【摘要】： 20世紀(jì)以來,青少年犯罪不斷增長,逐步發(fā)展成為一個世界性的嚴(yán)重社會問題,與環(huán)境污染、吸毒販毒并稱為當(dāng)今世界三大公害。到20世紀(jì)80年代,我國青少年犯罪占全部犯罪的60%以上,青少年已成為犯罪的主體人群。如何有效地預(yù)防和減少青少年犯罪,關(guān)系到國家長治久安,也關(guān)系到和諧社會建設(shè)。社區(qū)矯正是應(yīng)對我國社會轉(zhuǎn)型期青少年犯罪嚴(yán)峻挑戰(zhàn)的有效途徑,在提高矯正效果、遏制青少年犯罪方面都具有傳統(tǒng)監(jiān)禁矯正不可比擬的優(yōu)勢。 本文以犯罪青少年社區(qū)矯正為研究立足點,首先對社區(qū)矯正的含義、基本特征以及犯罪青少年社區(qū)矯正相對于監(jiān)禁矯正的優(yōu)勢作了理論分析;其次對美國、英國和法國等發(fā)達(dá)國家及巴西、香港等發(fā)展中國家和地區(qū)開展犯罪青少年社區(qū)矯正的實踐情況及借鑒意義進(jìn)行實證分析;最后在對我國開展犯罪青少年社區(qū)矯正的主要做法和存在問題認(rèn)真分析的基礎(chǔ)上,系統(tǒng)提出推進(jìn)我國犯罪青少年社區(qū)矯正體系建設(shè)的主要思路。即:完善我國犯罪青少年社區(qū)矯正法律法規(guī)、完善我國犯罪青少年社區(qū)矯正工作主體、完善我國犯罪青少年社區(qū)矯正項目設(shè)置、完善我國犯罪青少年社區(qū)矯正工作方法、完善我國犯罪青少年社區(qū)矯正環(huán)境建設(shè)。 在研究方法上,以辯證唯物主義和歷史唯物主義的基本原則、立場和方法為指導(dǎo),采用了理論分析法、實證分析等多種方法。
[Abstract]:Since twentieth Century, juvenile delinquency has been growing and gradually developed into a worldwide serious social problem. Environmental pollution, drug trafficking and drug trafficking are known as the three major public hazards in the world. By 1980s, juvenile delinquency in China accounted for more than 60% of all crimes, and young people have become the main body of crime. How to effectively prevent and reduce the crime Juvenile delinquency is related to the long-term stability of the country and the construction of a harmonious society. Community correction is an effective way to deal with the serious challenges of juvenile delinquency in the period of social transformation in China. It has the advantages of traditional imprisonment correction in improving the effect of correction and preventing juvenile delinquency.
Based on the research of community correction of juvenile delinquents, this paper first analyzes the meaning and basic characteristics of community correction and the advantages of community correction of juvenile delinquents compared with the advantages of imprisonment correction; secondly, we carry out community correction in developing countries and regions such as the United States, Britain and France and other developing countries and regions such as Brazil, Hongkong and other countries. On the basis of serious analysis of the main practice and problems of community correction of juvenile delinquents in our country, the main ideas of promoting the construction of community correction system for juvenile delinquents in China are put forward systematically. The main body of community correction work of juvenile delinquents in our country, perfect the setting of community correction project for juvenile delinquents in our country, perfect the working methods of community correction for juvenile delinquents in our country, and perfect the construction of community correction environment for juvenile delinquents in our country.
In the study method, we take the basic principles of dialectical materialism and historical materialism, position and method as guidance, and adopt a variety of methods, such as theoretical analysis, empirical analysis and so on.
