisal opinions in our country, the paper puts forward some concrete suggestions on how to perfect the procedure of cross-examination of appraisal opinions in China.
