【摘要】：社區(qū)矯正作為刑罰從以監(jiān)禁刑為主向以非監(jiān)禁刑為主轉(zhuǎn)變的世界性發(fā)展趨勢的主要標(biāo)志之一,是我國刑罰執(zhí)行領(lǐng)域的一個嶄新課題。加快社區(qū)矯正制度的本土化構(gòu)建,不僅符合我國構(gòu)建社會主義和諧社會的客觀要求,契合我國發(fā)展中國家的現(xiàn)實(shí)國情,而且從長遠(yuǎn)看,有助于推進(jìn)我國司法體制改革的進(jìn)程。為此,本文從辨析社區(qū)矯正的概念和基本屬性入手,探究社區(qū)矯正制度的思想源流和沿革以及其在美國、日本等國的應(yīng)用情況。對社區(qū)矯正制度的普遍價值,我國開展本土化構(gòu)建的特殊價值以及其存在的不足和缺陷進(jìn)行了全面評析。并在總結(jié)我國部分省(自治區(qū)、直轄市)兩年多來的社區(qū)矯正試點(diǎn)工作得失的基礎(chǔ)上,著重就社區(qū)矯正制度本土化構(gòu)建的有效途經(jīng)進(jìn)行了系統(tǒng)探討,提出了重構(gòu)刑罰理念、完善立法規(guī)制、規(guī)范運(yùn)作機(jī)制等思路,以期望對這一新生事物的探索對我國社區(qū)矯正工作的發(fā)展有所裨益。
[Abstract]:Community correction, as one of the main signs of the world development trend of penalty from imprisonment penalty to non-imprisonment penalty, is a new subject in the field of penalty execution in our country.Speeding up the localization of community correction system is not only in line with the objective requirements of building a harmonious socialist society in our country, but also in line with the actual conditions of developing countries in China, and in the long run, it is helpful to promote the process of judicial system reform in our country.Therefore, starting with the concept and basic attributes of community correction, this paper probes into the origin and evolution of community correction system and its application in the United States, Japan and other countries.This paper analyzes the universal value of community correction system, the special value of localization construction in our country, and its shortcomings and defects.On the basis of summing up the gains and losses of some provinces (autonomous regions and municipalities directly under the Central Government) in the past two years, the effective ways of the localization of community correction system are discussed systematically, and the concept of reconstructing penalty is put forward.It is expected that the exploration of this new thing will benefit the development of community correction in our country.
