【摘要】： 近年來，我國(guó)襲擊警察事件頻頻發(fā)生并呈上升趨勢(shì)，已經(jīng)成為不容回避的事實(shí)。從侮辱謾罵、圍攻阻撓，到暴力抗法、毆打傷害民警，甚至打砸基層公安機(jī)關(guān)，更有甚者，在民警亮明執(zhí)法身份后，一些人仍然叫囂“打的就是警察!”據(jù)公安部統(tǒng)計(jì)，自2001年至2005年，公安民警在執(zhí)法中遇到阻礙或遭到暴力襲擊，犧牲的有300余人，受傷的達(dá)1.68萬余人�！皶r(shí)時(shí)有流血、天天有犧牲”，公安民警是和平時(shí)期最具危險(xiǎn)性的職業(yè)，而襲警事件已經(jīng)成為導(dǎo)致民警傷亡的一個(gè)重要因素。襲警行為不僅嚴(yán)重傷害民警的身體健康，而且是對(duì)警察執(zhí)法權(quán)威和執(zhí)法尊嚴(yán)的挑戰(zhàn)，更是對(duì)國(guó)家法律尊嚴(yán)的藐視、挑釁和踐踏，對(duì)社會(huì)正義的嚴(yán)重褻瀆。 要遏制襲警行為、加強(qiáng)襲警問題的防范、提升民警的執(zhí)法權(quán)威，應(yīng)從整體角度出發(fā)，系統(tǒng)地分析。外因方面，警察執(zhí)法環(huán)境受到法制環(huán)境、行政環(huán)境、輿論環(huán)境、經(jīng)濟(jì)軟環(huán)境、人文素質(zhì)環(huán)境等外部環(huán)境的影響。內(nèi)因方面，主要因素有民警執(zhí)法思想、執(zhí)法程序、執(zhí)法技能、執(zhí)法藝術(shù)以及自我保護(hù)意識(shí)、自我保護(hù)規(guī)范、警民關(guān)系、心理素質(zhì)等。本論文將公共管理理論引入襲警問題的系統(tǒng)分析與防范研究領(lǐng)域中，通過系統(tǒng)分析襲警行為發(fā)生的原因，運(yùn)用公共管理中的環(huán)境影響和質(zhì)量管理涉及的過程方法、系統(tǒng)方法、持續(xù)改進(jìn)等理論，提出要從強(qiáng)化襲警問題防范的法治環(huán)境建設(shè)、優(yōu)化襲警問題防范的資源條件建設(shè)、實(shí)施襲警問題防范的過程管理等三個(gè)方面著手解決問題，提升襲警問題防范的效果評(píng)價(jià)與改進(jìn)制度建設(shè)，實(shí)施形象戰(zhàn)略管理，這樣才能高度樹立民警的執(zhí)法權(quán)威，有效遏制襲警行為的發(fā)生。 本文強(qiáng)調(diào)的是目前就公安機(jī)關(guān)和廣大民警而言，襲警罪的增設(shè)并不是當(dāng)務(wù)之急，但要積極爭(zhēng)取，關(guān)鍵是要端正態(tài)度，苦練基本功，內(nèi)外兼修，密切警民關(guān)系，依法懲處襲警行為，打擊敢于公然襲警的違法犯罪分子的囂張氣焰，樹立民警執(zhí)法權(quán)威。在手段上倡導(dǎo)“事后保護(hù)向事前保護(hù)拓展、從內(nèi)部保護(hù)向社會(huì)保護(hù)拓展、從行政保護(hù)向法律保護(hù)拓展”模式。 總之，當(dāng)前阻礙民警執(zhí)行職務(wù)和暴力襲警事件的發(fā)生，有著復(fù)雜的社會(huì)原因，因此襲警問題的防范要從健全法律法規(guī)、完善制度規(guī)范、加強(qiáng)崗位培訓(xùn)、增加基層警力、改善警用裝備、構(gòu)建和諧警民關(guān)系、改進(jìn)執(zhí)法監(jiān)督、落實(shí)救護(hù)措施、加強(qiáng)輿論宣傳、健全維權(quán)工作機(jī)制等多方面，標(biāo)本兼治，進(jìn)行綜合施策和綜合治理。 最后，關(guān)于進(jìn)一步工作的方向進(jìn)行了簡(jiǎn)要的討論。
[Abstract]:In recent years, China's attacks on police incidents have occurred frequently and on the rise. It has become an unavoidable fact. From insult abuse, siege and obstruction, violence against law, assault and damage to police, even smashing grass-roots public security organs, some people still clamor for "police!" according to the Ministry of public security. From 2001 to 2005, more than 300 people were sacrificed or attacked by the police in the law enforcement. More than 1.68 people were injured. "There is bleeding and sacrifice every day". The police are the most dangerous occupation in the peace period, and the incident of assaulting police has become an important factor leading to the casualties of the police. It is not only a serious injury to the health of the police, but also a challenge to the authority of the police and the dignity of the law enforcement. It is also a defiance of the dignity of the national law, provocation and trampling, and the serious blasphemy of social justice.
In order to contain the attacks of assaulting police, strengthen the prevention of the problem of assaulting police and enhance the authority of the police, we should systematically analyze the influence of the external cause on the environment of the legal system, the administrative environment, the public opinion environment, the soft environment of the economy, the environment of the humanistic quality and so on. The main factors in the internal cause are the police law enforcement thought. Thinking, law enforcement procedure, law enforcement skills, law enforcement art and self protection consciousness, self protection norms, police and people relations, psychological quality, etc. This paper introduces the public management theory into the field of systematic analysis and prevention of assaulting police problems, through systematic analysis of the causes of the occurrence of assaulting police, the use of environmental impact and quality management in public management. The process method, the system method, the continuous improvement and so on, put forward to solve the problem from three aspects, such as strengthening the construction of the rule of law, optimizing the construction of the rule of law, optimizing the prevention of the assaulting police problem, and implementing the process management of the prevention of the attack on the assaulting police problem, and improving the evaluation of the prevention effect and the improvement of the system construction of the attack on the attack. The image of the implementation of strategic management, the law enforcement authority so as to establish the height of the police, effectively curb acts of assaulting a police officer.
This article emphasizes that the addition of the crime of assaulting the police is not an urgent matter for the public security organs and the majority of the police, but to actively strive for it, the key is to correct the attitude, practise the basic skills, the internal and external training, the close relationship between the police and the people, punish the assaulting police according to law, attack the arrogance of the criminals who dare to publicly attack the police and establish the law enforcement of the police. Authority means advocating "ex post protection to ex ante protection, expanding from internal protection to social protection, from administrative protection to legal protection" mode.
In a word, there are complicated social reasons that impede police execution and violence attacks, so the prevention of assaulting police should be from perfecting laws and regulations, improving system norms, strengthening post training, increasing police force at the grass-roots level, improving police equipment, building a harmonious relationship between police and people, improving law enforcement supervision, implementing rescue measures and strengthening public opinion. We should publicize and improve the work mechanism of safeguarding rights and other aspects.
Finally, the direction of further work is briefly discussed.
