職務(wù)犯罪文化初探

【摘要】:當(dāng)前我國職務(wù)犯罪呈現(xiàn)出群體性、擴散性、關(guān)聯(lián)性等新的特征。以研究犯罪原因和犯罪控制為己任的犯罪學(xué)應(yīng)當(dāng)對這些新的特征做出解釋,并提出有效的控制措施。 本文在對西方白領(lǐng)犯罪亞文化理論和我國職務(wù)犯罪亞文化理論進行回顧的基礎(chǔ)上,總結(jié)了這些理論的基本觀點和方法,形成了職務(wù)犯罪亞文化理論的基本模型,并且,從該模型出發(fā),設(shè)定了一系列理論假設(shè)。針對這些假設(shè),本文運用文獻分析方法,以職務(wù)犯罪實際案例為實證材料對這些假設(shè)進行了論證,并得出結(jié)論:權(quán)力和金錢是一些國家工作人員追求的目標(biāo),獲取實現(xiàn)權(quán)力和金錢目標(biāo)的合法手段是有限的,當(dāng)追求權(quán)力和金錢的國家工作人員缺乏實現(xiàn)目標(biāo)的制度性手段時,就會有挫折感,如果有機會獲得能實現(xiàn)目標(biāo)的非制度性手段,他就可能通過該手段(即實施職務(wù)犯罪行為)來實現(xiàn)目標(biāo)。如果不僅缺乏制度性手段而且缺乏非制度性手段,或者僅缺乏制度性手段卻具有非制度性手段,但有刑罰威懾力等的阻礙,他就會調(diào)整自己的目標(biāo)并重新開始新目標(biāo)的實現(xiàn)行為。當(dāng)眾多國家工作人員實施了職務(wù)犯罪行為時,就形成了一種職務(wù)犯罪亞文化群和職務(wù)犯罪亞文化。由于職務(wù)犯罪亞文化特有的功能和規(guī)范能給群體成員以鼓勵和支持,這就更增強了該亞文化群對其他國家工作人員的吸引力。同樣由于犯罪亞文化群的特有規(guī)范,使不遵循該規(guī)范的成員得到群體的排斥和懲罰。群體對其成員的這種推拉作用促使其成員遵循其特有規(guī)范,遵循的結(jié)果就是職務(wù)犯罪。上述理論假定不僅可以從實證資料獲得證實,而且較好地解釋了當(dāng)前職務(wù)犯罪呈現(xiàn)的前述新的特征。因此,作者根據(jù)所作的分析,提出預(yù)防和控制職務(wù)犯罪的相應(yīng)對策建議。
[Abstract]:At present, the crime of duty in China presents new characteristics such as group, diffusible and related, and the criminology that studies the cause of crime and the control of crime should explain these new features and put forward effective control measures.
On the basis of the review of the western white collar crime subculture theory and the subculture theory of duty crime in China, this paper sums up the basic views and methods of these theories, and forms the basic model of the subculture theory of the duty crime, and sets out a series of theoretical assumptions from the model. The analysis method, taking the actual case of the duty crime as the empirical material, demonstrates these hypotheses, and draws the conclusion that power and money are the goals pursued by some national staff, and the legal means to achieve power and money goals are limited, and the national staff who pursue power and money lack the institutional hands to achieve the goal. In a period of time, there will be a sense of setback. If he has the opportunity to achieve a non institutional means to achieve the goal, he may achieve the goal through the means (i.e. the enforcement of the duty crime). If not only lack of institutional means but lack of non institutional means, or lack institutional means, but have non institutional means, but there is a deterrent force of punishment. He will adjust his goal and start a new goal. When many state workers carry out the crime of duty, they form a subculture of duty crime and the subculture of duty crime. Because of the special functions and norms of the job crime subculture, it can be encouraged and supported by the members of the group. It also strengthens the attractiveness of the subculture to the staff of other countries. Also, because of the specific norms of the subculture group, the members who do not follow the norm get the exclusion and punishment of the group. The push and pull of the group to its members leads the members to follow their specific norms and follow the theory of job crime. The hypothesis can not only be confirmed from the empirical data, but also better explain the new characteristics of the present job crime. Therefore, the author, based on the analysis, puts forward the corresponding countermeasures and suggestions for the prevention and control of the duty crime.
