【摘要】：社會(huì)矛盾和沖突存在于任何社會(huì)。現(xiàn)代化和社會(huì)轉(zhuǎn)型時(shí)期更是如此。改革開(kāi)放以來(lái),我國(guó)進(jìn)入后發(fā)展國(guó)家現(xiàn)代化和社會(huì)轉(zhuǎn)型時(shí)期,社會(huì)矛盾、社會(huì)沖突凸顯。在眾多的社會(huì)沖突當(dāng)中,農(nóng)村環(huán)境群體性事件值得關(guān)注。所謂農(nóng)村環(huán)境群體性事件是指由農(nóng)村內(nèi)部矛盾、糾紛引發(fā)的眾多農(nóng)民參與的危害公共安全和擾亂社會(huì)秩序的事件。從浙江省東陽(yáng)市畫(huà)水鎮(zhèn)“4.10事件”、浙江省長(zhǎng)興縣煤山鎮(zhèn)“8.20事件”和廣西壯族自治區(qū)岑溪市波塘鎮(zhèn)“1.10事件”等典型案例說(shuō)起,提出法社會(huì)學(xué)視野下我國(guó)農(nóng)村環(huán)境群體性事件的發(fā)生機(jī)理及防治措施是什么?法社會(huì)學(xué)視野下我國(guó)農(nóng)村環(huán)境群體性事件的發(fā)生機(jī)理是：社會(huì)轉(zhuǎn)型引發(fā)的利益沖突是農(nóng)村環(huán)境群體性事件發(fā)生的根源；農(nóng)民的環(huán)境利益受損是農(nóng)村環(huán)境群體性事件發(fā)生的前奏；農(nóng)民權(quán)利意識(shí)與法律意識(shí)的張力是農(nóng)村環(huán)境群體性事件的文化成因；農(nóng)民權(quán)利義務(wù)的基本法律制度不完善容易引發(fā)農(nóng)村環(huán)境群體性事件；訴訟救濟(jì)機(jī)制不健全容易引發(fā)農(nóng)村環(huán)境群體性事件。法社會(huì)學(xué)視野下我國(guó)農(nóng)村環(huán)境群體性事件的防治措施是：化解政府與農(nóng)民的利益沖突；培育農(nóng)民的法律意識(shí)；完善農(nóng)村環(huán)境群體性事件處置的基本法律制度；健全農(nóng)村環(huán)境糾紛的訴訟救濟(jì)機(jī)制。我國(guó)社會(huì)主義和諧社會(huì)絕不是一個(gè)沒(méi)有矛盾與沖突的社會(huì),而是一個(gè)有能力解決社會(huì)矛盾、化解社會(huì)沖突與實(shí)現(xiàn)社會(huì)動(dòng)態(tài)均衡發(fā)展的社會(huì)。我們一定要結(jié)合我國(guó)經(jīng)濟(jì)社會(huì)發(fā)展的實(shí)際情況,不斷深入地研究我國(guó)農(nóng)村環(huán)境群體性事件的有關(guān)問(wèn)題,為防治我國(guó)農(nóng)村環(huán)境群體性事件的實(shí)踐提供某些理論支撐和解決方案,促進(jìn)我國(guó)社會(huì)和諧發(fā)展。
[Abstract]:Social contradictions and conflicts exist in any society. This is especially true in times of modernization and social transformation. Since the reform and opening up, China has entered the period of modernization and social transformation. Among the numerous social conflicts, rural environmental group events are worthy of attention. The so-called rural environmental group events refer to the events that endanger public safety and disturb the social order caused by the contradictions and disputes within the countryside. Starting from the typical cases of "the 4.10 incident" in Xiushui Town, Dongyang City, Zhejiang Province, "8.20 incident" in Coal Mountain Town, Changxing County, Zhejiang Province, and "1.10 incident" in Botang Town, Cenxi City, Guangxi Zhuang Autonomous region, etc. What are the mechanism and prevention measures of environmental group events in rural areas in China from the perspective of sociology of law? The mechanism of rural environmental group events in China from the perspective of sociology of law is as follows: the conflict of interest caused by social transformation is the root of the occurrence of rural environmental group events, and the damage of farmers' environmental interests is the prelude to the occurrence of rural environmental group events. The tension between farmers' right consciousness and legal consciousness is the cultural cause of rural environmental group events, and the imperfection of the basic legal system of peasants' rights and obligations can easily lead to rural environmental group events. The remedy mechanism of litigation is not perfect, which can easily lead to group events in rural environment. The prevention and cure measures of rural environmental group events in our country from the perspective of sociology of law are as follows: to resolve the conflict of interests between the government and the peasants, to cultivate the peasants' legal consciousness, to perfect the basic legal system of dealing with the rural environmental group incidents; We will improve the mechanism of litigation and relief for environmental disputes in rural areas. Our socialist harmonious society is not a society without contradictions and conflicts, but a society with the ability to solve social contradictions, resolve social conflicts and realize social dynamic balanced development. We must combine the actual situation of our country's economic and social development, study the related problems of our country's rural environmental group events in depth, and provide some theoretical support and solutions for the practice of preventing and controlling the rural environmental group events in our country. Promote the harmonious development of our society.
