【摘要】：犯罪是人類社會發(fā)展到一定歷史階段所出現(xiàn)的社會現(xiàn)象，它同國家和法一樣，是階級矛盾不可調(diào)和的產(chǎn)物。我國的犯罪學(xué)是從總體上對犯罪這一社會現(xiàn)象進(jìn)行綜合研究的科學(xué)，具體說犯罪學(xué)是研究犯罪現(xiàn)象、犯罪原因和犯罪對策的科學(xué)。我國刑法所規(guī)定的生產(chǎn)、銷售偽劣產(chǎn)品犯罪是指生產(chǎn)者、銷售者故意在產(chǎn)品中摻雜、摻假、以假充真、以次充好或者以不合格產(chǎn)品冒充合格產(chǎn)品，銷售金額5萬元以上的行為。 本文運用犯罪學(xué)原理，主要以我國在市場經(jīng)濟(jì)條件下，懲治和預(yù)防生產(chǎn)、銷售偽劣產(chǎn)品犯罪的現(xiàn)實需要為基礎(chǔ)，，從預(yù)防和控制生產(chǎn)、銷售偽劣產(chǎn)品犯罪的理論研究和實際需要的具體情況出發(fā)，結(jié)合實例，通過對生產(chǎn)、銷售偽劣產(chǎn)品犯罪現(xiàn)象、原因的分析，力圖從犯罪學(xué)的理論視角對生產(chǎn)、銷售偽劣產(chǎn)品的犯罪行為在犯罪預(yù)防和控制策略措施方面進(jìn)行探討。 本文由引言、正文、結(jié)語三部分構(gòu)成，正文分四章。 第一章為生產(chǎn)、銷售偽劣產(chǎn)品犯罪概述。在本章中，作者分三節(jié)闡述了我國生產(chǎn)、銷售偽劣產(chǎn)品犯罪的概念和犯罪構(gòu)成，當(dāng)前我國生產(chǎn)、銷售偽劣產(chǎn)品犯罪的現(xiàn)狀及特點，并對當(dāng)前我國生產(chǎn)、銷售偽劣產(chǎn)品犯罪日益猖獗的原因進(jìn)行了剖析。 從第二章至第四章，作者著重根據(jù)第一章對我國生產(chǎn)、銷售偽劣
[Abstract]:Crime is a social phenomenon which appears in a certain historical stage of the development of human society. It is an irreconcilable product of class contradiction, just like the state and law. The criminology of our country is the science which carries on the comprehensive research to the crime this social phenomenon from the whole, specifically says the criminology is the science which studies the crime phenomenon, the crime reason and the crime countermeasure. The crime of producing and selling fake and inferior products stipulated in the criminal law of our country refers to the behavior of producers, sellers deliberately adulterating and adulterating products, pretending to be true, impersonating qualified products with substandard or unqualified products, and selling more than 50,000 yuan. Based on the practical need of punishing and preventing the crime of producing and selling fake and inferior products in China under the condition of market economy, this paper applies the principles of criminology to prevent and control production. On the basis of the theoretical research on the crime of selling fake and inferior products and the concrete situation of the actual needs, and combining with the examples, through the analysis of the criminal phenomena and causes of the production and sale of fake and inferior products, the author tries to analyze the production from the angle of view of criminology. The crime of selling fake and inferior products is discussed in crime prevention and control strategy. This paper consists of three parts: introduction, text and conclusion, and the text is divided into four chapters. The first chapter is an overview of the crime of producing and selling fake and inferior products. In this chapter, the author expounds the concept and constitution of the crime of producing and selling fake and inferior products in our country, the present situation and characteristics of the crime of producing and selling fake and inferior products in our country, and the current production in our country. The reason why the crime of selling fake and inferior products is increasingly rampant is analyzed. From chapter two to chapter four, the author focuses on the production and sale of fake and inferior goods in China according to the first chapter.
