【摘要】：白領(lǐng)犯罪是犯罪學(xué)概念。當(dāng)代社會,白領(lǐng)犯罪遠(yuǎn)比“街頭犯罪”造成的危害更大,然而我國法學(xué)界對白領(lǐng)犯罪的研究明顯薄弱。作者以犯罪學(xué)的視角,界定了白領(lǐng)犯罪,即:白領(lǐng)犯罪是指具有較高社會地位、經(jīng)濟(jì)地位或掌握一定專業(yè)技能的自然人或法人,為了牟取非法利益,采用非體力方式所實(shí)施的一定范圍的違法、犯罪行為。文章中指出白領(lǐng)犯罪的本質(zhì)是對社會信托關(guān)系的違反。以白領(lǐng)犯罪所侵害的法益作為劃分標(biāo)準(zhǔn),作者重新劃分出我國白領(lǐng)犯罪的五大類型,分別是貪賄型、瀆職型、經(jīng)濟(jì)型、妨害型和侵權(quán)型白領(lǐng)犯罪。吸收薩瑟蘭差異交往理論和默頓社會反常理論之精華,文章分析我國白領(lǐng)犯罪的成因,指出我國現(xiàn)階段引發(fā)白領(lǐng)犯罪的社會因素和白領(lǐng)犯罪人的個人因素。進(jìn)而,作者提出我國懲治和預(yù)防白領(lǐng)犯罪的刑事政策:立足預(yù)防,將治理防線適當(dāng)前移,發(fā)揮行政機(jī)關(guān)在懲治白領(lǐng)違法行為中的重要作用;轉(zhuǎn)變單純打擊的觀念,破除迷信重刑的思想觀念,代之以打防結(jié)合,以防為主的策略。
[Abstract]:White-collar crime is a concept of criminology. In contemporary society, white-collar crime is far more harmful than street crime, but the research on white-collar crime is obviously weak. From the perspective of criminology, the author defines white-collar crime, that is, white-collar crime is a natural or legal person with a higher social status, economic status or certain professional skills, in order to obtain illegal interests. A certain range of illegal or criminal acts committed in a non-physical manner. The article points out that the essence of white-collar crime is the violation of social trust relationship. Taking the legal interests infringed by white-collar crimes as the criterion, the author reclassifies the five types of white-collar crimes in our country, which are bribery, malfeasance, economic, nuisance and tort. By absorbing the essence of Sutherland's theory of differential communication and Merton's theory of social anomaly, this paper analyzes the causes of white-collar crime in China, and points out the social factors that cause white-collar crime and the personal factors of white-collar criminals at present. Furthermore, the author puts forward the criminal policy of punishing and preventing white-collar crime in our country: base on prevention, move the line of defense properly forward, give play to the important role of administrative organs in punishing white-collar illegal behavior, change the concept of simple attack, Break down the ideology of superstition and heavy punishment, and replace it with the strategy of combining attack and defense.
