【摘要】：電子證據(jù)是電子技術(shù)發(fā)展的產(chǎn)物，可以斷定，，隨著電子技術(shù)對人類生活影響的日益顯現(xiàn)，電子證據(jù)是司法實踐無法也不應當回避的重要課題。電子證據(jù)與傳統(tǒng)的證據(jù)類型有何異同，如何接受現(xiàn)有證據(jù)規(guī)則的檢驗，如何在現(xiàn)有證據(jù)規(guī)則基礎(chǔ)上解決電子證據(jù)的采納問題是證據(jù)學研究的新領(lǐng)域。 論文從電子證據(jù)的定義和特性出發(fā)，從技術(shù)和法律二方面闡述了電子證據(jù)的一般問題；通過對電子證據(jù)證明機制的區(qū)分，筆者提出電子證據(jù)屬于傳統(tǒng)證據(jù)的觀點；論文運用比較研究的方法，介紹了世界上電子證據(jù)立法比較先進的國家關(guān)于電子證據(jù)適用鑒證規(guī)則、最佳證據(jù)規(guī)則、傳聞證據(jù)規(guī)則和非法證據(jù)排除規(guī)則的不同做法；結(jié)合筆者在審判實踐中遇到的電子證據(jù)可：采性問題作了實證分析；最后，文章結(jié)合我國證據(jù)立法的現(xiàn)狀和發(fā)展趨勢，對電子證據(jù)可采性問題提出立法建議。
[Abstract]:Electronic evidence is the product of the development of electronic technology. It can be concluded that with the increasing impact of electronic technology on human life, electronic evidence is an important subject that can not and should not be evaded in judicial practice. What are the similarities and differences between electronic evidence and traditional evidence types, how to accept the test of existing evidence rules, and how to solve the problem of electronic evidence adoption on the basis of existing evidence rules is a new field of evidential research. Based on the definition and characteristics of electronic evidence, this paper expounds the general problems of electronic evidence from two aspects of technology and law, and points out that electronic evidence belongs to traditional evidence by distinguishing the mechanism of proof of electronic evidence. By using the method of comparative study, this paper introduces the different practices of the countries in the world where the electronic evidence legislation is more advanced on the application of the authentication rules, the best evidence rules, the hearsay rules and the exclusionary rules of illegal evidence. Combined with the author's experience in the trial practice, the author makes an empirical analysis on the admissibility of electronic evidence. Finally, the article puts forward some legislative suggestions on the admissibility of electronic evidence in the light of the current situation and development trend of the evidence legislation in our country.
