【摘要】： 黑社會(huì)性質(zhì)組織犯罪對(duì)社會(huì)具有巨大的危害性和整體沖擊性,其發(fā)展、蔓延正嚴(yán)重威脅著我國(guó)的政治、經(jīng)濟(jì)和社會(huì)的發(fā)展。如何改革和完善立法與司法,并從理論上探討防治黑社會(huì)性質(zhì)組織犯罪的對(duì)策問(wèn)題,成為我國(guó)學(xué)界和實(shí)務(wù)界所共同關(guān)注的問(wèn)題。目前,我國(guó)關(guān)于打擊黑社會(huì)性質(zhì)組織犯罪的規(guī)定缺乏系統(tǒng)性、超前性和完備性,難以適應(yīng)打擊日益嚴(yán)重的黑社會(huì)性質(zhì)組織犯罪的要求。因此,我們要準(zhǔn)確有效的打擊黑社會(huì)性質(zhì)組織犯罪,就應(yīng)該立足我國(guó)現(xiàn)實(shí),借鑒外國(guó)經(jīng)驗(yàn),深入地研究黑社會(huì)性質(zhì)組織犯罪的各個(gè)相關(guān)要素,進(jìn)行多角度剖析,為有效預(yù)防和打擊這一社會(huì)毒瘤提供決策依據(jù)。 本文共分為五個(gè)部分。第一部分引言介紹了本文的研究背景及研究黑社會(huì)性質(zhì)組織犯罪的原因和目的;第二部分研究了黑社會(huì)性質(zhì)組織犯罪的概念及特征,并闡述了黑社會(huì)性質(zhì)組織犯罪與相關(guān)犯罪的區(qū)別與聯(lián)系;第三部分研究了我國(guó)黑社會(huì)性質(zhì)組織犯罪的現(xiàn)狀和發(fā)展趨勢(shì);第四部分是中外打擊有組織犯罪的對(duì)策比較研究;第五部分是黑社會(huì)性質(zhì)組織犯罪在我國(guó)的防治對(duì)策,這一部分是本文的重點(diǎn)。本文研究黑社會(huì)性質(zhì)組織犯罪更多的借鑒了《聯(lián)合國(guó)打擊跨國(guó)有組織犯罪公約》的規(guī)定,更多的體現(xiàn)的是有組織犯罪的共性。但犯罪現(xiàn)象根植于各個(gè)國(guó)家特定的社會(huì)環(huán)境,其個(gè)性也是不可忽視的。我國(guó)黑社會(huì)性質(zhì)組織犯罪具有自身的特點(diǎn),這就要求我們更多的研究和總結(jié)經(jīng)驗(yàn),形成具有我國(guó)特色的防控黑社會(huì)性質(zhì)組織犯罪的對(duì)策體系。本文主要運(yùn)用描述性和比較性的研究,對(duì)黑社會(huì)性質(zhì)組織犯罪的相關(guān)要素進(jìn)行了論述,通過(guò)對(duì)中外有組織犯罪特征的比較,并借鑒外國(guó)在打擊有組織犯罪方面的先進(jìn)經(jīng)驗(yàn),提出了在我國(guó)打擊黑社會(huì)性質(zhì)組織犯罪的一些探索和建議。
[Abstract]:The underworld organization crime has great harmfulness and overall impact to the society. Its development and spread are seriously threatening the political, economic and social development of our country. How to reform and perfect the legislation and judicature, and to discuss the countermeasures of preventing and curing the organized crime of the underworld in theory has become the common concern of the academic and practical circles of our country. At present, the regulations on cracking down on the organized crime of the underworld nature lack of systematicness, advance and completeness, so it is difficult to adapt to the demand of cracking down on the increasingly serious organized crime of the underworld nature. Therefore, if we want to crack down accurately and effectively on the organized crime of the underworld nature, we should base ourselves on the reality of our country, draw lessons from the experience of foreign countries, deeply study the relevant elements of the organized crime of the underworld nature, and analyze it from various angles. To effectively prevent and combat this social cancer to provide decision-making basis. This paper is divided into five parts. The first part introduces the research background of this paper, the reasons and purposes of the study, the second part studies the concept and characteristics of the organized crime. The third part studies the present situation and the development trend of the organized crime of the underworld nature in our country, the fourth part is the comparative study on the countermeasures of fighting organized crime between China and foreign countries. The fifth part is the prevention and cure countermeasure of organized crime of underworld nature in our country, this part is the focal point of this article. This paper studies the organized crime with the character of underworld and draws more lessons from the provisions of the United Nations Convention against Transnational organized Crime, and more embodies the commonness of organized crime. But the crime phenomenon is rooted in the specific social environment of each country, and its personality can not be ignored. The organized crime of underworld nature in our country has its own characteristics, which requires us to study more and sum up experience, and form the countermeasure system of preventing and controlling the organized crime of underworld nature with the characteristics of our country. This article mainly uses the descriptive and comparative research, discusses the related elements of organized crime with the nature of underworld, through the comparison of the characteristics of organized crime between China and foreign countries, and draws lessons from the advanced experience of foreign countries in the fight against organized crime. This paper puts forward some exploration and suggestions on cracking down on the organized crime of underworld nature in our country.
