【摘要】：公安機(jī)關(guān)執(zhí)法公信力是指公安機(jī)關(guān)通過(guò)公正行使法定職權(quán),在行政執(zhí)法過(guò)程中建立起來(lái)的一種社會(huì)公共信用,是社會(huì)公眾對(duì)公安機(jī)關(guān)及其人民警察運(yùn)用公權(quán)力進(jìn)行執(zhí)法活動(dòng)的過(guò)程和結(jié)果所具有的信任程度和心理認(rèn)同感。 公安機(jī)關(guān)作為我國(guó)公共安全維護(hù)與服務(wù)的政府機(jī)構(gòu),肩負(fù)著行政執(zhí)法的重要職責(zé),擔(dān)負(fù)著鞏固黨的執(zhí)政地位、保障人民安居樂(lè)業(yè)、維護(hù)國(guó)家長(zhǎng)治久安、服務(wù)經(jīng)濟(jì)社會(huì)發(fā)展的重大政治和社會(huì)責(zé)任,并且承擔(dān)著新形勢(shì)下維護(hù)社會(huì)穩(wěn)定的歷史重任。公安機(jī)關(guān)的執(zhí)法公信力代表了公安機(jī)關(guān)執(zhí)政履職的群眾基礎(chǔ),不僅影響著公安機(jī)關(guān)的正常工作,而且反映出黨和政府在公眾面前的形象地位,影響著黨和政府的執(zhí)政基礎(chǔ),影響著公眾對(duì)法律尊嚴(yán)的信仰和法律權(quán)威的信心。由于公安機(jī)關(guān)在日常工作中往往直面矛盾主體,不斷地采用禁止、處罰、取締等剛性手段,因此不可避免地被推置于處理社會(huì)公眾矛盾和社會(huì)關(guān)系的風(fēng)口浪尖,始終受到了社會(huì)公眾的高度關(guān)注。山東省人民政府2011年科學(xué)發(fā)展綜合考核電話抽樣調(diào)查結(jié)果顯示,人民群眾對(duì)全省公安工作的滿意度平均得分為86.61分,在不滿意的原因中,認(rèn)為民警的辦事效率不高的占39.27%,認(rèn)為公正執(zhí)法不好的占22.82%,認(rèn)為經(jīng)常發(fā)生刑事和治安案件的占20.48%,認(rèn)為公安民警形象不好的占17.43%。上述調(diào)查結(jié)果表明,當(dāng)前廣大人民群眾對(duì)公安機(jī)關(guān)的執(zhí)法公信力總體上是滿意的,但仍存在一定程度的缺失。在公安工作得到廣大人民群眾基本肯定的同時(shí),我們必須清醒的認(rèn)識(shí)到,隨著政府職能的轉(zhuǎn)變和社會(huì)轉(zhuǎn)型的深入,公眾與公安機(jī)關(guān)的抵觸對(duì)立情緒也在不斷加劇,公安機(jī)關(guān)的執(zhí)法公信力面臨嚴(yán)峻的考驗(yàn)。公安機(jī)關(guān)執(zhí)法公信力不高和缺失的現(xiàn)象既有體制機(jī)制的外部因素,也有其自身素質(zhì)和管理水平的內(nèi)部原因。公安民警的特權(quán)思想、警員綜合素質(zhì)不高、執(zhí)法行為不公正,公安機(jī)關(guān)過(guò)度的承諾與服務(wù)、不明晰的公共權(quán)力,公安協(xié)警的無(wú)序管理,群眾對(duì)警察職責(zé)的理解誤差等現(xiàn)實(shí)因素以及“針刺死”、“深圳協(xié)警強(qiáng)奸案”等事件造成的輿論環(huán)境影響對(duì)人們心理底線的不斷沖擊,加深了公眾對(duì)公安機(jī)關(guān)執(zhí)法的不信任感,從而產(chǎn)生了公安機(jī)關(guān)執(zhí)法公信力的信任危機(jī)。 加強(qiáng)執(zhí)法公信力建設(shè)應(yīng)當(dāng)成為當(dāng)前各級(jí)公安機(jī)關(guān)建設(shè)的重要任務(wù)。本文通過(guò)對(duì)公安機(jī)關(guān)執(zhí)法公信力概念、特征、現(xiàn)狀和危機(jī)的表現(xiàn)形式等方面進(jìn)行分析和研究,從理念、行為和制度三個(gè)最能影響執(zhí)法公信力的要素入手,尋找加強(qiáng)公安機(jī)關(guān)執(zhí)法公信力建設(shè)的方法和途徑。以構(gòu)建服務(wù)型公安機(jī)關(guān)為載體,運(yùn)用危機(jī)管理的理論改變當(dāng)前存在的執(zhí)法公信力危機(jī)現(xiàn)狀,不斷加強(qiáng)公安機(jī)關(guān)的執(zhí)法公信力建設(shè)。其主要的措施和手段為：借助加強(qiáng)公安民警執(zhí)法能力建設(shè)提高服務(wù)群眾的能力；通過(guò)明晰執(zhí)法與服務(wù)做到有限警力的高效使用；依托警務(wù)流程再造遏制辦案腐敗現(xiàn)象的發(fā)生；依靠完善的執(zhí)法監(jiān)督體系把公共權(quán)力運(yùn)行全過(guò)程置于群眾的監(jiān)督之下；通過(guò)加強(qiáng)對(duì)協(xié)警隊(duì)伍的嚴(yán)格管理避免非法福利的派生；憑借完善的危機(jī)處理機(jī)制降低突發(fā)事件對(duì)執(zhí)法公信力的負(fù)面影響。
[Abstract]:The public security organ's law enforcement credibility is a kind of social public credit established by the public security organs in the process of administrative law enforcement by the public security organs. It is the degree of trust and psychological identity of the public in the process and results of the public security organs and their people's police using public power to enforce the law.
