【摘要】：技術(shù)是一把雙刃劍。在信息社會(huì),計(jì)算機(jī)及其網(wǎng)絡(luò)在造福人類的同時(shí),計(jì)算機(jī)網(wǎng)絡(luò)違法犯罪也迅速蔓延,涉及社會(huì)的各個(gè)領(lǐng)域,社會(huì)危害性塵囂日上。面對(duì)計(jì)算機(jī)網(wǎng)絡(luò)違法犯罪的肆虐,世界各國(guó)紛紛采取措施懲治和預(yù)防計(jì)算機(jī)網(wǎng)絡(luò)犯罪,筆者所在的廣西河池市也不例外地遭受計(jì)算機(jī)網(wǎng)絡(luò)犯罪的侵蝕。筆者在調(diào)查研究的基礎(chǔ)上,結(jié)合辦案工作實(shí)踐,形成了《河池市網(wǎng)絡(luò)違法犯罪情況調(diào)查》一文。 本文共分為三部分。 第一部分介紹了河池市互聯(lián)網(wǎng)絡(luò)發(fā)展概況。河池市位于廣西壯族自治區(qū)的西北部,屬中國(guó)西南喀斯特地區(qū)之一。該市接入互聯(lián)網(wǎng)的注冊(cè)用戶已超過(guò)48200 戶,寬帶用戶數(shù)與人口比率約為1:79,而全國(guó)的比率為1:50,可見該市互聯(lián)網(wǎng)普及程度低于全國(guó)平均水平。 第二部分為河池市網(wǎng)絡(luò)違法犯罪的現(xiàn)狀和原因。筆者認(rèn)為網(wǎng)絡(luò)犯罪是行為主體利用計(jì)算機(jī)網(wǎng)絡(luò)實(shí)施的違反刑事法律的,應(yīng)受到刑罰處罰的嚴(yán)重危害社會(huì)的行為。河池市網(wǎng)絡(luò)違法犯罪案件類型繁多,主要包括網(wǎng)絡(luò)詐騙、賭博、盜竊、色情、傳銷、傳播有害信息等。河池市網(wǎng)絡(luò)違法犯罪案件的特點(diǎn)有:違法犯罪人員的文化程度以高中或中專為主; 違法犯罪案件類型以網(wǎng)絡(luò)詐騙、網(wǎng)絡(luò)賭博居多; 違法犯罪人員低齡化突出。河池市網(wǎng)絡(luò)違法犯罪將呈現(xiàn)如下發(fā)展趨勢(shì):網(wǎng)絡(luò)違法犯罪活動(dòng)將日益社會(huì)化,網(wǎng)絡(luò)違法犯罪數(shù)量可能繼續(xù)上升,網(wǎng)絡(luò)違法犯罪性質(zhì)日趨嚴(yán)重,對(duì)社會(huì)穩(wěn)定的危害將加劇,有可能出現(xiàn)新的網(wǎng)絡(luò)違法犯罪的類型。河池市網(wǎng)絡(luò)違法犯罪的原因是多種多樣的,法制觀念淡薄、僥幸心理作祟是其中之一; 其次是控制力量薄弱,預(yù)防、打擊網(wǎng)絡(luò)違法犯罪缺乏力度; 再次是有關(guān)計(jì)算機(jī)網(wǎng)絡(luò)的立法嚴(yán)重滯后; 第四是社會(huì)觀念存在誤區(qū); 最后是重應(yīng)用、輕安全,高科技監(jiān)控管理手段相對(duì)滯后。 第三部分為河池市網(wǎng)絡(luò)違法犯罪的防控策略。雖然目前青少年還不是河池網(wǎng)絡(luò)違法犯罪的主要群體,但經(jīng)驗(yàn)告訴我們,預(yù)防網(wǎng)絡(luò)違法犯罪必須從青少年抓起,必須針對(duì)青少年網(wǎng)民的實(shí)際情況,對(duì)
[Abstract]:Technology is a double-edged sword. In the information society, while computer and its network are benefiting mankind, computer network crimes also spread rapidly, involving all fields of society, social harmfulness and ravage. Facing the raging of illegal crimes in computer networks, various countries have taken measures to punish and prevent computer network crimes. The city of Hechi, the city of Guangxi, is also subjected to the erosion of computer network crime. On the basis of the investigation and research, the author has formed the article of the investigation of the situation of network illegal crime in Hechi.
This article is divided into three parts.
The first part introduces the development of the Internet Network in Hechi. Hechi is located in the northwest of the Guangxi Zhuang Autonomous Region, one of the Karst regions in Southwest China. The registered users of the city have more than 48200 registered users, the ratio of the number of broadband users to the population is about 1:79, and the national ratio is 1:50, and the low popularity of the Internet in the city is low. The second part is the current situation and cause of the network illegal crime in Hechi. The author thinks that the network crime is a violation of criminal law by the main body of behavior, which is violated by the computer network, and should be punished severely by the punishment. There are many types of illegal crimes in Hechi, including network fraud, gambling, theft, pornography, and transmission. The characteristics of the illegal and criminal cases in Hechi are as follows: the cultural degree of the criminal offenders is mainly in high school or secondary school; the types of illegal crimes are based on network fraud, network gambling is most; the illegal offenders are very young. The Internet crimes in Hechi will present the following development trend: network illegal crime The activities will become more and more socialized, the number of illegal crimes in the network may continue to rise, the nature of the network illegal and crime is becoming more and more serious, the harm to the social stability will be aggravated, and the new types of network crimes are likely to occur. The reasons for the illegal crimes in Hechi are various, the concept of the legal system is weak and the fluke psychology is one of them. The second is the weak control of the power, the prevention and the fight against the lack of the network illegal crime; again, the legislation of the computer network is seriously lagging behind; fourth is the misunderstanding of the social concept, and the last is the heavy application, the light safety, and the relatively lagging of the high-tech monitoring and management means.
The third part is the prevention and control strategy of network illegal crime in Hechi. Although teenagers are not the main group of illegal crimes in Hechi at present, the experience tells us that the prevention of network crimes must be taken from young people and must be aimed at the actual situation of young netizens.
