【摘要】: 作為中國(guó)特有的一種法律制度,我國(guó)的勞動(dòng)教養(yǎng)自創(chuàng)建至今已經(jīng)存在了50多年,在維護(hù)社會(huì)秩序、預(yù)防減少違法犯罪、保障社會(huì)主義現(xiàn)代化建設(shè)方面發(fā)揮了重要作用。然而,隨著中國(guó)法治化進(jìn)程的推進(jìn),由于勞動(dòng)教養(yǎng)制度存在的法制化和人權(quán)保障危機(jī),這一制度倍受質(zhì)疑,也遭到了西方敵對(duì)勢(shì)力的攻擊。理論界和實(shí)務(wù)界對(duì)勞動(dòng)教養(yǎng)制度提出了許多改革方案,各有優(yōu)勢(shì)也各有缺陷,但不管怎樣,對(duì)我們下一步推進(jìn)勞動(dòng)教養(yǎng)制度改革都大有裨益。在筆者看來(lái),作為中國(guó)特有的一項(xiàng)法律制度,雖然其存在缺陷和不足,但仍具有自身存在的價(jià)值和意義,我們應(yīng)該在推進(jìn)法治、保障人權(quán)的基礎(chǔ)上對(duì)其進(jìn)行改革,保留并充分發(fā)揮這項(xiàng)制度的合理內(nèi)核,努力建設(shè)具有中國(guó)特色的教育矯治制度。 本文共分五個(gè)部分,導(dǎo)言部分引出問(wèn)題,介紹了本論文問(wèn)題的提出與選題宗旨、研究背景等。第一章介紹了中國(guó)勞動(dòng)教養(yǎng)制度歷史沿革與現(xiàn)狀。第二章著重分析了中國(guó)勞動(dòng)教養(yǎng)制度的法制化和人權(quán)保障方面的危機(jī)。第三章分析比較了中國(guó)勞動(dòng)教養(yǎng)制度不同改革路徑的利弊得失。第四章著重從基本原則、理念支撐和具體改革措施等提出了改革中國(guó)勞動(dòng)教養(yǎng)制度的對(duì)策建議。 希望通過(guò)本文的研究,能夠提出一些較具可行性與操作性的對(duì)策建議,供立法部門(mén)和相關(guān)政府部門(mén)作為決策咨詢(xún)和參考,使經(jīng)過(guò)改革后的勞動(dòng)教養(yǎng)制度能更好地服務(wù)于我國(guó)的社會(huì)主義現(xiàn)代化建設(shè)。
[Abstract]:As a unique legal system in China, reeducation through labor in China has existed for more than 50 years since its establishment, which has played an important role in maintaining social order, preventing illegal crimes and ensuring socialist modernization. However, with the advancement of the process of rule of law in China, due to the legalization of the system of re-education through labour and the crisis of human rights protection, this system has been questioned and attacked by hostile forces in the West. The theoretical and practical circles have put forward many reform plans for the system of re-education through labor, each of which has its own advantages and disadvantages, but in any case, it will be of great benefit to us to push forward the reform of the system of re-education through labor next. In my opinion, as a unique legal system in China, although it has defects and shortcomings, it still has its own value and significance. We should reform it on the basis of promoting the rule of law and safeguarding human rights. We should keep and give full play to the reasonable core of this system and strive to build an educational correction system with Chinese characteristics. This paper is divided into five parts, the introduction part leads to the problem, introduces the proposition of the paper, the purpose of the topic, the research background and so on. The first chapter introduces the history and present situation of Chinese reeducation through labor system. The second chapter focuses on the legalization and human rights protection crisis of China's reeducation through labor system. The third chapter analyzes and compares the advantages and disadvantages of different reform paths of China's reeducation through labor system. The fourth chapter puts forward countermeasures and suggestions to reform China's reeducation through labor system from basic principles, conceptual support and concrete reform measures. I hope that through the study of this paper, I can put forward some feasible and operational countermeasures and suggestions for legislative departments and relevant government departments as decision-making consultation and reference. After the reform, the reeducation through labor system can better serve the socialist modernization of our country.
