【摘要】： 社區(qū)矯正，英文Communitv correction，有的國(guó)家稱之為“社區(qū)矯治”，它是一種不使罪犯與社會(huì)隔離并利用社區(qū)資源教育改造罪犯的方法，是所有在社區(qū)環(huán)境中管理教育罪犯方式的總稱。也是西方發(fā)達(dá)國(guó)家普遍運(yùn)用的一種社會(huì)化的矯正模式。2003年7月，我國(guó)最高人民法院、最高人民檢察院、公安部、司法部聯(lián)合下發(fā)了《關(guān)于開展社區(qū)矯正試點(diǎn)工作的通知》，，它標(biāo)志著我刑罰執(zhí)行改革的國(guó)際化方向。 長(zhǎng)期以來(lái)，由于受重刑思想的影響和擔(dān)心社會(huì)不穩(wěn)定等原因，加之相關(guān)的非監(jiān)禁刑罰執(zhí)行方式的配套措施不完善，我國(guó)在司法實(shí)踐中大量使用監(jiān)禁刑，將非監(jiān)禁刑控制在很小的范圍內(nèi)。但隨著刑罰文明的進(jìn)步，傳統(tǒng)監(jiān)禁刑的弊端已成為刑罰學(xué)界的普遍共識(shí)，我國(guó)的監(jiān)禁改造又面臨著諸多的困境，罪犯改造質(zhì)量難以提高，行刑社會(huì)化已成為刑罰改革的必然趨勢(shì)。 首先，社區(qū)矯正代表著先進(jìn)的刑罰理念。標(biāo)簽理論、復(fù)歸理論、行刑社會(huì)化理論是社區(qū)矯正的理論基礎(chǔ)和依據(jù)，人道、高效、經(jīng)濟(jì)則是社區(qū)矯正的價(jià)值體現(xiàn)。 其次，實(shí)施社區(qū)矯正是我國(guó)刑罰改革的必由之路。我國(guó)的監(jiān)禁矯正面臨著監(jiān)禁資源緊缺、服刑人員之問的交叉感染和深度感染問題嚴(yán)重、刑釋人員難以適應(yīng)社會(huì)、罪犯改造質(zhì)量難以提高等諸多困境，要解決上述問題，構(gòu)建社區(qū)矯正顯然是最佳途徑。 最后，要構(gòu)建出適合我國(guó)國(guó)情的社區(qū)矯正制度，必須要分析我國(guó)具備的本土資源，樹立先進(jìn)的刑罰理念，設(shè)計(jì)出科學(xué)的社區(qū)矯正運(yùn)作模式。 社區(qū)矯正制度的建立和完善，是一個(gè)系統(tǒng)工程，涉及到刑罰理念、司法改革、權(quán)力重構(gòu)、立法完善、執(zhí)行保障和社區(qū)支持等方方面面，只有社會(huì)各界的高度理解、積極參與和鼎力協(xié)助，這個(gè)代表人類刑罰文明進(jìn)步的制度才能夠順利構(gòu)建和正常運(yùn)轉(zhuǎn)。
[Abstract]:Community Correction (Communitv Correction), which is called "Community Correction" in some countries, is a method of not isolating criminals from society and using community resource education to reform criminals. It is a general term for all the ways of managing criminals in community environment. In July 2003, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security, The Ministry of Justice jointly issued the notice on carrying out the pilot work of Community Correction, which marks the internationalization direction of our penalty execution reform. For a long time, due to the influence of the thought of heavy punishment and the fear of social instability, coupled with the imperfect measures related to the execution of non-custodial penalties, our country has used a large number of prison sentences in judicial practice. Keep non-custodial sentences within a very small range. However, with the progress of penalty civilization, the malpractice of traditional imprisonment has become a common understanding in the field of punishment, and the reform of imprisonment in our country is faced with many difficulties, and the quality of the reform of criminals is difficult to improve. The socialization of execution has become the inevitable trend of penalty reform. First of all, community correction represents the advanced concept of punishment. Label theory, return theory and socialized execution theory are the theoretical basis and basis of community correction. Humanity, efficiency and economy are the value embodiment of community correction. Secondly, community correction is the only way of penalty reform in China. The prison correction in our country is faced with the shortage of imprisonment resources, the serious problems of cross-infection and deep infection among the prisoners, the difficulty of the released prisoners to adapt to the society, the difficulty of improving the quality of the criminals' reform, and so on. Building community correction is clearly the best approach. Finally, in order to construct a community correction system suitable for our national conditions, we must analyze the local resources of our country, set up advanced penalty concept, and design a scientific operation mode of community correction. The establishment and improvement of community correction system is a systematic project, involving penalty concept, judicial reform, power reconstruction, legislative perfection, executive protection and community support, etc. Only through active participation and vigorous assistance, can this system, which represents the progress of human penalty civilization, be constructed and run smoothly.
