【摘要】：未成年人是國(guó)家的未來(lái)，他們的健康成長(zhǎng)直接關(guān)系著民族的興旺和國(guó)家的富強(qiáng)。近年來(lái)，我國(guó)的未成年人犯罪案件呈日益上升趨勢(shì)，其中未成年人性犯罪已成為未成年人罪案中僅次于盜竊、搶劫案件的又一類嚴(yán)重侵犯公民人身權(quán)利、損害社會(huì)文明風(fēng)尚、毒害未成年人身心健康的暴力犯罪。未成年人性犯罪具有區(qū)別于成年人犯罪的不同特征。它的形成既有復(fù)雜的社會(huì)原因，也有個(gè)體的因素。如何有效地預(yù)防和控制未成年人性犯罪，已成為全社會(huì)關(guān)注的熱點(diǎn)問(wèn)題。認(rèn)真研究未成年人性犯罪的特征和原因，對(duì)預(yù)防此類犯罪具有非常重要的價(jià)值。 筆者綜合運(yùn)用社會(huì)學(xué)、犯罪學(xué)、教育學(xué)、心理學(xué)等相關(guān)知識(shí)，主要采用文獻(xiàn)研究法進(jìn)行研究，通過(guò)對(duì)大量的文獻(xiàn)資料進(jìn)行整理、歸納選取典型的個(gè)案作為依據(jù)，并輔之以問(wèn)卷調(diào)查法、訪談法、比較研究法等研究方法，，了解掌握當(dāng)前我國(guó)未成年人性犯罪的現(xiàn)狀并提出一定的預(yù)防及教育手段。全文主要分為以下幾個(gè)部分： 1、當(dāng)前我國(guó)未成年人性犯罪的特征：性犯罪的低齡化；文化程度的偏低化；手段的殘忍化；犯罪形式的復(fù)合化；團(tuán)伙化；違法犯罪恥辱感的日趨淡化。 2、對(duì)未成年人性犯罪原因的綜合分析。 未成年人性犯罪的犯罪原因是一個(gè)多層次多維度的原因結(jié)構(gòu)系統(tǒng)。在這個(gè)系統(tǒng)中，即有屬于未成年性犯罪人本身的因素，也有社會(huì)環(huán)境中種種不利因素的影響。 未成年人性犯罪的心理特征：主要表現(xiàn)為認(rèn)識(shí)能力低；思維方式簡(jiǎn)單；控制力差；動(dòng)機(jī)模糊；行為的盲從；情緒情感的消極等方面。 影響未成年人未成年人性犯罪的家庭因素主要包括：家庭教育觀念的偏差；家庭管教方式的不當(dāng)；不健康不文明的家庭生活方式及殘缺家庭的影響。 影響未成年人性犯罪的學(xué)校因素主要體現(xiàn)在七個(gè)方面：學(xué)校教育實(shí)踐的偏差，性道德教育的滯后；法制教育的不足；心理教育的缺乏；學(xué)風(fēng)校風(fēng)建設(shè)的滑坡；教育方式方法的陳舊、失當(dāng)；部分教師素質(zhì)的偏低；教育結(jié)構(gòu)的不合理。 影響未成年人性犯罪的社會(huì)因素主要表現(xiàn)在：市場(chǎng)經(jīng)濟(jì)的負(fù)面影響；黃色文化的影響和刺激；不良交往的直接影響。 3、對(duì)未成年人性犯罪預(yù)防的對(duì)策思考。文中筆者提出了六個(gè)方面的措施：營(yíng)造未成年人健康成長(zhǎng)的良好社會(huì)環(huán)境；摒棄各種黃色文化，凈化社會(huì)環(huán)境；強(qiáng)化家庭功能，提高家庭教育質(zhì)量；全面貫徹素質(zhì)教育，改革學(xué)校現(xiàn)有教育模式；完
[Abstract]:Minors are the future of the country, their healthy growth is directly related to the prosperity of the nation and the prosperity of the country. In recent years, juvenile delinquency cases in our country are on the rise day by day. Among them, sexual crimes of minors have become second only to theft, robbery cases are another kind of serious violation of citizens' personal rights, harm to social civilization. A violent crime that poisons the physical and mental health of minors. Juvenile sex crime has different characteristics from adult crime. Its formation has complex social reasons as well as individual factors. How to effectively prevent and control sexual crimes of minors has become a hot issue in the whole society. It is of great value to study the characteristics and causes of juvenile sex crime. The author synthetically uses sociology, criminology, pedagogy, psychology and other related knowledge, mainly uses the literature research method to carry on the research, through carries on the arrangement to the massive literature material, induces and selects the typical case as the basis, With the methods of questionnaire, interview, comparative research and so on, we can understand and grasp the current situation of juvenile sex crime in China and put forward some preventive and educational methods. The full text is divided into the following parts: 1. At present, the characteristics of juvenile sexual crime in China are: the younger age of sexual crime; the lower education level; the cruelty of means; the compounding of crime forms; the gang; the desolation of shame of illegal crime. 2. A comprehensive analysis of the causes of sexual crimes committed by minors. The cause of juvenile sexual crime is a multi-level and multi-dimensional cause structure system. In this system, there are not only the factors belonging to the minor offenders themselves, but also the influence of all kinds of unfavorable factors in the social environment. The psychological characteristics of juvenile sex crime include low cognitive ability, simple mode of thinking, poor control, vague motivation, blind behavior, negative emotion and so on. The family factors which affect the juvenile sex crime mainly include: the deviation of the family education concept, the improper way of family discipline, the unhealthy and uncivilized family life style and the influence of the incomplete family. The school factors affecting juvenile sexual delinquency are mainly reflected in seven aspects: deviation of school education practice, lag of sex moral education, lack of legal education, lack of psychological education, decline of school spirit construction; The methods of education are old and improper, some teachers' quality is on the low side, and the educational structure is unreasonable. The social factors that affect juvenile sex crime mainly include the negative influence of market economy, the influence and stimulation of yellow culture, and the direct influence of bad communication. 3. Thinking about the prevention of juvenile sexual crime. The author puts forward six measures: to build a good social environment for the healthy growth of minors, to abandon all kinds of yellow culture, to purify the social environment, to strengthen the family function, to improve the quality of family education, to carry out quality education in an all-round way.
