【摘要】：公安監(jiān)管場所是依法設(shè)立的國家刑事、行政執(zhí)法機關(guān)。公安監(jiān)管場所安全管理是公安監(jiān)管工作的核心,研究公安監(jiān)管場所安全管理,對于確保公安監(jiān)管場所的安全穩(wěn)定、預(yù)防和減少違法犯罪、改進公安監(jiān)管工作、促進和諧社會的構(gòu)建等等都具有重要的意義。 論文以公安監(jiān)管場所安全管理為研究對象,以公安看守所的安全管理為切入口,闡述了公安監(jiān)管場所安全管理的真實狀況,分析了我國公安監(jiān)管場所安全管理存在的問題及產(chǎn)生的原因,在此基礎(chǔ)上,提出了加強公安監(jiān)管場所安全管理的總體思路和具體措施。論文共分為四章。 第一章從公安監(jiān)管場所安全管理的概述、闡述公安監(jiān)管場所安全管理的研究意義,比較國內(nèi)外研究現(xiàn)狀和觀點,提出本文的研究思路和研究方法。 第二章介紹了全國公安監(jiān)管場所安全管理的整體狀況,分析了影響公安監(jiān)管場所安全管理的主觀和客觀原因,指出指導(dǎo)思想片面、部分監(jiān)管民警的安全管理意識淡薄、監(jiān)管民警工作倦怠問題凸顯、民警執(zhí)法理念滯后等主觀原因,以及現(xiàn)實工作中存在的監(jiān)管場所的保障機制尚不健全,犯罪形勢發(fā)生變化,在押對象的復(fù)雜程度加劇等客觀原因,影響到公安監(jiān)管場所的安全穩(wěn)定。 第三章介紹了美國、英國、德國、西班牙等國家的監(jiān)獄管理經(jīng)驗,指出完善分押分管模式,改進監(jiān)管場所的建設(shè),實施監(jiān)管民警的分層分類管理,對加強公安監(jiān)管場所安全管理具有十分重要的意義。 第四章針對現(xiàn)存的主要問題,在借鑒國外經(jīng)驗的基礎(chǔ)上,提出加強我國公安監(jiān)管場所安全管理的總體思路及具體措施:一是,加強公安監(jiān)管工作的保障,從立法、經(jīng)費保障中予以體現(xiàn)。二是,提高公安監(jiān)管場所基礎(chǔ)設(shè)施建設(shè)的質(zhì)量,制定監(jiān)管場所基礎(chǔ)設(shè)施建設(shè)的標(biāo)準(zhǔn),建立監(jiān)管場所建設(shè)的評估機制,注重設(shè)施建設(shè)過程的專業(yè)化管理。三是,建立規(guī)范化的監(jiān)管場所運行機制,完善監(jiān)管場所安全管理制度,促進隱患排查整改,注重責(zé)任追溯的有效性和針對性。四是,加強監(jiān)管場所的危機管理能力,完善危機處理流程,提高危機應(yīng)對反應(yīng)速度,關(guān)注危機處理的輿論導(dǎo)向。五是,加強監(jiān)管民警隊伍建設(shè),設(shè)立監(jiān)管民警的準(zhǔn)入資格,建立公安系統(tǒng)內(nèi)跨警種交流制度和監(jiān)管場所工作人員分類制度,加強監(jiān)管民警隊伍的能力建設(shè)。
[Abstract]:The public security supervision place is the state criminal, the administrative law enforcement organ which establishes according to the law. The safety management of public security supervision places is the core of public security supervision work. To study the safety management of public security supervision places can ensure the safety and stability of public security supervision places, prevent and reduce illegal crimes, and improve the public security supervision work. It is of great significance to promote the construction of a harmonious society. Taking the safety management of the public security supervision place as the research object and the safety management of the public security detention center as the entrance, the paper expounds the real situation of the security management in the public security supervision place. This paper analyzes on the problems existing in the safety management of public security supervision places in our country and the causes, and puts forward the general ideas and concrete measures to strengthen the safety management of public security supervision places on the basis of this. The thesis is divided into four chapters. The first chapter expounds the significance of the research on the safety management of the public security supervision places from the overview of the safety management of the public security supervision places, compares the current research situation and the viewpoints at home and abroad, and puts forward the research ideas and research methods of this paper. The second chapter introduces the overall situation of the safety management of the public security supervision places in China, analyzes the subjective and objective reasons that affect the safety management of the public security supervision places, and points out that the guiding ideology is one-sided, and the safety management consciousness of some police supervision is weak. The problem of job burnout of police supervision is prominent, the subjective reasons such as the lag of the idea of law enforcement by the police, and the imperfection of the safeguard mechanism of the supervision place in the real work, the change of the crime situation, the increasing complexity of the object of detention, etc. It affects the safety and stability of public security supervision places. The third chapter introduces the prison management experience of the United States, Britain, Germany, Spain and other countries, and points out that the model of separate custody should be improved, the construction of supervision places should be improved, and the hierarchical and classified management of police supervision should be implemented. It is of great significance to strengthen the safety management of public security supervision places. The fourth chapter aims at the existing main problems, on the basis of drawing lessons from foreign experience, puts forward the general ideas and concrete measures to strengthen the safety management of the public security supervision places in our country: first, to strengthen the security of the public security supervision work, from the legislation, Funds are guaranteed to be embodied. Second, it is necessary to improve the quality of the infrastructure construction of the public security supervision sites, formulate standards for the infrastructure construction of the supervision sites, establish an evaluation mechanism for the construction of the supervision sites, and pay attention to the specialized management of the construction process of the facilities. Third, it is necessary to establish a standardized operating mechanism for regulatory sites, improve the safety management system of regulatory sites, promote the investigation and rectification of hidden dangers, and pay attention to the effectiveness and pertinence of tracing back responsibility. Fourth, we should strengthen the crisis management ability of supervising places, perfect the process of crisis management, improve the response speed of crisis response, and pay attention to the guidance of public opinion on crisis management. Fifth, it is necessary to strengthen the supervision of the construction of the police contingent, establish the qualification for the admission of the police supervision, establish a system of cross-police exchanges within the public security system and a system for classifying the personnel working in the supervising places, and strengthen the capacity-building for the supervision of the police force.