As the government agency of public security maintenance and service in China, the public security organs shoulder the important duties of administrative law enforcement, bear the important political and social responsibility to consolidate the ruling position of the party, safeguard the people to live and work, maintain the long-term stability of the state, serve the economic and social development, and bear the history of maintaining social stability under the new situation. The credibility of the public security organs represents the mass basis for the public security organs to work in power, which not only affects the normal work of the public security organs, but also reflects the image status of the public security organs and the government in public, affects the ruling foundation of the party and the government, and affects the public's faith in the dignity of the law and the confidence of the legal authority. In the daily work, the security organs often face the contradiction subject, and constantly adopt the rigid means of prohibition, punishment and banning. Therefore, it is inevitably pushed into the wind and wave of dealing with social public contradictions and social relations, and has always been highly concerned by the public. The Shandong Provincial People's Government in 2011 has a comprehensive assessment of the scientific development of the telephone sampling. The results show that the average score of the people's satisfaction with the public security work in the province is 86.61 points. In the unsatisfactory reasons, it is considered that the efficiency of the police is not high, and that the fairness of the law enforcement is 22.82%, and that 20.48% of the criminal and public security cases often occur, and that the image of the public security police is not good in 17.43%.. The survey shows that the public security organs are generally satisfied with the public credibility of the public security organs at present, but there are still some deficiencies. While the public security work has been basically affirmed by the masses, we must be aware that with the transformation of government functions and the deepening of social transformation, the public and public security organs should be realized. The antagonism of the public security organs is facing a severe test. The public security organs' law enforcement credibility is faced with a severe test. The phenomenon of public security organs' law enforcement public credibility is not only the external factors of the institutional mechanism, but also its own quality and the internal reasons for its management. Justice, the excessive commitment and service of the public security organs, the undefined public power, the unordered management of the public security police, the masses' understanding of the police's responsibility and other realistic factors, and the impact of the public opinion on the bottom line of the people's heart, the impact of the public opinion environment caused by the incidents of "the death of the police and the rape of Shenzhen police" and so on. The sense of distrust in law enforcement has created the trust crisis of public security organs' credibility in law enforcement.
Strengthening the construction of the public credibility of the law enforcement should be an important task at the current level of public security organs at all levels. Through the analysis and Research on the concept, characteristics, present situation and the manifestation of the public security organs' law enforcement public trust, this paper starts with three factors that can affect the public credibility of the law, and seeks to strengthen the public security machine. In order to establish the method and way for the construction of the public credibility of the law enforcement, in order to build the service type public security organ as the carrier, use the theory of crisis management to change the current situation of the current law enforcement credibility crisis, and constantly strengthen the construction of public security organs' law enforcement credibility. The main measures and means are to improve the service group by the construction of the strengthening of the police law enforcement ability of the police. The capacity of the public, through the clear law enforcement and service to achieve the efficient use of limited police force; relying on police process reengineering to curb the occurrence of corruption in the case of handling cases; relying on a perfect law enforcement supervision system to put the whole process of public power under the supervision of the masses; by strengthening the strict management of the Concord team to avoid illegal welfare By virtue of a sound crisis management mechanism, it will reduce the negative impact of emergencies on the credibility of law enforcement.
