【摘要】：臺灣地區(qū)目前之有組織犯罪,集團(tuán)化、幫派化甚至組織化的趨向已日益明顯。黑道幫派以組織化的型態(tài),介入各行各業(yè)經(jīng)營,更積極介入政治,導(dǎo)致「黑金政治」成為目前最嚴(yán)重的政治問題。臺灣地區(qū)黑道的演進(jìn)如同國外黑道之發(fā)展模式,先由流氓演變至幫派,最后發(fā)展至有組織犯罪。隨著社會、政治、經(jīng)濟(jì)快速變遷,使得近年來的黑道活動型態(tài)呈現(xiàn)多樣化與成長化。 因此,本研究藉由探究臺灣地區(qū)有組織犯罪的背景與原因,并借鏡世界各國組織犯罪狀況與法制,最后針對臺灣地區(qū)之有組織犯罪現(xiàn)象提出妥適對策與觀點(diǎn),包括法制面、執(zhí)行面與政策面各方面的探討,企圖在眾多現(xiàn)有組織犯罪的理論中,整理并發(fā)展出適合臺灣地區(qū)情況與需求之理論。期望透過對有組織犯罪現(xiàn)象的回顧與現(xiàn)行法制面與執(zhí)行面的檢討,對立法、執(zhí)法機(jī)關(guān)未來方向之厘清與有組織犯罪防制工作有所幫助。 研究方法主要采用文獻(xiàn)資料分析法,運(yùn)用科學(xué)方法,進(jìn)行臺灣地區(qū)有組織犯罪現(xiàn)象的本土性實(shí)證研究。采用比較分析與官方統(tǒng)計資料分析法,針對臺灣地區(qū)有組織犯罪進(jìn)行基礎(chǔ)研究,即透過文獻(xiàn)資料的搜集、整理、探討、分析、整合并建構(gòu)全面性抗制有組織犯罪之策略,提供政府發(fā)展有組織犯罪對抗機(jī)制之參研。 本研究對于臺灣地區(qū)防制有組織犯罪提出適切的對策。在預(yù)防與控制有組織犯罪方面,過去四十年來,臺灣一系列的執(zhí)行掃黑行動,成果雖令人激賞,但有組織犯罪仍不斷孳長。因此,在預(yù)防與控制的實(shí)務(wù)操作上若能采取直接取締與預(yù)防措施的雙軌并行的方式,從源頭肅清與從下游打擊同時并進(jìn),方能有效控制有組織犯罪;在法制面對策上,臺灣近年來已陸續(xù)完成「檢肅流氓條例」與「組織犯罪防制條例」,并完成相關(guān)防制法律的建置,如「證人保護(hù)法」、「通訊保障及監(jiān)察法」、「洗錢防制法」、「毒品危害防制法」以及「槍炮彈藥刀械管制條例」與「犯罪被害人保護(hù)法」等,這些努力使臺灣法制面的防護(hù)網(wǎng)更趨完整。在執(zhí)行面對策方面,提出幾點(diǎn)對策:第一,相關(guān)法律必須再加以檢討修訂,使法制更加完備;第二,臺灣與大陸應(yīng)加強(qiáng)交流合作打擊有組織犯罪;第三,鑒于世界恐怖活動日趨活躍,應(yīng)積極立法規(guī)范預(yù)防與處理相關(guān)制度。第四,有組織犯罪的國際化與跨疆界使得加強(qiáng)合作查緝跨國或跨境有組織犯罪成為必要的作法。除了以上四點(diǎn),執(zhí)行上尚須注意非法入境及海上犯罪問題,如走私槍枝、彈藥、刀械與運(yùn)毒,洗錢等,尋求全面性的犯罪防制。
[Abstract]:The trend of organized crime, collectivization, gangs and even organization in Taiwan is becoming more and more obvious. The "black gold politics" has become the most serious political problem at present because of the organized form of the black gangs, their involvement in various industries and their more active involvement in politics. The evolution of the mafia in Taiwan is like the development mode of the foreign mafia, from hooligan to gang, and finally to organized crime. With the rapid changes of society, politics and economy, the forms of mafia activities in recent years have diversified and grown. Therefore, by exploring the background and causes of organized crime in Taiwan, and learning from the situation and legal system of organized crime in various countries in the world, this study finally puts forward appropriate countermeasures and viewpoints on organized crime in Taiwan, including the legal aspect. The discussion of executive and policy aspects attempts to collate and develop a theory suitable for the situation and needs of Taiwan in many existing theories of organized crime. It is expected that the review of the organized crime phenomenon and the review of the current legal system and enforcement aspects will help to clarify the future direction of the legislation and the law enforcement agencies and to prevent and control organized crime. The research methods mainly use literature analysis and scientific methods to carry out local empirical research on organized crime in Taiwan. By means of comparative analysis and official statistical analysis, the basic research on organized crime in Taiwan is carried out, that is, through the collection, collation, discussion, analysis, integration and construction of a comprehensive strategy against organized crime. To provide the government with the opportunity to develop a mechanism to combat organized crime. This study provides appropriate countermeasures for the prevention and control of organized crime in Taiwan. In the area of prevention and control of organized crime, in the past 40 years, Taiwan has carried out a series of anti-triad operations, the results of which have been admirable, but organized crime has continued to grow. Therefore, in the practical operation of prevention and control, we can effectively control organized crime if we can adopt a two-track parallel approach of direct banning and preventive measures, and eliminate the source and strike at the same time from the downstream, so that we can effectively control organized crime. In recent years, Taiwan has completed one after another the "regulations on the suppression of hooligans" and the "Prevention of organized Crime Ordinance," and has completed the establishment of related prevention laws, such as the Witness Protection Law, the Communications Protection and Supervision Act, and the money laundering Prevention Act. The Drug harm Prevention Law, the regulations on the Control of Guns and ammunition, and the Law on the Protection of victims of Crime, etc., all these efforts have made Taiwan's legal protection net more complete. In the implementation of the policy, several countermeasures are put forward: first, the relevant laws must be further reviewed and amended to make the legal system more complete; second, Taiwan and the mainland should strengthen exchanges and cooperation to combat organized crime; and thirdly, In view of the increasing activity of terrorism in the world, we should legislate actively to standardize the system of prevention and treatment. Fourth, the internationalization and cross-border nature of organized crime make it necessary to strengthen cooperation in the detection of transnational or cross-border organized crime. In addition to the above four points, we should also pay attention to the problems of illegal immigration and maritime crimes, such as smuggling guns, ammunition, knives, weapons and drugs, money laundering and so on, and seek comprehensive crime prevention and control.
