【摘要】：農(nóng)村有組織犯罪是和諧社會中不和諧的重要因素，嚴重危害廣大人民群眾的生命財產(chǎn)安全，影響農(nóng)村的社會穩(wěn)定。有組織犯罪問題已成為影響我國社會治安穩(wěn)定的重要因素，，并在很大程度上決定著我國治安形勢的走向。認真分析研究農(nóng)村有組織犯罪及其成因，提出具體對策意見，對于解決農(nóng)村穩(wěn)定、全國社會治安問題，保持穩(wěn)定的政治環(huán)境和社會秩序，更好更快實現(xiàn)建設(shè)社會主義新農(nóng)村戰(zhàn)略目標都具有重大意義。 本文在考察國內(nèi)外農(nóng)村有組織犯罪研究現(xiàn)狀的基礎(chǔ)上，對農(nóng)村有組織犯罪進行了定性分析，闡明其概念、類型與特征，從政治、經(jīng)濟、文化、法制等不同角度，剖析了農(nóng)村有組織犯罪形成的原因。通過研究我國現(xiàn)行防控農(nóng)村有組織犯罪的法律體系，對現(xiàn)行刑法關(guān)于有組織犯罪的立法精神進行了詳細分析，通過對系統(tǒng)梳理刑法總則、分則關(guān)于有組織犯罪的相關(guān)規(guī)定，為依法懲治農(nóng)村有組織犯罪提供了重要參照，并從四個方面分析了現(xiàn)行刑法對有組織犯罪的立法規(guī)定存在的明顯不足。針對農(nóng)村有組織犯罪產(chǎn)生的原因以及現(xiàn)行防控農(nóng)村有組織犯罪中存在的問題，以大力發(fā)展農(nóng)村經(jīng)濟、提高物質(zhì)生活水平，注重農(nóng)村文化教育、抓好精神文明建設(shè)，加大普法宣傳力度、提高農(nóng)民法律意識，健全社會保障體系、消除農(nóng)民后顧之憂，強化基層政權(quán)組織、提高“兩委”管控能力，修改法律法規(guī)體系、嚴厲打擊有法可依，嚴厲打擊農(nóng)村犯罪、增強法律威懾力等七個方面為主要內(nèi)容，提出了防控農(nóng)村有組織犯罪的對策建議。
[Abstract]:Rural organized crime is an important factor of disharmony in a harmonious society, which seriously endangers the life and property safety of the broad masses of the people and affects the social stability of the countryside. The problem of organized crime has become an important factor affecting the stability of public security in our country, and to a great extent determines the trend of our country's public security situation. Seriously analyzing and studying rural organized crime and its causes, and putting forward concrete countermeasures and suggestions, in order to solve the problems of rural stability, social security throughout the country, and maintain a stable political environment and social order, Better and faster realization of the strategic goal of building a new socialist countryside is of great significance. On the basis of investigating the present situation of rural organized crime research at home and abroad, this paper makes a qualitative analysis of rural organized crime, expounds its concept, types and characteristics, from different angles of politics, economy, culture, legal system, etc. This paper analyzes the reasons for the formation of rural organized crime. By studying the current legal system of prevention and control of rural organized crime in China, the legislative spirit of the current criminal law on organized crime is analyzed in detail, and the relevant provisions of the general and special provisions of the criminal law on organized crime are systematically combed. This paper provides an important reference for punishing rural organized crime according to law, and analyzes the obvious shortcomings of the existing criminal law on organized crime from four aspects. In view of the causes of rural organized crime and the problems existing in the prevention and control of rural organized crime, we should vigorously develop the rural economy, improve the material living standard, pay attention to rural cultural education, and do a good job in the construction of spiritual civilization. To increase the publicity of law popularization, raise the legal awareness of farmers, improve the social security system, eliminate the worries of peasants, strengthen grass-roots political power organizations, improve the ability of the "two committees" to control and control, revise the laws and regulations system, and severely crack down on those who have laws to abide by. Seven aspects such as cracking down on rural crimes and strengthening legal deterrence are the main contents. The countermeasures and suggestions of preventing and controlling rural organized crime are put forward.
