【摘要】： 計(jì)算機(jī)犯罪是伴隨著電子計(jì)算機(jī)、互聯(lián)網(wǎng)和信息技術(shù)的產(chǎn)生和應(yīng)用而出現(xiàn)的一種新型犯罪形式。由于經(jīng)濟(jì)和科技的發(fā)展，計(jì)算機(jī)應(yīng)用越來越廣泛，同時計(jì)算機(jī)犯罪在全球范圍內(nèi)也有愈演愈烈的趨勢，其帶來的社會危害性也越來越大，對經(jīng)濟(jì)發(fā)展和人民生活造成了嚴(yán)重的影響。因此，對此類犯罪的偵查和打擊理所當(dāng)然成了各國警察們的一項(xiàng)重要的任務(wù)，在我國也不例外，面對這種技術(shù)含量高而且極具隱蔽性的計(jì)算機(jī)犯罪，偵查人員在實(shí)踐中應(yīng)對困難、戰(zhàn)術(shù)乏力，而我國學(xué)者目前在這方面較為完整系統(tǒng)的理論也甚為缺乏，多是針對計(jì)算機(jī)犯罪的研究，在偵查方面雖有著述，也僅是集中在某一點(diǎn)上，如對偵查模式或偵查機(jī)構(gòu)的闡述。本文試圖在評析了計(jì)算機(jī)犯罪的特點(diǎn)、成因及發(fā)展趨勢的基礎(chǔ)上，重點(diǎn)闡釋了計(jì)算機(jī)犯罪偵查方面互相聯(lián)系、相互制約的三大問題：偵查機(jī)構(gòu)建設(shè)、偵查模式及偵查措施，并且分別提出了完善策略的構(gòu)想，使得研究此類犯罪偵查的關(guān)鍵點(diǎn)得以突顯和系統(tǒng)化。文章通過詳盡分析目前我國計(jì)算機(jī)犯罪偵查機(jī)構(gòu)出現(xiàn)的問題及原因，在充分考察國外計(jì)算機(jī)犯罪偵查機(jī)構(gòu)建設(shè)的先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上，提出了我國在完善計(jì)算機(jī)犯罪偵查機(jī)構(gòu)建設(shè)的具體建議和設(shè)想，以期能為我國計(jì)算機(jī)犯罪偵查部門的建設(shè)有所幫助。其次，在研究了偵查主體的問題之后，顯而易見，按照怎樣的思路方式去偵查計(jì)算機(jī)犯罪便是計(jì)算機(jī)犯罪偵查部門所面臨的關(guān)鍵問題，也就是計(jì)算機(jī)犯罪的偵查模式問題。從目前公安機(jī)關(guān)偵辦計(jì)算機(jī)犯罪案件的情況看，偵查模式較為陳舊，主要沿襲“從案到人”的偵查辦案模式，導(dǎo)致偵查取證工作陷于被動局面，無法及時有效地應(yīng)對計(jì)算機(jī)犯罪的高科技性和智能化，文章認(rèn)為完善我國目前的偵查模式勢在必行，所以必須逐漸建立起多種新的偵查模式以緊跟時代的步伐，更為重要的是只有這樣才能有效地遏止計(jì)算機(jī)犯罪案件的頻發(fā)，而要做到這一點(diǎn)，首當(dāng)其沖是轉(zhuǎn)變偵查觀念，從偵查實(shí)踐中不斷摸索總結(jié)，盡早構(gòu)建起適應(yīng)我國國情的計(jì)算機(jī)犯罪偵查模式。再次，在前兩者的基礎(chǔ)上，具體的偵查措施成為重中之重，因?yàn)榇胧⿲Q定了最后的偵查效果。文章從一般偵查措施和特別偵查措施兩方面具體論述了在實(shí)施各個具體措施時應(yīng)注意的問題。特別強(qiáng)調(diào)了要強(qiáng)化對具體實(shí)踐的指導(dǎo)，通過對各項(xiàng)具體偵查措施的比較分析，總結(jié)出在實(shí)際運(yùn)用中行之有效的偵查措施，并且提出了進(jìn)一步完善提高的具體建議。 文章運(yùn)用了歷史分析、比較分析和例證分析等研究方法對計(jì)算機(jī)犯罪偵查機(jī)構(gòu)的建設(shè)、偵查模式的構(gòu)建以及具體的偵查措施三個方面的問題進(jìn)行了詳細(xì)地論述，提出了自己的看法和建議，雖然較為粗淺，也希望能引起相關(guān)理論界和實(shí)務(wù)界的關(guān)注，從而完善我國在計(jì)算機(jī)犯罪方面的刑事程序立法，在實(shí)踐中健全相關(guān)機(jī)制，，以便為更加有效地打擊計(jì)算機(jī)犯罪活動提供幫助。
[Abstract]:Computer crime is a new type of crime with the emergence and application of computer, Internet and information technology. Because of the development of economy and science and technology, the application of computer is becoming more and more widespread. At the same time, computer crime is becoming more and more intense around the world, and its social harmfulness is becoming more and more serious. The economic development and the people's lives have caused serious influence. Therefore, the investigation and attack of such crimes have become an important task of the police of all countries. In our country, it is no exception. In the face of this kind of computer crime with high technical content and high concealment, investigators should deal with difficulties and tactics in practice, and our country is weak in practice. At present, the theory of a more complete and systematic study in this field is also very lack, most of which is aimed at the research of computer crime. Although there are writings in the investigation, it is also concentrated on a certain point, such as the investigation mode or the investigation organization. This article tries to analyze the characteristics, causes and development trend of computer crime, and focus on the analysis of the characteristics, causes and development trend of computer crime. The three major problems which are related to each other in the investigation of computer crime and mutual restriction are explained: the construction of investigation institutions, the mode of investigation and the investigation measures, and the ideas of perfecting the tactics are put forward respectively. The key points of the investigation of this kind of crime can be highlighted and systematized. The present problems and reasons, on the basis of the full inspection of the advanced experience of the construction of computer criminal investigation institutions in foreign countries, put forward the concrete suggestions and ideas of improving the construction of computer criminal investigation institutions in our country, in order to help the construction of computer criminal investigation department in China. Secondly, after studying the problems of the investigative subject. It is obvious that how to investigate computer crime according to the way of thinking is the key problem that the computer crime investigation department is facing, that is, the investigation mode of computer crime. From the current situation of the investigation of computer crime in the public security organs, the investigation mode is more obsolete and mainly follows the investigation office "from the case to the person". The case pattern leads to the passive situation of investigation and forensics, and it is impossible to respond to the high-tech and intellectualization of computer crime in time and effectively. It is imperative to improve the current investigation mode of our country, so we must gradually establish a variety of new investigation modes to follow the pace of the times, and more importantly, it is only in this way to be effective. To stop the frequent occurrence of computer crime cases, and to do this, it is the first to change the concept of investigation, explore the summary from the investigation practice, build up a computer crime investigation model to adapt to the national conditions of our country as soon as possible. Again, on the basis of the previous two, the specific detection measures become the most important, because the measures will decide the last. From the two aspects of the general investigation measures and the special investigation measures, the article expounds the problems that should be paid attention to in the implementation of the specific measures. Specific suggestions for further improvement are given.
The article makes use of historical analysis, comparative analysis and example analysis to elaborate on the construction of computer criminal investigation organization, the construction of investigation mode and the specific investigation measures in three aspects, and put forward his own views and suggestions, although it is relatively shallow, it also hopes to cause the relevant theoretical circles and Practice. The concern of the community will improve our criminal procedural legislation on computer crime and improve the relevant mechanisms in practice so as to help to combat computer crime more effectively.
