【摘要】：筆者認(rèn)為，，發(fā)生在民航領(lǐng)域的恐怖犯罪，是恐怖犯罪不斷發(fā)展的必然結(jié)果，美國(guó)“9．11”事件無論從犯罪的策劃、實(shí)施手段和過程以及犯罪結(jié)果上都是現(xiàn)實(shí)民航恐怖犯罪的最高水平�！懊窈筋I(lǐng)域”是特指恐怖犯罪發(fā)生的區(qū)域，是恐怖犯罪的下位概念和表現(xiàn)形式。伴隨世界航空業(yè)和人類科學(xué)技術(shù)的迅猛發(fā)展，該類犯罪將長(zhǎng)期困擾民航業(yè)的健康發(fā)展，民航領(lǐng)域恐怖犯罪對(duì)民航業(yè)的安全保衛(wèi)能力(偵查能力和防范能力)提出了強(qiáng)烈的挑戰(zhàn)，對(duì)民航業(yè)安全構(gòu)成長(zhǎng)期的現(xiàn)實(shí)威脅。本文即從民航領(lǐng)域恐怖犯罪的犯罪界定和現(xiàn)實(shí)情況等基礎(chǔ)問題出發(fā)，對(duì)該犯罪的特征、手法和發(fā)展等進(jìn)行理論分析和探討，進(jìn)而提出偵查對(duì)策和防范對(duì)策，以期達(dá)到有效偵查現(xiàn)實(shí)犯罪和有效防范未來犯罪的目的，實(shí)現(xiàn)為確保全球民用航空業(yè)的健康發(fā)展，維護(hù)人類的根本法益產(chǎn)生些許指導(dǎo)和借鑒意義的目標(biāo)。 全文共分四個(gè)部分，共46000字： 引言——本文的寫作背景。首先，介紹了民航領(lǐng)域恐怖犯罪在全球的不斷發(fā)生和發(fā)展，對(duì)民航業(yè)安全提出了更高的要求。其次，介紹了作者創(chuàng)作本文的最初動(dòng)因，即國(guó)內(nèi)有關(guān)民航領(lǐng)域恐怖犯罪研究的匱乏，這種匱乏無助于對(duì)國(guó)內(nèi)偵查和防范民航領(lǐng)域恐怖犯罪的指導(dǎo)。再次，介紹了本文的研究視角，即提高對(duì)民航領(lǐng)域恐怖犯罪偵查和防范的水平，推動(dòng)對(duì)民航領(lǐng)域恐怖犯罪研究的獨(dú)立發(fā)展。 第一部分是民航領(lǐng)域恐陣犯罪概述。闡明民航領(lǐng)域恐怖犯罪是恐怖犯罪的下位概念，通過對(duì)恐怖犯罪概念介紹、類型分析、犯罪特點(diǎn)分析對(duì)民航領(lǐng)域恐怖犯罪作整體性的介紹，進(jìn)而大膽提出作者自己的觀點(diǎn)和預(yù)測(cè)，即對(duì)民航領(lǐng)域面對(duì)的恐怖犯罪的發(fā)展趨勢(shì)和不斷加大的威脅。 第二部分是民航領(lǐng)域恐怖犯罪的偵查對(duì)策。該部分首先確定對(duì)民航領(lǐng)域恐怖犯罪偵查的原則，其次對(duì)民航領(lǐng)域恐怖犯罪偵查基礎(chǔ)工作進(jìn)行闡述
[Abstract]:The author believes that the terrorist crime in the field of civil aviation is the inevitable result of the continuous development of the terrorist crime. The means and process of implementation as well as the result of crime are the highest level of terrorist crime in civil aviation. The field of civil aviation refers to the region where terrorist crimes occur, and is the lower concept and manifestation of terrorist crimes. With the rapid development of the world aviation industry and human science and technology, this kind of crime will haunt the healthy development of the civil aviation industry for a long time. The terrorist crime in the civil aviation field has posed a strong challenge to the civil aviation industry's ability of safety and security (the ability of investigation and prevention). It poses a long-term realistic threat to the safety of the civil aviation industry. Based on the basic problems of the definition and reality of the terrorist crime in the civil aviation field, this paper makes a theoretical analysis and discussion on the characteristics, techniques and development of the crime, and then puts forward the investigative and preventive countermeasures. In order to achieve the purpose of effective detection of real crime and effective prevention of future crimes, to ensure the healthy development of the global civil aviation industry, to maintain the interests of human basic law has some guidance and reference significance. The full text is divided into four parts, 46000 words in total: Introduction-the background of this paper. Firstly, it introduces the continuous occurrence and development of terrorist crimes in the field of civil aviation, and puts forward higher requirements for the safety of civil aviation industry. Secondly, the author introduces the initial motivation of the author's creation of this article, that is, the lack of domestic research on terrorist crimes in the field of civil aviation, which is not helpful to the guidance of domestic investigation and prevention of terrorist crimes in the field of civil aviation. Thirdly, this paper introduces the research perspective, that is, to improve the level of investigation and prevention of terrorist crimes in the field of civil aviation, to promote the independent development of the research on terrorist crimes in the field of civil aviation. The first part is the summary of terrorist crime in civil aviation field. It is expounded that the terrorist crime in civil aviation is the inferior concept of the terrorist crime. Through the introduction of the concept of the terrorist crime, the analysis of the types and the characteristics of the crime, the author makes a holistic introduction to the terrorist crime in the field of civil aviation. Then the author boldly puts forward his own viewpoint and forecast, that is, the development trend and increasing threat to the terrorist crime in the field of civil aviation. The second part is the investigation countermeasure of terrorist crime in civil aviation field. This part first determines the principles of the investigation of terrorist crimes in the civil aviation field, and then expounds the basic work of the investigation of terrorist crimes in the field of civil aviation.
