誘惑偵查法律問(wèn)題初探

【摘要】: 近年來(lái),誘惑偵查作為一種偵查手段已經(jīng)在我國(guó)偵查部門得到運(yùn)用。但圍繞誘惑偵查的爭(zhēng)論可謂眾說(shuō)紛紜、莫衷一是。誘惑偵查,是刑事訴訟中一種特殊的偵查手段,其不當(dāng)適用可能導(dǎo)致偵查陷阱。在美國(guó)判例法上,從對(duì)偵查陷阱的寬容態(tài)度到“陷阱之法理”再到“正當(dāng)程序抗辯”,圍繞誘惑偵查的合法性問(wèn)題,演繹了規(guī)制偵查權(quán)的艱難歷程,折射出偵查程序中關(guān)注人權(quán)保障的深層底蘊(yùn)、由此得到啟示,我國(guó)目前實(shí)踐中誘惑偵查的無(wú)序狀態(tài)也亟待法律規(guī)范。 從本質(zhì)上講,,誘惑偵查的運(yùn)用具有非法性、非理性,它不僅與刑事訴訟的活動(dòng)規(guī)律、法治原則相悖,而且可能帶來(lái)一系列弊端,不利于保障公民的合法權(quán)益。具體應(yīng)遵循以下幾項(xiàng)原則:主體合法原則;必要性原則;報(bào)告及審批原則;引誘對(duì)象非特定性原則;誘餌適當(dāng)原則;消極行為原則;嚴(yán)格監(jiān)督原則;有效控制原則;責(zé)任制原則。 在判斷誘惑偵查合法性的標(biāo)準(zhǔn)上,文章提出了以客觀標(biāo)準(zhǔn)為主,主觀標(biāo)準(zhǔn)為輔的觀點(diǎn)。主張首先看誘惑者客觀上是否采取了誘惑他人犯罪的行為,此種誘導(dǎo)行為本身是否合法,原則上應(yīng)以此來(lái)界定誘惑偵查行為是否合法。只有在特殊情況下,才能允許使用主觀標(biāo)準(zhǔn)來(lái)進(jìn)行判定。由于誘惑偵查具有極大的危險(xiǎn)性,一旦適用不當(dāng),容易陷人于罪,因此,誘惑偵查的立法建構(gòu)應(yīng)當(dāng)對(duì)其適用范圍、適用對(duì)象,審批程序等進(jìn)行嚴(yán)格的控制。
[Abstract]:In recent years, seductive investigation as an investigative technique has been used in our investigation department. But the argument around enticement investigation can be said to have different opinions and different opinions. Enticement investigation is a special investigative technique in criminal procedure, and its improper application may lead to investigation trap. In the case law of the United States, from the tolerant attitude towards the investigation trap to the legal principle of the trap and then to the defense of due process, it deduces the difficult course of regulating the investigation power around the legality of the enticement investigation. It reflects the deep information of paying attention to the protection of human rights in the procedure of investigation, and thus gets the enlightenment. The disordered state of enticement investigation in our country's current practice is also urgent to be regulated by law. In essence, the application of enticement investigation is illegal and irrational. It is not only contrary to the law of criminal procedure and the principle of rule by law, but also may bring a series of malpractices, which is not conducive to the protection of the legitimate rights and interests of citizens. The following principles should be followed: the principle of subject legality; the principle of necessity; the principle of reporting and examination and approval; the principle of non-specificity of enticing object; the principle of appropriate bait; the principle of negative behavior; the principle of strict supervision; the principle of effective control; Principle of accountability On the criterion of judging the legality of enticement investigation, this paper puts forward the viewpoint that objective standard is the main criterion and subjective standard is auxiliary. The author holds that the first step is whether the seducer has taken the act of inducing others to commit a crime, and whether such inducement is legal, in principle, to define whether the act of enticement investigation is lawful or not. Only in exceptional circumstances can subjective criteria be allowed. Because of the great danger of seductive investigation, it is easy to get caught in crime if it is not applied properly. Therefore, the legislative construction of seduction investigation should strictly control its scope of application, applicable object, examination and approval procedure, etc.
