【摘要】：本文立足司法實(shí)踐,對職務(wù)犯罪中的反偵查問題及其對策進(jìn)行了嘗試性的研究。全文共分三個部分,約三萬余字。 第一部分,職務(wù)犯罪中反偵查的內(nèi)涵。通過對反偵查行為的產(chǎn)生、實(shí)施主體、最終目的及其范疇的論述,探討并界定了反偵查的內(nèi)涵。在此基礎(chǔ)上,初步分析了偵查與反偵查相生相克、相互促進(jìn)的辯證關(guān)系,進(jìn)而對職務(wù)犯罪中的反偵查做了概括性闡述。 第二部分,職務(wù)犯罪中的反偵查行為分析。職務(wù)犯罪中,實(shí)施反偵查活動的主體和作用對象具有廣泛性,實(shí)施反偵查活動的主觀動機(jī)和方式具有多樣性,反偵查活動具有很強(qiáng)的針對性和系統(tǒng)性,進(jìn)而導(dǎo)致職務(wù)犯罪中的反偵查行為具有較強(qiáng)的破壞性。本文從職務(wù)犯罪嫌疑人的職業(yè)技能和犯罪經(jīng)驗(yàn)、社會傳媒的影響以及偵查方法、手段的進(jìn)步等方面對職務(wù)犯罪中反偵查活動的形成來源進(jìn)行了總結(jié)提煉。總結(jié)了司法實(shí)踐中犯罪嫌疑人、證人等主體所實(shí)施的常見反偵查行為,并在此基礎(chǔ)上,對職務(wù)犯罪嫌疑人、證人等不同主體實(shí)施反偵查活動的主客觀原因進(jìn)行了較為具體的歸納與分析。 第三部分,職務(wù)犯罪中反偵查活動的對策。這是本文研究的重點(diǎn)。反偵查對策是有效地揭露和遏制職務(wù)犯罪嫌疑人的反偵查行為,提高偵查效率的一個對策體系。本文立足現(xiàn)實(shí)政治法律制度和執(zhí)法環(huán)境,
[Abstract]:Based on judicial practice, this paper makes a tentative study on the problem of anti-investigation in duty crime and its countermeasures. The full text is divided into three parts, about 30,000 words. The first part, the connotation of anti-investigation in duty crime. Based on the discussion of the emergence, the subject, the ultimate purpose and the category of the anti-investigation, the connotation of anti-investigation is discussed and defined. On this basis, the dialectical relationship between investigation and counter-investigation is analyzed, which promotes each other, and then makes a general exposition of the counter-investigation in duty crime. The second part is the analysis of anti-investigation behavior in duty crime. In the crime of duty, the subject and object of anti-investigation activities are extensive, the subjective motive and ways of carrying out anti-investigation activities are diverse, and the anti-investigation activities have strong pertinence and systematicness. Therefore, the anti-investigation behavior in duty crime is destructive. This paper summarizes and refines the origin of anti-investigation activities in duty crime from the aspects of professional skills and criminal experience of duty crime suspects, the influence of social media and the progress of investigation methods and means. This paper summarizes the common anti-investigation behaviors carried out by criminal suspects, witnesses and other subjects in judicial practice, and on the basis of the above, The subjective and objective reasons why different subjects such as witnesses carry out anti-investigation activities are summarized and analyzed in detail. The third part, the countermeasure of anti-investigation in duty crime. This is the focus of this paper. Counter-investigation countermeasure is a countermeasure system which can effectively expose and restrain the anti-investigation behavior of duty criminal suspects and improve the investigation efficiency.
