【摘要】： 本文首先對信用卡犯罪的概念范疇進行了探討,重點圍繞不具有透支功能的銀行卡是否屬于刑法意義信用卡的問題,對刑法意義上的信用卡進行了界定。在明確信用卡犯罪概念的前提下,本文結(jié)合數(shù)據(jù)統(tǒng)計和案例,分析了當(dāng)前我國信用卡犯罪的特點、發(fā)展趨勢和主要犯罪手法,并由此深入分析了造成當(dāng)前信用卡犯罪多發(fā)的信用卡本身流通環(huán)節(jié)多及技術(shù)防范措施薄弱、信用體系不健全和持卡人用卡習(xí)慣不良、銀行對信用卡各環(huán)節(jié)的內(nèi)部管理不嚴(yán)、特約商戶業(yè)務(wù)管理上存有漏洞等原因。 如何有效防治信用卡犯罪,文章分刑法制度的完善和一般防范策略兩個層面進行了探討。在肯定《刑法修正案(五)》對有效打擊信用卡犯罪的積極意義的同時,提出了根據(jù)司法實務(wù)操作需要,刑法需要進一步完善和明確的相關(guān)建議。此外,本文還從完善信用卡的金融立法和相關(guān)規(guī)章制度,加強與信用卡業(yè)務(wù)相關(guān)的技防、物防、人防建設(shè),建立公民個人信用制度體系、加強信息溝通和共享,完善發(fā)卡行和特約商戶的內(nèi)部管理,加強宣傳,提高持卡人的防范意識等五個方面提出了防范信用卡犯罪的一般策略。
[Abstract]:This paper first discusses the concept of credit card crime, focusing on whether the bank card with no overdraft function belongs to the criminal law credit card, and defines the credit card in the criminal law sense. On the premise of defining the concept of credit card crime, this paper analyzes the characteristics, development trend and main criminal methods of credit card crime in China, combining with data statistics and cases. And from this in-depth analysis of the credit card itself caused by the current frequent crime of credit card itself circulation links and technical prevention measures are weak, the credit system is not perfect and cardholders bad habits, banks do not have strict internal management of each link of the credit card. Special business management on the existence of loopholes and other reasons. How to prevent and cure the crime of credit card effectively is discussed in two aspects: the perfection of criminal law system and the general preventive strategy. While affirming the positive significance of "Criminal Law Amendment (5)" for effectively cracking down on credit card crimes, this paper puts forward some relevant suggestions which need to be further improved and clearly defined according to the needs of judicial practice. In addition, this article also from consummates the credit card financial legislation and the related rules and regulations, strengthens the technical defense, the material defense, the civil air defense construction related to the credit card business, establishes the citizen personal credit system, strengthens the information communication and the sharing, This paper puts forward the general strategy of preventing credit card crime from five aspects: perfecting the internal management of the issuing bank and the special merchant, strengthening the propaganda and raising the cardholder's guard consciousness.
