【摘要】： 重新犯罪一直是個(gè)世界性的難題,少年犯作為被監(jiān)禁人群中的特殊主體,其重新犯罪的特征與成年犯相比在犯罪類型、社會(huì)處遇、家庭狀況、年齡結(jié)構(gòu)等方面呈現(xiàn)出許多不同之處,因而也更受關(guān)注。 刑釋少年犯重新犯罪的原因是多重的,可以從不同角度進(jìn)行分析。我國(guó)目前少年司法制度的滯后和缺失直接導(dǎo)致了對(duì)少年犯刑事責(zé)任偏重、少年犯短期自由刑適用偏多等弊端,對(duì)少年犯重新犯罪問題會(huì)產(chǎn)生一定程度的影響;少年監(jiān)禁的基本價(jià)值目標(biāo)之一是預(yù)防和減少重新犯罪,但監(jiān)禁刑本身的弊端如交叉感染、標(biāo)簽效應(yīng)、心理失調(diào)等往往會(huì)使監(jiān)禁的效果與預(yù)期背道而馳;少年犯被刑釋后,社會(huì)幫教和家庭幫教是其重新開始生活的重要?jiǎng)恿?少年犯自身的易感性、不適應(yīng)癥以及畸形的需求對(duì)其再社會(huì)化也會(huì)產(chǎn)生直接的影響。 預(yù)防和減少刑釋少年犯重新犯罪應(yīng)首先從立法入手,修訂刑法,完善未成年人刑事責(zé)任體系,健全和完善工讀教育立法、社會(huì)幫教立法、監(jiān)禁矯治立法;在少年案件的處理上,通過(guò)全面的社會(huì)調(diào)查,查清犯罪原因,使庭審教育和最后的判決更有針對(duì)性,在處理上盡可能多地適用緩刑等非監(jiān)禁刑;在少年犯的監(jiān)禁過(guò)程中,應(yīng)整合社會(huì)各方面的資源和家庭力量,重視心理健康教育,把少年犯的監(jiān)禁場(chǎng)所打造成特殊學(xué)校;少年犯被釋放后,家庭和社會(huì)都應(yīng)予以重視,充分尊重、合理疏導(dǎo),創(chuàng)造多種形式的幫教方法,注重解決刑釋少年犯的實(shí)際問題,為刑釋少年犯的再社會(huì)化創(chuàng)造寬松的環(huán)境和有利的條件。
[Abstract]:Reoffending has always been a worldwide problem. Juvenile offenders, as special subjects in the incarcerated population, have the characteristics of reoffending in comparison with adult offenders in the types of crimes, social situations, family conditions, There are many differences in age structure and so on. There are many reasons for reoffending juvenile offenders, which can be analyzed from different angles. The lag and lack of the current juvenile justice system in our country has directly led to the disadvantages of paying more attention to the criminal responsibility of juvenile offenders and the application of short-term free sentences to juvenile offenders, which will have a certain degree of influence on juvenile delinquents' reoffending. One of the basic value goals of juvenile imprisonment is to prevent and reduce reoffending. However, the disadvantages of imprisonment itself, such as cross-infection, label effect, psychological disorder, etc., often make the effect of imprisonment run counter to expectations. Social help and family help are important driving forces for them to start their lives again, and juvenile delinquents' susceptibility, unindications and abnormal needs also have a direct impact on their re-socialization. In order to prevent and reduce the reoffending of juvenile offenders, we should first start with legislation, revise the criminal law, perfect the criminal responsibility system of minors, perfect and perfect the legislation of work-study education, the legislation of social help and education, and the legislation of correction of imprisonment, and deal with juvenile cases. Through a comprehensive social investigation to find out the causes of the crime, to make the trial education and the final sentence more targeted, and to apply as many non-custodial sentences as possible, such as suspended sentences, in the course of the imprisonment of juvenile offenders, Social resources and family strength should be integrated, mental health education should be emphasized, and the place of imprisonment of juvenile offenders should be built into special schools. After the release of juvenile offenders, the family and society should attach importance to them, fully respect them, and give them reasonable guidance. To create a variety of ways to help and educate, pay attention to solve the actual problems of criminal release juvenile offenders, create a relaxed environment and favorable conditions for the re-socialization of criminal release juvenile offenders.
