【摘要】： 包括我國在內(nèi)的女性犯罪正成為當今世界各國不容忽視的社會問題。而日益嚴重的女大學生違法犯罪問題更是引起了全社會的高度關(guān)注。研究和探討女大學生違法犯罪的特征、成因及應(yīng)對措施，不僅可以填補長期以來女大學生犯罪未列入女性犯罪學的理論空白，而且在實際生活中還能為女大學生遠離邪惡、全面提高其整體素質(zhì)，發(fā)揮她們的社會主觀能動性敲響警鐘。 女大學生的違法行為，是指違反現(xiàn)行法律規(guī)定的行為。犯罪行為則指危害社會、觸犯刑律、應(yīng)受刑罰處罰的行為。女大學生的違法犯罪行為具有數(shù)量增長的迅速性、表現(xiàn)類型的多樣性、主要手段的色情性、催化因素的貧困性、施展過程的漸進性、作案方式的隱蔽性、教育改造的頑劣性等方面的特征，其危害程度和范圍也比較嚴重，這一方面體現(xiàn)為女大學生的學業(yè)、身心健康受到嚴重損害；另一方面也致使她們的親友痛苦不堪，高校人才目標無法實現(xiàn)，國民素質(zhì)不能得到整體的提高。 女大學生違法犯罪是各種主、客觀原因相互作用與結(jié)合的結(jié)果。其中的主觀原因主要是指女大學生不能對自身的生理、心理和思想素質(zhì)加以正確的認知和把握，如不能正確對待源自生理的性需求、心理失衡后偏執(zhí)性人格障礙的出現(xiàn)、缺乏正確的世界觀與人生道德觀、法律觀念淡漠等等。而導致女大學生違法犯罪的客觀原因則主要指社會就業(yè)機制不完善、腐朽而落后文化的沖擊、女性教育系統(tǒng)乏力等因素對女大學生所帶來的負面影響。大學生就業(yè)的社會保護性政策的踐踏、文化逆流的腐蝕、家庭及學校教育的偏失便是客觀原因的具體體現(xiàn)。 預防和治理女大學生違法犯罪有賴于各種社會力量的參與和配合。從女大學生違法犯罪的防范來看，國家在支持就業(yè)、扶貧救濟、凈化風氣上的制度保障，學校在幫助認知、加強性教育、提供心理咨詢、管理學生事務(wù)、教 ⑧糕譽忿 師言傳身教、增加激勵措施、引導學生休閑等方面的教育牽引，以及增進家 庭教育功能、建立良好家庭關(guān)系，改進培育方式與質(zhì)量的親情滋養(yǎng)應(yīng)分別成 為防范女大學生違法犯罪的重點、關(guān)鍵與基石。而就女大學生違法犯罪的治 理而言，針對女大學生特有的心理特征，采用科學化的法律制裁手段與方法、 建立人性化的女大學生刑事污點消滅制度就不失為既能對女大學生嚴重違法 犯罪行為予以嚴厲打擊，，又能對其中一部分人予以回爐重鑄般的幫教改造的 有效矯治方式與手段。
[Abstract]:Female crime, including our country, is becoming a social problem that can not be ignored in the world. The increasingly serious problem of female college students in violation of the law and crime has attracted the attention of the whole society. The study and discussion on the characteristics, causes and countermeasures of female college students' crime can not only fill the theoretical gap of female college students' crime not included in female criminology for a long time, but also be able to keep female college students away from evil in real life. Improve their overall quality in an all-round way, give play to their social initiative sounded the alarm bell. The illegal behavior of female college students refers to the behavior that violates the current law. The criminal act refers to the act that endangers the society, violates the criminal law, and should be punished. The crimes committed by female college students have the characteristics of rapid increase in quantity, diversity of expression types, pornography of main means, poverty of catalytic factors, gradual development of the process of development, concealment of the ways of committing crimes, etc. The degree and scope of harm caused by the obstinate nature of educational reform are also quite serious. On the one hand, this is reflected in the serious damage to the physical and mental health of female university students; on the other hand, it also causes severe suffering for their relatives and friends. The university talented person goal cannot realize, the national quality cannot obtain the overall enhancement. Female college students' crime is the result of interaction and combination of subjective and objective reasons. The subjective reason is that female college students can not correctly understand and grasp their own physiological, psychological and ideological qualities, such as not dealing with the sexual needs derived from physiology correctly, and the emergence of paranoid personality disorder after psychological imbalance. Lack of correct world outlook and life ethics, the legal concept of indifference and so on. The objective causes of female college students' crime mainly refer to the negative influence on female college students caused by the imperfect social employment mechanism, the impact of decadent and backward culture, and the weakness of female education system. The trampling of the social protective policy of college students' employment, the corrosion of cultural countercurrent, the partial loss of family and school education are the concrete embodiment of the objective reasons. The prevention and treatment of female college students'crime depends on the participation and cooperation of various social forces.
