【摘要】：我國(guó)從農(nóng)業(yè)經(jīng)濟(jì)向工業(yè)經(jīng)濟(jì)轉(zhuǎn)換過(guò)程中，社會(huì)機(jī)制的相對(duì)混亂和弱化使黑社會(huì)性質(zhì)犯罪有了生存的空間。黑社會(huì)是在國(guó)家權(quán)力出現(xiàn)空缺時(shí)產(chǎn)生的，，其滋生和發(fā)展與國(guó)家政治生活形式息息相關(guān)。在我國(guó)不存在絕對(duì)權(quán)力空缺，但政治體制改革的滯后性使社會(huì)出現(xiàn)政治弱化和社會(huì)控制乏力，為黑社會(huì)性質(zhì)犯罪提供了生存空間。任何一個(gè)政府都利用法律這一專政工具對(duì)其進(jìn)行打擊和控制。我國(guó)打擊和控制黑社會(huì)性質(zhì)犯罪的法律制度不完善；對(duì)權(quán)力監(jiān)督制約的法制體制亦不完善。政治腐敗是黑社會(huì)性質(zhì)犯罪依附的政治“毒瘤”，黑社會(huì)與腐敗相結(jié)合，不僅縱容了黑社會(huì)的囂張氣焰，而且還可能造成政局不穩(wěn)。后現(xiàn)代多元化特征的政治取向使政治體系呈現(xiàn)出混亂和無(wú)序，造成我們思想上的混亂。黑社會(huì)性質(zhì)犯罪組織作為一股容易被利用的潛在政治力量，在資本主義和社會(huì)主義兩種政治制度的斗爭(zhēng)中，被某些反動(dòng)政治勢(shì)力利用必將成為我國(guó)政權(quán)的一大威脅。
[Abstract]:In the process of transformation from agricultural economy to industrial economy, the relative confusion and weakening of social mechanism give the underworld crime a living space. The underworld is produced when the state power is vacant, and its breeding and development are closely related to the state political life form. There is no absolute power vacancy in our country, but the lagging nature of the political system reform makes the society appear the political weakening and the social control is weak, has provided the existence space for the underworld nature crime. Any government uses the law as a tool of dictatorship to combat and control it. The legal system of cracking down and controlling underworld crimes in China is not perfect, and the legal system of power supervision and restriction is also imperfect. Political corruption is a "malignant tumor" of politics that underworld crime depends on. The combination of underworld and corruption not only connives the arrogance of underworld, but also may cause political instability. The political orientation of the pluralistic character of post-modern makes the political system present chaos and disorder, resulting in the confusion of our thoughts. As a potential political force which is easy to be used, the criminal organization of underworld nature will be used by some reactionary political forces in the struggle of capitalist and socialist political systems, and it will become a great threat to the political power of our country.
